40	40	An Act relating to elections; amending 26 O.S. 2021,
41	41	Section 5-111, which relates to declaration of
42	42	candidacy forms; modifying information contained on
43	43	form; and providing an effective date.

48	48	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	49	SECTION 1. AMENDATORY 26 O.S. 2021, Section 5 -111, is
50	50	amended to read as follows:
51	51	Section 5-111. A. Forms to be used for filing Declarations of
52	52	Candidacy shall be prescribed by the Secretary of the State Election
53	53	Board and shall contain the following information:
54	54	1. The name of the candidate as it shall a ppear on the ballot;
55	55	2. The legal name of the c andidate;
56	56	3. The candidate's place of residence and mailing address;
57	57	4. The name of the office sought;
58	58	5. The candidate's date of birth;
59	59	6. The party affiliation of the candidate seeking political
60	60	party nomination, regardless of the office being sought ;

87	87	7. The precinct and county wherein the candid ate is a
88	88	registered voter;
89	89	8. An oath wherein the candidate swears or affirms that he or
90	90	she is qualified to become a candidate for the office sought, and
91	91	that, if elected, the candidate will be qua lified to hold the
92	92	office; and
93	93	9. Any additional informa tion which the Secretary deems
94	94	necessary.
95	95	B. If the candidate has ever been ultimately determined by a
96	96	court of proper authority to be guilty of an offense specified in
97	97	subsection A of Section 5 -105a of this title or at the time of
98	98	filing the Declaration of Candidacy is named in an outstanding
99	99	warrant for arrest for such an offense, in this or any other state,
100	100	the candidate shall provide the following information on a form
101	101	prescribed by the Secretary of the State Election Board:
102	102	1. The name of the offense ;
103	103	2. The date of conviction or issuance of the outstanding
104	104	warrant; and
105	105	3. The county and state of conviction or issuance of the
106	106	outstanding warrant.
107	107	The provisions of this subsection shall not app ly to an offense
108	108	for which the candidate has received a p ardon.

135	135	C. A Declaration of Candidacy form must be signed by the
136	136	candidate, and the signature must be properly notarized by a notary
137	137	public or other person authorized by law to administer oaths.
138	138	D. In addition to the information required by this section, a
139	139	candidate may include a telephone number, email address and website
140	140	address. Such additional information shall not be required of any
141	141	candidate but if provided shall be made available to the publi c.
142	142	SECTION 2. This act shall become effe ctive November 1, 2022.
