4040 An Act relating to vaccinations; providing
4141 exemptions; prohibiting vaccination requirements;
4242 providing for codification; and providing an
4343 effective date.

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. NEW LAW A new section of law to be codified
5050 in the Oklahoma Statutes as Section 3400 of Title 63, unless there
5151 is created a duplication i n numbering, reads as follows:
5252 A. If an employer requires any vacc ination as a requirement for
5353 employment, such employer shall be required to offer exemptions from
5454 the mandatory vaccination requirements. The exemptions shall be as
5555 follows:
5656 1. An individual having a bona fide, sincerely held religious
5757 belief which opposes vaccination;
5858 2. A certificate of a licensed physician, as defined in Section
5959 725.2 of Title 59 of the Oklahoma Statutes, stating that the
6060 physical condition of the individual is such that immunization would
6161 endanger the life or health of the individual; or

8888 3. A written statement by the individual objecting to
8989 immunization,
9090 whereupon the individual shall be exempt from the immunization laws
9191 of an employer-mandated vaccination polic y.
9292 B. There shall be no justification evidence need ed to be
9393 granted such exemptions.
9494 SECTION 2. NEW LAW A new section of law to be codified
9595 in the Oklahoma Statutes as Section 3400.1 of Title 63, unless there
9696 is created a duplication in numbering, reads as follows:
9797 A. No governmental entit y within the state shall ma ndate
9898 vaccinations for COVID-19 as a requirement for employment. These
9999 entities include, but are not limited to , the following:
100100 1. Any state entity organized within any executi ve department
101101 or branch;
102102 2. Any city or municipal entity; and
103103 3. Any county governmental entity.
104104 B. Any city or municipal regulation of COVID-19 vaccinations
105105 shall be superseded by this act, as the area of public health is one
106106 which pertains to general matters of the state and its g overnment.
107107 SECTION 3. This act shall become effective November 1, 2022.
