49	40		An Act relating to contracts; prohibiting
50	41		uncontracted third-party pick-up and delivery of
51	42		food; authorizing restaurants to ter minate contracts;
52	43		creating fine for violation; creating right of
53	44		action; and providing an effective date.

59	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	51		SECTION 1. NEW LAW A new section of law to be codified
61	52		in the Oklahoma Statutes as Section 581 of Title 15, unless there is
62	53		created a duplicatio n in numbering, reads as follows:
63	54		A. A food delivery platform shall not offer pick -up or delivery
64	55		services from a restaurant without first obtaining an agreement with
65	56		the restaurant expressly authorizing the food delivery platform to
66	57		take orders and offer delivery or pick-up of the food and/or
67	58		beverages prepared by the restaurant.
	59	+	B. The agreement shall be terminated upon the restaurant 's
	60	+	written request to the food de livery platform. The food delivery
	61	+	platform shall remove the restaurant from its list o f participating

95		-	B. The agreement shall be terminated upon the restaurant 's
96		-	written request to the food de livery platform. The food delivery
97		-	platform shall remove the restaurant from its list o f participating
98	88		restaurants within seventy two (72) hours of receiving the request
99	89		for termination.
100	90		SECTION 2. NEW LAW A new section of law to be co dified
101	91		in the Oklahoma Statutes as Section 582 of Title 15, unless there is
102	92		created a duplication in numbering, reads as follows:
103	93		A. Platforms that violate this act shall be fined Two Hundred
104	94		Fifty Dollars ($250.00) plus statutory assessments , and shall be
105	95		fined an additional Two Hundred Fifty Dollars ($250.00) for each day
106	96		of noncompliance.
107	97		B. Any person or class of persons that suffers injury as a
108	98		result of a violation of this act may bring a civil action in a
109	99		court of competent jurisdiction agains t the person violating this
110	100		act and, upon prevailing, may be awarded reasonable at torney fees
111	101		and costs and such legal or equitable relief as may be appropriate
112	102		to remedy the violation.
113	103		SECTION 3. This act shall become effective November 1, 2022.
