4040 An Act relating to elections; amending 26 O.S. 2021,
4141 Section 3-101, which relates to election dates;
4242 requiring certain entities to provide written notice

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 26 O.S. 2021, Section 3 -101, is
5252 amended to read as follow s:
5353 Section 3-101. A. No election required to be conducted by any
5454 county election board shall be s cheduled for a day other than
5555 Tuesday.
5656 B. Except as otherwi se provided by law, no regular or special
5757 election to fill an elective office shall be held by any county,
5858 school district, technology center school district, municipality,
5959 fire protection distri ct or other political subdivision autho rized
6060 to call elections except as follows:
6161 1. The second Tuesday of February in a ny year;
6262 2. The first Tuesday of Apr il in any year;

8989 3. The date of any regularly scheduled statewide state or
9090 federal election in an even-numbered year;
9191 4. The second Tuesday of September in an odd-numbered year;
9292 5. The second Tuesday of November in an odd-numbered year; and
9393 6. The second Tuesday of June of an odd -numbered year for a
9494 special election to fill a vac ancy.
9595 C. Except as otherwise provided by law or by Section 1 of this
9696 act, no election for any purpose other than to fill an elective
9797 office shall be held by any county, school d istrict, technology
9898 center school district, municipality, fire protection district or
9999 other political subdivision authorized to call elections except on:
100100 1. The second Tuesday of January, February, May, June, July,
101101 August, September, October and November and the first Tuesday in
102102 March and April in odd-numbered years; provided, a municipality with
103103 a population in excess of two hundred fifty thousand (250,000)
104104 persons, according to the most recent federal decennial census , may
105105 also hold an election on the se cond Tuesday of December in odd-
106106 numbered years; and
107107 2. The second Tuesday of January and February, the first
108108 Tuesday in March and April, the last Tuesday in J une, the fourth
109109 Tuesday in August, and the first Tuesday aft er the first Monday in
110110 November of any even-numbered year.
111111 D. In the event that a regular or speci al election date occurs
112112 on an official state holiday, the election shall be scheduled for

139139 the next following Tuesday. In the event that any day of a
140140 candidate filing period occurs on a Saturday , Sunday or any official
141141 state holiday, that day of the filing period shall be scheduled for
142142 the next business day.
143143 E. Notwithstanding any other provision of law or any provision
144144 of a municipal charter, any municipalit y, school district,
145145 technology center district, county, rural fire protection district,
146146 or any other entity seeking to hold a regular or special election to
147147 be conducted by a county election board on the same date as a
148148 regular or special federal or state e lection, shall file the
149149 resolution calling for the election with the county election board
150150 secretary no later than seventy-five (75) days prior to the election
151151 date. A candidate filing period of three (3) days, if so required
152152 by the resolution, shall begi n no later than ten (10) days followi ng
153153 the deadline to file the resolution with the secretary of t he county
154154 election board; provided, the filing period for such municipal
155155 office may be scheduled on the same dates as the filing period for
156156 state or federal office to be filled at such election.
157157 F. Any school district, technology center district,
158158 municipality, including any municipality governed by charter, rural
159159 fire protection district or any other entity seeking to hold a
160160 special election for the purpose o f filling a vacancy shall schedule
161161 a candidate filing period of three (3) days to begin not more th an
162162 twenty (20) days following the date the resolution calling the

189189 election is required to be file d with the secretary of the county
190190 election board.
191191 G. Any entity calling an election pursuant to subsection C of
192192 this section shall provide written notice to every regis tered voter
193193 eligible to vote in the election informing the voter of the upcoming
194194 election. The written notice shall contain:
195195 1. The date of the election ; and
196196 2. The website address of the entity calling the election that
197197 allows the voter to re view the text of the proposed ballot.
198198 SECTION 2. This act shall become effective November 1, 2022.
