No. 8892 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 STATE OF OKLAHOMA 2nd Session of the 58th Legislature (202 2) HOUSE BILL 3194 By: Williams AS INTRODUCED An Act relating to schools; creating the Oklahoma Education Commission; setting expiration date of Commission; providing for membership ; requiring organizational meeting by certain date; directing certain members to serve as chair and vice-chair; requiring approval of qu orum for final action; specifying quorum requirement; providing for frequency of meetings; prescribing duties of Commission; subjecting meetings to the Oklahoma Open Meeting Act; prohibiting compensation or travel reimbursement for members; providing for staff support; requiring submission of certain report by certain date; providing for codification; and providing an effective date. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 14-201 of Title 70, unless there is created a duplication in numb ering, reads as follows : A. There is hereby created until November 1, 2027, the Oklahoma Education Commission . B. The Commission shall consist of fifteen (15) members to be appointed as follows: Req. A member of the Oklahoma House of Representative s shall be appointed by the Speaker of the Oklahoma House of Representatives; 2. A member of the Oklahoma State Senate shall be appointed by the President Pro Tempore of the Oklahoma State Senate; 3. The Director of the Department of Corrections, or his or her designee; 4. Four members with expertise in online and educational innovation shall be appointed by t he Chancellor of Higher Education, one of whom shall be a representative of the Oklahoma State Regents for Higher Education , one of whom shall be a representative of a research institution within The Oklahoma State System of Higher Education, one of whom shall be a representative of regional institution within The Oklahoma State System of Higher Education, and one of whom shall be a representative of a comm unity college within The Oklahoma State System of Higher Education; 5. Four members with expertise in effective approaches to classroom instruction and learning or educational innovation shall be appointed by the S uperintendent of Public Instruction , one of whom shall represent the State Department of Education, one of whom shall be a school district administrator, one of whom shall be a classroom certified teacher, and one of whom shall be a high school student; and 6. Four members with expertise in effe ctive approaches to career and technology education instruction and learning or Req. No. 8892 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 educational innovati on shall be appointed by the Director of the Oklahoma Department of Career and Technology Education , one of whom shall represent the Oklahoma Department of Career and Technology Education, one of whom shall be an administrator of a state technology center school or college, one of whom shall be a certified teacher at a state technology center school or college, and one shall be a student enrolled at a state t echnology center school or college. C. The Commission shall hold an organizational meeting not later than ninety (90) days after the effective date of this act . The member of the Oklahoma House of Representatives shall serve as chair of the Commission and the member of the Okl ahoma State Senate shall serve as vice-chair. A quorum of the membership of the Commission shall be required to approve any final action of the Commission. For purposes of this section, eight members shall constitute a quorum. D. The Commission may meet as often as required to perform the duties imposed upon it, but shall meet at least quarterly. E. The Commission shall engage multiple stakeholders in research, evaluation, and information shar ing to conduct a study on how to improve the quality of instruction and learning through distance and remote modalities. Topic areas of the st udy shall include, but are not limited to: 1. Support infrastructure; Req. No. 8892 Page 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2. Open education resources; 3. Compliance with the federal Americans with Disabilities Act; 4. Professional development; and 5. Modality research. F. The Commission shall be subject to the Oklahoma Open Meeting Act and the Oklahoma Open Records Act. G. Members of the Commission shall not receive compensation or travel reimbursement. H. The Oklahoma House of Representatives shall provide staff and administrative support f or the Commission. I. The Commission shall submit a report of its findings and recommendations no later than November 1, 2027, to the Governor, the President Pro Tempore of the Oklahoma State Senate and the Speaker of the Oklahoma House of Representatives. SECTION 2. This act shall become effective November 1, 2022. 58-2-8892 EK 01/16/22
