40	40	An Act relating to vaccinations; providing
41	41	exemptions; prohibiting vaccination requirements;
42	42	providing for codification; and providing an

48	48	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	49	SECTION 1. NEW LAW A new section of law to be codified
50	50	in the Oklahoma Statutes as Section 3400 of Title 63, unless there
51	51	is created a duplication i n numbering, reads as follows:
52	52	A. If an employer requires any vacc ination as a requirement for
53	53	employment, such employer shall be required to offer exemptions from
54	54	the mandatory vaccination requirements. The exemptions shall be as
55	55	follows:
56	56	1. An individual having a bona fide, sincerely held religious
57	57	belief which opposes vaccination;
58	58	2. A certificate of a licensed physician, as defined in Section
59	59	725.2 of Title 59 of the Oklahoma Statutes, stating that the
60	60	physical condition of the individual is such that immunization would
61	61	endanger the life or health of the individual; or

88	88	3. A written statement by the individual objecting to
89	89	immunization,
90	90	whereupon the individual shall be exempt from the immunization laws
91	91	of an employer-mandated vaccination polic y.
92	92	B. There shall be no justification evidence need ed to be
93	93	granted such exemptions.
94	94	SECTION 2. NEW LAW A new section of law to be codified
95	95	in the Oklahoma Statutes as Section 3400.1 of Title 63, unless there
96	96	is created a duplication in numbering, reads as follows:
97	97	A. No governmental entit y within the state shall ma ndate
98	98	vaccinations for COVID-19 as a requirement for employment. These
99	99	entities include, but are not limited to , the following:
100	100	1. Any state entity organized within any executi ve department
101	101	or branch;
102	102	2. Any city or municipal entity; and
103	103	3. Any county governmental entity.
104	104	B. Any city or municipal regulation of COVID-19 vaccinations
105	105	shall be superseded by this act, as the area of public health is one
106	106	which pertains to general matters of the state and its g overnment.
107	107	SECTION 3. This act shall become effective November 1, 2022.
