2451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2652 SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.6, is
2753 amended to read as fol lows:

2954 Section 199.6 A. The State Board of Cosmetology and Barbering
3055 is hereby authorized to promulgate rules for governing the
3156 examination and licensure of cosmetologists, manicurists, nail
3257 technicians, estheti cians, cosmeticians, hair braiding technicians,
3358 master cosmetology instructors, manicurist instructo rs, esthetics
3459 instructors, barbers, and master barber instructors. The Board is
3560 hereby authorized to promulgate rules to govern the sanitary
3661 operation of cosmetology and barbering establish ments and to
3762 administer fines not to exceed Fifty Dollars ($50.00) for those
3863 licensed and not to exceed Five Hundred Dollars ($500.00) for those

3991 not licensed. Each day a violation continues shall be construed as
4092 a separate offense.

4293 B. The State Board of Cosmetology and Barbering shall have the
4394 power and duty to impleme nt rules of the Board, to issue and renew
4495 licenses, to inspect cosmetology and barbering establishments and
45-schools, and to inspect the sanitary operating p ractices of ENR. H. B. NO. 3195 Page 2
96+schools, and to inspect the sanitary operating p ractices of
4697 cosmetology and barber ing licensees, including sanitary conditions
4798 of cosmetology and ba rbering establishments and schools.

4999 C. It shall be unlawful and constitute a misdemeanor,
50100 punishable upon conviction by a fine of not less than Fifty Dolla rs
51101 ($50.00), nor more than One Hun dred Fifty Dollars ($150.00), or by
52102 imprisonment in the county jai l for not more than thirty (30) days,
53103 or both such fine and imprisonment, for any person, firm, or
54104 corporation in this state to:

56105 1. Operate or attempt to o perate a cosmetology school/college,
57106 cosmetology or barber establishment, cosmetology or barber scho ol or
58107 college that offers cosmetology, barbering or both without having
59108 obtained a license therefor from the State Board of Cosmetology and
60109 Barbering;

62110 2. Give or attempt to give instruction in cosmetology or
63111 barbering, without having obtained an instructo r's license from the
64112 Board;

66140 3. Practice or offer to practice barbering, cosmetology or
67141 manicuring without having obtained a license therefor from the
68142 Board;

70143 4. Operate a cosmetic studio wi thout having obtained a license
71144 therefor from the Board;

73145 5. Demonstrate a cosmetic preparation without having obtained a
74146 demonstrator's license from the Board;

76147 6. Permit any person in one 's employ, supervision, or contro l
77148 to practice cosmetology or barbe ring unless that person has obtained
78149 an appropriate license from t he Board;
79-
80150 7. Willfully violate any rule promulgated by the Board for the
81151 sanitary management and operation of a cosmetology or barber
82152 establishment, cosmet ology school or barber college; or
83-
84153 8. Violate any of the provisions of the Oklahoma Cosmetology
85154 and Barbering Act.

87155 D. The State Board of Cosmetology and Barbering shall have the
88156 authority to levy administrative fines not to exceed Five Hundred
89157 Dollars ($500.00) for persons practicing cos metology or barbering
90-without a license, and for owners of license d establishments who ENR. H. B. NO. 3195 Page 3
158+without a license, and for owners of license d establishments who
91159 allow unlicensed individuals to practice cosmetology or barbering
92160 without a license in their establishment. Each day a violation
93161 continues shall be a separate offense. The administrative fine
94162 shall not exceed a total of Five Hundred Dollars ($500.00).

96190 E. The provisions of the Oklahoma Cosmetology and Barbering Act
97191 shall not apply to the following persons while such persons are
98192 engaged in the proper discharge of their p rofessional duties:

100193 1. Funeral directors;

102194 2. Persons in the Arme d Services;

104195 3. Persons authorized to practice the healing arts or nursing;
105196 or

107197 4. Regularly employed sales people working in retail
108198 establishments engaged in the business of selling cosmeti cs in
109199 sealed packages; or
110-
111200 5. Persons employed to render cosmetolo gy or hairstyling
112201 services in the course of and inc idental to the business or
113202 employers engaged in the theatrical, radio, television , or motion
114203 picture production industries, modeling , or photography.

116204 SECTION 2. This act shall become effec tive November 1, 2022.
