4040 An Act relating to labor; prohibiting vaccination or
4141 immunization mandates; prohibiting certain liability
4242 for employers; prohibitin g certain actions of
4343 employees; providing penalty; providing exceptions;
4444 providing for codification; and providing an

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law to be codified
5252 in the Oklahoma Statutes as Section 191.1 of Title 40, unless there
5353 is created a duplication in numbering, reads as follows:
5454 A. A public or private employer shall not mandate the
5555 requirement of an employee or contractor to participat e in
5656 vaccination or immunizat ion as part of the employer 's policy,
5757 whether written or verbal.
5858 B. A public or private employer shall not be liable in a civil
5959 action claiming an injury from exposure or potential exposure to any
6060 virus, infection or disease.
6161 C. No employee or contractor employed by a public or private
6262 employer operating in this state shall:

8989 1. Be required to disclose his or her vaccination or
9090 immunization status for any virus, infection or disease;
9191 2. Receive incentives, bonuses or any othe r reward for
9292 disclosing or achieving a particular vaccination or immunization
9393 status for any virus, infection or disease;
9494 3. Be discriminated against based on his or her vaccination or
9595 immunization status for any virus, infection or disease including ,
9696 but not limited to, harassment, different treatment, denial of
9797 benefits or retaliation;
9898 4. Be terminated, demoted, disciplined, denied employment or
9999 otherwise penalized based on the employee 's vaccination or
100100 immunization status for any virus, infection or di sease;
101101 5. Be segregated from other employees based on vaccination or
102102 immunization status for any virus, infection or disease; or
103103 6. Be required to wear or display any insignia or mark, or
104104 otherwise directly or indirectly disclose his or her vaccination or
105105 immunization status for any virus, infection or disease.
106106 D. Any public or private employer in violation of this section
107107 shall be fined Five Thousand Dollars ($5,000.00) for each offense.
108108 E. This section shall not apply to the employment of an
109109 individual by his or her parents, spouse, or child or to employment
110110 in the domestic service of the employer.
