49	49	authority setting compensation; deleting certain
50	50	removal procedure; and providing an effective date .

56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY 69 O.S. 2021, Section 302, is
58	58	amended to read as follows:
59	59	Section 302. A. The State Transportation Commission s hall
60	60	consist of an at-large member and one (1) member from each of eight
61	61	districts of the state, such districts to serve a s the maintenance
62	62	districts and to include the area as follows:
63	63	District 1. Wagoner, Cherokee, Adair, Sequoyah, Muskogee,
64	64	Okmulgee, McIntosh and Haskell Counties.

98	98	Greer, Kiowa, Harmon, Jackson, Blaine, and Tillman Counties.
99	99	District 6. Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
100	100	Ellis, Major and Woodward Counties.
101	101	District 7. Carter, Love, Murray, Grady, Coma nche, Stephens,
102	102	Cotton, Caddo and Jefferson Counties.
103	103	District 8. Osage, Pawnee, Nowata, Creek, Craig, Ottawa,
104	104	Rogers, Mayes, Delawar e, Washington and Tulsa Counties.
105	105	B. The members of the Commission shall be appointed as follows:
106	106	1. Members from Distri cts 5, 6, 7 and 8 an d the at-large member
107	107	shall be appointed by the Governor;
108	108	2. Members from Districts 2 and 3 shall be appointed by the
109	109	Speaker of the House of Representatives; and
110	110	3. Members from Districts 1 and 4 shall be appointed by the
111	111	President Pro Tempore of the Se nate.
112	112	C. Each member shall serve at the pleasure until the end of his
113	113	or her appointing authority appointer's term and may be removed or
114	114	replaced without with cause. Any member of the Commission shall be

141	141	prohibited from voti ng on any issue in which the m ember has a direct
142	142	financial interest. The Director of the Department of
143	143	Transportation shall be an ex officio me mber of the Commission, but
144	144	shall be entitled to vote only in case of a tie vote.
145	145	D. The members of the Commiss ion each shall receive an annu al
146	146	salary of Four Thousand Eight Hundred Dollars ($4,800.00), payable
147	147	monthly, and each shall be entitled to recei ve travel expenses
148	148	pursuant to the State Travel Reimbursement Act.
149	149	SECTION 2. AMENDATORY 69 O.S. 2021, Section 305, is
150	150	amended to read as follows:
151	151	Section 305. There is hereby created the office of the Director
152	152	of the Department of Transportation, who shall be appointed by the
153	153	Governor with the advice and consent of the Senate and who shall
154	154	serve at the pleasure of the Governor an at-will employee with the
155	155	Governor appointing the Director from a list of three candidates
156	156	submitted by the State Transportation Commissi on and may be removed
157	157	or, replaced without, or fired by the Commission with cause.
158	158	Compensation for the D irector shall be determined by the Governor
159	159	Commission. The Director may be removed from office by a two -thirds
160	160	(2/3) vote of the members elected to and constituting each chamber
161	161	of the Legislature.
162	162	SECTION 3. This act shall become effective November 1, 2022.
