4040 An Act relating to elections; amending 26 O.S. 2021,
4141 Section 5-111, which relates to declaration of
4242 candidacy forms; modifying information contained on
4343 form; and providing an effective date.

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. AMENDATORY 26 O.S. 2021, Section 5 -111, is
5050 amended to read as follows:
5151 Section 5-111. A. Forms to be used for filing Declarations of
5252 Candidacy shall be prescribed by the Secretary of the State Election
5353 Board and shall contain the following information:
5454 1. The name of the candidate as it shall a ppear on the ballot;
5555 2. The legal name of the c andidate;
5656 3. The candidate's place of residence and mailing address;
5757 4. The name of the office sought;
5858 5. The candidate's date of birth;
5959 6. The party affiliation of the candidate seeking political
6060 party nomination, regardless of the office being sought ;

8787 7. The precinct and county wherein the candid ate is a
8888 registered voter;
8989 8. An oath wherein the candidate swears or affirms that he or
9090 she is qualified to become a candidate for the office sought, and
9191 that, if elected, the candidate will be qua lified to hold the
9292 office; and
9393 9. Any additional informa tion which the Secretary deems
9494 necessary.
9595 B. If the candidate has ever been ultimately determined by a
9696 court of proper authority to be guilty of an offense specified in
9797 subsection A of Section 5 -105a of this title or at the time of
9898 filing the Declaration of Candidacy is named in an outstanding
9999 warrant for arrest for such an offense, in this or any other state,
100100 the candidate shall provide the following information on a form
101101 prescribed by the Secretary of the State Election Board:
102102 1. The name of the offense ;
103103 2. The date of conviction or issuance of the outstanding
104104 warrant; and
105105 3. The county and state of conviction or issuance of the
106106 outstanding warrant.
107107 The provisions of this subsection shall not app ly to an offense
108108 for which the candidate has received a p ardon.

135135 C. A Declaration of Candidacy form must be signed by the
136136 candidate, and the signature must be properly notarized by a notary
137137 public or other person authorized by law to administer oaths.
138138 D. In addition to the information required by this section, a
139139 candidate may include a telephone number, email address and website
140140 address. Such additional information shall not be required of any
141141 candidate but if provided shall be made available to the publi c.
142142 SECTION 2. This act shall become effe ctive November 1, 2022.
