An Act relating to quarantine protocols; amending 63 
O.S. 2021, Section 1-504, which relates to quaran tine 
procedures; clarifying language; a mending 63 O.S. 
2021, Section 1-505, which relates to the removal of 
quarantined individual; modifying policy; repealing 
63 O.S. 2021, Sections 1-506 and 1-507, which relate 
to school attendance of diseased pup ils; and 
providing an effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    AMENDATORY     63 O.S. 2021, Section 1-504, is 
amended to read as follows : 
Section 1-504. A.  Whenever a local health officer determi nes 
or suspects that a person has been e xposed to and may be incubating 
a communicable disease of public healt h concern, the local he alth 
officer may impose a quarantine upon such person and require such 
person to remain out of public contact and in the pl ace or premises 
where such person usuall y stays.  Notice thereof shall be given in 
accordance with the rules a nd regulations of the S tate Board of 
Health.  It shall be unlawful for such person, or any othe r person, 
to violate the terms or conditions of the quarantine.

B.  Whenever a local health officer determines or suspects that 
a person has a communicable disea se of public health con cern, the 
local health officer may impose isolation upon such person and 
require such person to remain out of public contac t and in an 
adequate treatment facility or in the place or premises where such 
person usually stays.  Notice t hereof shall be given i n accordance 
with the rules and regulations of the State Board of Health .  It 
shall be unlawful for such person, or any oth er person, to violate 
the terms or conditions of the isolation. 
C.  No person having or suspected of having a communicable 
disease shall be compelled to be moved from the place where he or 
she is sick to any place other than his or her own residence unless 
the individual does not reside in a per manent residence. 
D. District courts shall be authorized to grant injunctive 
relief, including temporary injunctions and temporary restraining 
orders, to overturn or compel compliance with a quarantine or 
isolation order issued by a local health officer p ursuant to this 
section. 
SECTION 2.    AMENDATORY     63 O.S. 2021, Section 1-505, is 
amended to read as follows : 
Section 1-505. A local health officer may cause any person in 
his jurisdiction, found to be infected with Any person having a 
communicable disease, to be removed to a hospital or other pl ace for 
the reception of infected persons, unless such person be sick in his

own place of residence or cannot be moved without danger to his life 
may be prohibited from attending a private, public, or parochial 
school.  It shall be the duty of the parent or guardian of s uch 
person to exclude from the s chool such person in compliance with the 
school's communicable disease policy.  School boards shall make 
communicable disease policy in conjunction with local health 
department authorities and the State Department of Health . 
SECTION 3.     REPEALER     63 O.S. 2021, Section 1-506, is 
hereby repealed. 
SECTION 4.     REPEALER     63 O.S. 2021, Section 1-507, is 
hereby repealed. 
SECTION 5.  This act shall become effective November 1, 2022.
