60	60	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	61	SECTION 1. NEW LAW A new section of law not to be
62	62	codified in the Oklahoma Statutes reads as foll ows:
63	63	In publishing the decennial Oklahoma Statutes , and the
64	64	cumulative supplements after July 1, 2022, West Publishing Company
65	65	shall include in such decennial statutes a nd supplements a new Title
66	66	75A, to be designated "Technology".

96	96	This act shall be known and may be cited as the "Oklahoma Low
97	97	Income Broadband Assistance Program Act".
98	98	SECTION 3. NEW LAW A new section of law to be codified
99	99	in the Oklahoma Statutes as Section 1002 of Title 75A, unless there
100	100	is created a duplication in numbering, reads as follows:
101	101	As used in this act:
102	102	1. "Broadband service" means a high speed service connection to
103	103	the public Internet capable of supporting, in at least one
104	104	direction, a speed in excess of 200 kilobits per second ( Kbps) to
105	105	the network demarcation poi nt at the subscriber 's premises;
106	106	2. "Office" means the State Broadband Coordinator 's Office;
107	107	3. "Economic unit" means all adult individuals contributing to
108	108	and sharing in the income and expenses of a household ;
109	109	4. "Family" or "household" means any individual or group of
110	110	individuals who live tog ether at the same address as one economic
111	111	unit; and
112	112	5. "Federal poverty level " means the poverty guidelines updated
113	113	periodically in the Federal Register by the U.S. Department of
114	114	Health and Human Services. These guidelines set poverty levels by
115	115	family size.

143	143	in the Oklahoma Statutes as Section 1003 of Title 75A, unless there
144	144	is created a duplication in numbering, reads as follows:
145	145	The State Broadband Coordinator 's Office shall establish an
146	146	Oklahoma Low Income Broadband Assistance Program to ensure the
147	147	availability and affordability of broadband service to low -income
148	148	families. The Office shall coordinate with local administrative
149	149	agencies to determine eligibility for the Program ; provided that
150	150	eligible income shall be no more than one hundred fifty percent
151	151	(150%) of the federal poverty level .
152	152	SECTION 5. NEW LAW A new section of law to be codified
153	153	in the Oklahoma Statutes as Section 1004 of Title 75A, unless there
154	154	is created a duplication in numbe ring, reads as follows:
155	155	A. Families whose annual household income is at or below one
156	156	hundred thirty-five percent (135%) of the federal poverty level
157	157	shall be eligible for free broadband service.
158	158	B. A credit of at least Nine Dollars and ninety-five cents
159	159	($9.95) a month for broadband services shall be payable monthly to:
160	160	1. Families whose annual household income is above one hundred
161	161	thirty-five percent (135%) of the federal poverty level but no
162	162	greater than one hundred fifty percent (150%) of the federal poverty

190	190	2. Families that include at least one adult person or dependent
191	191	child who qualifies for or received benefits under one of the
192	192	following programs:
193	193	a. Supplemental Nutrition Assistance Program ,
194	194	b. Supplemental Security Income program ,
195	195	c. Veterans Pension and Survivors Benefits Programs,
196	196	d. Federal Public Housing Assistance Program ,
197	197	e. Tribal Programs for Native Americans, or
198	198	f. National School Lunch Program.
199	199	Credit amounts provided under this subsection may be adjusted
200	200	according to family size as prescribed by the State Broadband
201	201	Coordinator's Office.
202	202	C. Families who receive a discount for broadband service under
203	203	the federal Lifeline program or any other state Internet service
204	204	subsidy program shall n ot be eligible to participate in the Oklahoma
205	205	Low Income Broadband Assistance Program if they elect to remain
206	206	enrolled in the aforementioned programs .
207	207	SECTION 6. NEW LAW A n ew section of law to be codified
208	208	in the Oklahoma Statutes a s Section 1005 of Title 75A, unless there
209	209	is created a duplication in numbering, reads as follows:
210	210	To be eligible for free broadband service or a monthly credit
211	211	for broadband service under this act, an applicant must provide
212	212	proof of eligibility in the for m and manner prescribed by the State
213	213	Broadband Coordinator 's Office.

241	241	in the Oklahoma Statutes as Section 1006 of Title 75A, unless there
242	242	is created a duplication in numbering, r eads as follows:
243	243	A. For each family enrolled in the Oklahoma Low Income
244	244	Broadband Assistance Program, the State Broadband Coordinator 's
245	245	Office shall remit, through the local administrative agencies, to
246	246	the broadband service provider that portion of the fa mily's bill
247	247	that is not the responsibility of the family. For purposes of this
248	248	section, payment is due on the date specified on the family 's bill.
249	249	The Office, Oklahoma Tax Commission, and local administrative
250	250	agencies shall adopt processes that provide f or the timely payment
251	251	required by this section.
252	252	B. Each family that receives a credit for broadband service
253	253	under subsection B of Section 5 of this act is responsible for all
254	254	actual charges for broadband service in excess of the credit
255	255	provided under subsection B of Section 5 of this act. The Office
256	256	may terminate a program participant 's eligibility for the credit
257	257	available under subsection B of Section 5 of this act upon
258	258	notification by the broadband serv ice provider that the
259	259	participant's monthly service payment is more than forty-five (45)
260	260	days past due.
261	261	SECTION 8. NEW LAW A new section of law to be codified
262	262	in the Oklahoma Statutes as Section 1007 of Title 75A, unless there
