41	41	Section 3-101, which relates to election dates;
42	42	requiring certain entities to provide written notice
43	43	to voters prior to election; and providing an

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 26 O.S. 2021, Section 3 -101, is
52	52	amended to read as follow s:
53	53	Section 3-101. A. No election required to be conducted by any
54	54	county election board shall be s cheduled for a day other than
55	55	Tuesday.
56	56	B. Except as otherwi se provided by law, no regular or special
57	57	election to fill an elective office shall be held by any county,
58	58	school district, technology center school district, municipality,
59	59	fire protection distri ct or other political subdivision autho rized
60	60	to call elections except as follows:
61	61	1. The second Tuesday of February in a ny year;
62	62	2. The first Tuesday of Apr il in any year;

89	89	3. The date of any regularly scheduled statewide state or
90	90	federal election in an even-numbered year;
91	91	4. The second Tuesday of September in an odd-numbered year;
92	92	5. The second Tuesday of November in an odd-numbered year; and
93	93	6. The second Tuesday of June of an odd -numbered year for a
94	94	special election to fill a vac ancy.
95	95	C. Except as otherwise provided by law or by Section 1 of this
96	96	act, no election for any purpose other than to fill an elective
97	97	office shall be held by any county, school d istrict, technology
98	98	center school district, municipality, fire protection district or
99	99	other political subdivision authorized to call elections except on:
100	100	1. The second Tuesday of January, February, May, June, July,
101	101	August, September, October and November and the first Tuesday in
102	102	March and April in odd-numbered years; provided, a municipality with
103	103	a population in excess of two hundred fifty thousand (250,000)
104	104	persons, according to the most recent federal decennial census , may
105	105	also hold an election on the se cond Tuesday of December in odd-
106	106	numbered years; and
107	107	2. The second Tuesday of January and February, the first
108	108	Tuesday in March and April, the last Tuesday in J une, the fourth
109	109	Tuesday in August, and the first Tuesday aft er the first Monday in
110	110	November of any even-numbered year.
111	111	D. In the event that a regular or speci al election date occurs
112	112	on an official state holiday, the election shall be scheduled for

139	139	the next following Tuesday. In the event that any day of a
140	140	candidate filing period occurs on a Saturday , Sunday or any official
141	141	state holiday, that day of the filing period shall be scheduled for
142	142	the next business day.
143	143	E. Notwithstanding any other provision of law or any provision
144	144	of a municipal charter, any municipalit y, school district,
145	145	technology center district, county, rural fire protection district,
146	146	or any other entity seeking to hold a regular or special election to
147	147	be conducted by a county election board on the same date as a
148	148	regular or special federal or state e lection, shall file the
149	149	resolution calling for the election with the county election board
150	150	secretary no later than seventy-five (75) days prior to the election
151	151	date. A candidate filing period of three (3) days, if so required
152	152	by the resolution, shall begi n no later than ten (10) days followi ng
153	153	the deadline to file the resolution with the secretary of t he county
154	154	election board; provided, the filing period for such municipal
155	155	office may be scheduled on the same dates as the filing period for
156	156	state or federal office to be filled at such election.
157	157	F. Any school district, technology center district,
158	158	municipality, including any municipality governed by charter, rural
159	159	fire protection district or any other entity seeking to hold a
160	160	special election for the purpose o f filling a vacancy shall schedule
161	161	a candidate filing period of three (3) days to begin not more th an
162	162	twenty (20) days following the date the resolution calling the

190	190	election board.
191	191	G. Any entity calling an election pursuant to subsection C of
192	192	this section shall provide written notice to every regis tered voter
193	193	eligible to vote in the election informing the voter of the upcoming
194	194	election. The written notice shall contain:
195	195	1. The date of the election ; and
196	196	2. The website address of the entity calling the election that
197	197	allows the voter to re view the text of the proposed ballot.
198	198	SECTION 2. This act shall become effective November 1, 2022.
