6060 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6161 SECTION 1. NEW LAW A new section of law not to be
6262 codified in the Oklahoma Statutes reads as foll ows:
6363 In publishing the decennial Oklahoma Statutes , and the
6464 cumulative supplements after July 1, 2022, West Publishing Company
6565 shall include in such decennial statutes a nd supplements a new Title
6666 75A, to be designated "Technology".

9393 SECTION 2. NEW LAW A new section of law to be codified
9494 in the Oklahoma Statutes as Section 1001 of Title 75A, unless there
9595 is created a duplication in numbering, reads as follows:
9696 This act shall be known and may be cited as the "Oklahoma Low
9797 Income Broadband Assistance Program Act".
9898 SECTION 3. NEW LAW A new section of law to be codified
9999 in the Oklahoma Statutes as Section 1002 of Title 75A, unless there
100100 is created a duplication in numbering, reads as follows:
101101 As used in this act:
102102 1. "Broadband service" means a high speed service connection to
103103 the public Internet capable of supporting, in at least one
104104 direction, a speed in excess of 200 kilobits per second ( Kbps) to
105105 the network demarcation poi nt at the subscriber 's premises;
106106 2. "Office" means the State Broadband Coordinator 's Office;
107107 3. "Economic unit" means all adult individuals contributing to
108108 and sharing in the income and expenses of a household ;
109109 4. "Family" or "household" means any individual or group of
110110 individuals who live tog ether at the same address as one economic
111111 unit; and
112112 5. "Federal poverty level " means the poverty guidelines updated
113113 periodically in the Federal Register by the U.S. Department of
114114 Health and Human Services. These guidelines set poverty levels by
115115 family size.

142142 SECTION 4. NEW LAW A new section of law to be codified
143143 in the Oklahoma Statutes as Section 1003 of Title 75A, unless there
144144 is created a duplication in numbering, reads as follows:
145145 The State Broadband Coordinator 's Office shall establish an
146146 Oklahoma Low Income Broadband Assistance Program to ensure the
147147 availability and affordability of broadband service to low -income
148148 families. The Office shall coordinate with local administrative
149149 agencies to determine eligibility for the Program ; provided that
150150 eligible income shall be no more than one hundred fifty percent
151151 (150%) of the federal poverty level .
152152 SECTION 5. NEW LAW A new section of law to be codified
153153 in the Oklahoma Statutes as Section 1004 of Title 75A, unless there
154154 is created a duplication in numbe ring, reads as follows:
155155 A. Families whose annual household income is at or below one
156156 hundred thirty-five percent (135%) of the federal poverty level
157157 shall be eligible for free broadband service.
158158 B. A credit of at least Nine Dollars and ninety-five cents
159159 ($9.95) a month for broadband services shall be payable monthly to:
160160 1. Families whose annual household income is above one hundred
161161 thirty-five percent (135%) of the federal poverty level but no
162162 greater than one hundred fifty percent (150%) of the federal poverty

190190 2. Families that include at least one adult person or dependent
191191 child who qualifies for or received benefits under one of the
192192 following programs:
193193 a. Supplemental Nutrition Assistance Program ,
194194 b. Supplemental Security Income program ,
195195 c. Veterans Pension and Survivors Benefits Programs,
196196 d. Federal Public Housing Assistance Program ,
197197 e. Tribal Programs for Native Americans, or
198198 f. National School Lunch Program.
199199 Credit amounts provided under this subsection may be adjusted
200200 according to family size as prescribed by the State Broadband
201201 Coordinator's Office.
202202 C. Families who receive a discount for broadband service under
203203 the federal Lifeline program or any other state Internet service
204204 subsidy program shall n ot be eligible to participate in the Oklahoma
205205 Low Income Broadband Assistance Program if they elect to remain
206206 enrolled in the aforementioned programs .
207207 SECTION 6. NEW LAW A n ew section of law to be codified
208208 in the Oklahoma Statutes a s Section 1005 of Title 75A, unless there
209209 is created a duplication in numbering, reads as follows:
210210 To be eligible for free broadband service or a monthly credit
211211 for broadband service under this act, an applicant must provide
212212 proof of eligibility in the for m and manner prescribed by the State
213213 Broadband Coordinator 's Office.

240240 SECTION 7. NEW LAW A new section of law to be codified
241241 in the Oklahoma Statutes as Section 1006 of Title 75A, unless there
242242 is created a duplication in numbering, r eads as follows:
243243 A. For each family enrolled in the Oklahoma Low Income
244244 Broadband Assistance Program, the State Broadband Coordinator 's
245245 Office shall remit, through the local administrative agencies, to
246246 the broadband service provider that portion of the fa mily's bill
247247 that is not the responsibility of the family. For purposes of this
248248 section, payment is due on the date specified on the family 's bill.
249249 The Office, Oklahoma Tax Commission, and local administrative
250250 agencies shall adopt processes that provide f or the timely payment
251251 required by this section.
252252 B. Each family that receives a credit for broadband service
253253 under subsection B of Section 5 of this act is responsible for all
254254 actual charges for broadband service in excess of the credit
255255 provided under subsection B of Section 5 of this act. The Office
256256 may terminate a program participant 's eligibility for the credit
257257 available under subsection B of Section 5 of this act upon
258258 notification by the broadband serv ice provider that the
259259 participant's monthly service payment is more than forty-five (45)
260260 days past due.
261261 SECTION 8. NEW LAW A new section of law to be codified
262262 in the Oklahoma Statutes as Section 1007 of Title 75A, unless there

291291 necessary to implement the provisions of this act.
292292 SECTION 9. This act shall become effective November 1, 2022.
