5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 69 O.S. 2021, Section 302, is
5858 amended to read as follows:
5959 Section 302. A. The State Transportation Commission s hall
6060 consist of an at-large member and one (1) member from each of eight
6161 districts of the state, such districts to serve a s the maintenance
6262 districts and to include the area as follows:
6363 District 1. Wagoner, Cherokee, Adair, Sequoyah, Muskogee,
6464 Okmulgee, McIntosh and Haskell Counties.

103103 District 8. Osage, Pawnee, Nowata, Creek, Craig, Ottawa,

105105 B. The members of the Commission shall be appointed as follows:
106106 1. Members from Distri cts 5, 6, 7 and 8 an d the at-large member
107107 shall be appointed by the Governor;
108108 2. Members from Districts 2 and 3 shall be appointed by the
109109 Speaker of the House of Representatives; and
110110 3. Members from Districts 1 and 4 shall be appointed by the
111111 President Pro Tempore of the Se nate.
112112 C. Each member shall serve at the pleasure until the end of his
113113 or her appointing authority appointer's term and may be removed or
114114 replaced without with cause. Any member of the Commission shall be

141141 prohibited from voti ng on any issue in which the m ember has a direct
142142 financial interest. The Director of the Department of
143143 Transportation shall be an ex officio me mber of the Commission, but
144144 shall be entitled to vote only in case of a tie vote.
145145 D. The members of the Commiss ion each shall receive an annu al
146146 salary of Four Thousand Eight Hundred Dollars ($4,800.00), payable
147147 monthly, and each shall be entitled to recei ve travel expenses
148148 pursuant to the State Travel Reimbursement Act.
149149 SECTION 2. AMENDATORY 69 O.S. 2021, Section 305, is
150150 amended to read as follows:
151151 Section 305. There is hereby created the office of the Director
152152 of the Department of Transportation, who shall be appointed by the
153153 Governor with the advice and consent of the Senate and who shall
154154 serve at the pleasure of the Governor an at-will employee with the
155155 Governor appointing the Director from a list of three candidates
156156 submitted by the State Transportation Commissi on and may be removed
157157 or, replaced without, or fired by the Commission with cause.
158158 Compensation for the D irector shall be determined by the Governor
159159 Commission. The Director may be removed from office by a two -thirds
160160 (2/3) vote of the members elected to and constituting each chamber
161161 of the Legislature.
162162 SECTION 3. This act shall become effective November 1, 2022.
