49	49	BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
50	50	SECTION 1. AMENDATORY 17 O.S. 2021, Section 139.203, is
51	51	amended to read as follows :
52	52	Section 139.203 A. On or before October 31, 2021, and annually
53	53	thereafter, in accordance with the FCC Data Collection and
54	54	Methodology, private broadband service providers operating i n this
55	55	state and satellite-based broadband private providers that hav e been
56	56	designated as an eligible telecommunications carrier pursuant to 47
57	57	U.S.C., Section 214(e)(6) for any portion of Oklahoma, here inafter
58	58	referred to as "private providers", shall submit to the Oklahoma
59	59	Department of Commerce and the Rural Broadband Ex pansion Council the
60	60	broadband network area coverage map data the private providers are
61	61	required to submit to the Federal Communication s Commission pursuant

87	87	to the federal Broadband Deploy ment Accuracy and Technological
88	88	Availability Act, 47 U.S.C., Section 641 et seq. The map da ta shall
89	89	be updated annually through a supplemental submission by the private
90	90	providers that reflects changes i n area coverage from the preceding
91	91	year. The Department is authorized to pro mulgate rules for the
92	92	collection of the broad band network area cover age map reports from
93	93	the private providers.
94	94	B. A. On or before October 31 of each year, OneNet, the Office
95	95	of Management and Enterprise Services and the Oklahoma D epartment of
96	96	Transportation, hereinafter referred to as "public entities", shall
97	97	submit to the Oklahoma Department of Commerce and the Rural
98	98	Broadband Expansion Council broadband network area coverage ma p data
99	99	of all assets and network coverage in the form at requested by the
100	100	Oklahoma Department of Commerce and the Council.
101	101	C. Private providers and p ublic entities shall disclose to the
102	102	Oklahoma Department of Commerce and the Rural Broadband Expansion
103	103	Council the properties they serve and the maximum adverti sed
104	104	download and upload speeds at which they provide any Internet
105	105	services to those properties, and shall be afforded by the Oklahoma
106	106	Department of Commerce and the Council a process to petition for
107	107	correction of potential inaccuracies in the map.
108	108	D. The reports and information require d to be disclosed
109	109	pursuant to this section by private providers shall remain
110	110	confidential pursuant to Section 24A.10 of Title 51 of the Oklahoma

136	136	Statutes. The Council shal l determine the required submission
137	137	format of the data submitted under the provision s of this act. In
138	138	no instance shall private providers be require d to submit any data,
139	139	in substantive content or form or schedule, beyond or in advance of
140	140	the data described in subsection A of this section, or any data
141	141	containing customer information, such as names, addresses or account
142	142	numbers. The Department shall use a third party to collect the data
143	143	submitted by private providers under the provisions of this act.
144	144	The third party shall deliver data to the Department follo wing a
145	145	white label process to r emove information identifying specific
146	146	providers.
147	147	E. B. On or before December 1 of each year, the Department
148	148	Department of Commerce and the Council shall update the map re quired
149	149	by subsection G of Section 139.202 of Title 17 of the Oklahoma
150	150	Statutes this title using the data collected under the provisions of
151	151	this act in a manner that i dentifies the assets and service areas of
152	152	the public entities while displaying anonymized information, without
153	153	reference to any specific privat e provider, of the assets a nd
154	154	service areas of private providers.
155	155	F. After the FCC completes the national Broadb and Serviceable
156	156	Location Fabric and accompanying National Broadband Availability
157	157	Map, the Rural Broadband Expansion Council shall annually eval uate
158	158	whether the State of O klahoma needs to continue producing an

186	186	SECTION 2. This act shall be come effective November 1, 2022.
