26 | 52 | SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.6, is | |
27 | 53 | amended to read as fol lows: | |

29 | 54 | Section 199.6 A. The State Board of Cosmetology and Barbering | |
30 | 55 | is hereby authorized to promulgate rules for governing the | |
31 | 56 | examination and licensure of cosmetologists, manicurists, nail | |
32 | 57 | technicians, estheti cians, cosmeticians, hair braiding technicians, | |
33 | 58 | master cosmetology instructors, manicurist instructo rs, esthetics | |
34 | 59 | instructors, barbers, and master barber instructors. The Board is | |
35 | 60 | hereby authorized to promulgate rules to govern the sanitary | |
36 | 61 | operation of cosmetology and barbering establish ments and to | |
37 | 62 | administer fines not to exceed Fifty Dollars ($50.00) for those | |
38 | 63 | licensed and not to exceed Five Hundred Dollars ($500.00) for those | |

43 | 94 | power and duty to impleme nt rules of the Board, to issue and renew | |
44 | 95 | licenses, to inspect cosmetology and barbering establishments and | |
45 | - | schools, and to inspect the sanitary operating p ractices of | |

46 | 97 | cosmetology and barber ing licensees, including sanitary conditions | |
47 | 98 | of cosmetology and ba rbering establishments and schools. | |

49 | 99 | C. It shall be unlawful and constitute a misdemeanor, | |
50 | 100 | punishable upon conviction by a fine of not less than Fifty Dolla rs | |
51 | 101 | ($50.00), nor more than One Hun dred Fifty Dollars ($150.00), or by | |
52 | 102 | imprisonment in the county jai l for not more than thirty (30) days, | |
53 | 103 | or both such fine and imprisonment, for any person, firm, or | |
54 | 104 | corporation in this state to: | |

56 | 105 | 1. Operate or attempt to o perate a cosmetology school/college, | |
57 | 106 | cosmetology or barber establishment, cosmetology or barber scho ol or | |
58 | 107 | college that offers cosmetology, barbering or both without having | |
59 | 108 | obtained a license therefor from the State Board of Cosmetology and | |
60 | 109 | Barbering; | |

62 | 110 | 2. Give or attempt to give instruction in cosmetology or | |
63 | 111 | barbering, without having obtained an instructo r's license from the | |

73 | 145 | 5. Demonstrate a cosmetic preparation without having obtained a | |
74 | 146 | demonstrator's license from the Board; | |

76 | 147 | 6. Permit any person in one 's employ, supervision, or contro l | |
77 | 148 | to practice cosmetology or barbe ring unless that person has obtained | |
78 | 149 | an appropriate license from t he Board; | |
79 | - | ||
80 | 150 | 7. Willfully violate any rule promulgated by the Board for the | |
81 | 151 | sanitary management and operation of a cosmetology or barber | |
82 | 152 | establishment, cosmet ology school or barber college; or | |
83 | - | ||
84 | 153 | 8. Violate any of the provisions of the Oklahoma Cosmetology | |
85 | 154 | and Barbering Act. | |
86 | - | ||
87 | 155 | D. The State Board of Cosmetology and Barbering shall have the | |
88 | 156 | authority to levy administrative fines not to exceed Five Hundred | |
89 | 157 | Dollars ($500.00) for persons practicing cos metology or barbering | |
90 | - | without a license, and for owners of license d establishments who | |
158 | + | without a license, and for owners of license d establishments who | |
91 | 159 | allow unlicensed individuals to practice cosmetology or barbering | |

112 | 201 | services in the course of and inc idental to the business or | |
113 | 202 | employers engaged in the theatrical, radio, television , or motion | |
114 | 203 | picture production industries, modeling , or photography. | |
