4040 An Act relating to elections; amending 26 O.S. 2021,
4141 Section 3-101, which relates to election dates;
4242 modifying dates for certain el ections; providing
4343 exception; and providing an effective date.

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. AMENDATORY 26 O.S. 2021, Section 3-101 is
5050 amended to read as follows:
5151 A. No election requi red to be conducted by any county election
5252 board shall be scheduled for a day other than Tu esday.
5353 B. Except as otherwise provided by law, no regular or special
5454 election to fill an elective office for any purpose shall be held by
5555 any county, school distric t, technology center school district,
5656 municipality, fire protection district or other polit ical
5757 subdivision authorized to call elections except as follows:
5858 1. The second Tuesday of February in any year;
5959 2. The first Tuesday of Ap ril in any year;
6060 3. The date of any regularly scheduled statewide state or
6161 federal election in an even -numbered year;

8888 4. The second Tuesday of September in an odd -numbered year;
8989 5. The second Tuesday of November in an odd -numbered year; and
9090 6. The second Tuesday of June of an odd-numbered year for a
9191 special election to fill a vacancy.
9292 C. Except as otherwise provide d by law or by Section 1 of this
9393 act, no election for any purpose other than to fill an elective
9494 office shall be held by any county, school district, technology
9595 center school district, municipality, fire protection district or
9696 other political subdivision a uthorized to call elections except on:
9797 1. The second Tuesday of January, February, May, June, July,
9898 August, September, October and November and the first Tuesday in
9999 March and April in odd -numbered years; provided, a municipality with
100100 a population in exces s of two hundred fifty thousand (250,000)
101101 persons, according to the most recent federal decennial census, may
102102 also hold an election on the s econd Tuesday of December in odd-
103103 numbered years; and
104104 2. The second Tuesday of January and February, the first
105105 Tuesday in March and April, the last Tuesday in June, the fourth
106106 Tuesday in August, and the first Tuesday after the first Monday in
107107 November of any even-numbered year The provisions of subsection B of
108108 this section shall not apply to a special election called by the
109109 Governor to fill a vacancy i n an elective office .
110110 D. In the event that a regular or special election date occurs
111111 on an official state holiday, the election sha ll be scheduled for

138138 the next following Tuesday. In the event that any day of a
139139 candidate filing period occurs on a Saturda y, Sunday or any official
140140 state holiday, that day of the filing period shall be scheduled for
141141 the next business day.
142142 E. Notwithstanding any other provision of law or any provision
143143 of a municipal charter, any municipality, s chool district,
144144 technology center district, county, rural fire protection district,
145145 or any other entity seeking to hold a regular or special election to
146146 be conducted by a county election board on the same date as a
147147 regular or special federal or state elect ion, shall file the
148148 resolution calling for the election with the county election board
149149 secretary no later than seventy -five (75) days prior to the election
150150 date. A candidate filing period of three (3) days, if so required
151151 by the resolution, shall begin no later than ten (10) days follow ing
152152 the deadline to file the resolution with the secretary of the county
153153 election board; provided, the filing period for such municip al
154154 office may be scheduled on the same dates as the filing period for
155155 state or federal offi ce to be filled at such election .
156156 F. Any school district, technology center district,
157157 municipality, including any municipality governed by charter, rural
158158 fire protection district or any other entity seeking to hold a
159159 special election for the purpose of fi lling a vacancy shall schedule
160160 a candidate filing period of three (3) days to begin not more than
161161 twenty (20) days following the date the resolution calling the
