5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. NEW LAW A new section of law to be codified
5454 in the Oklahoma Statutes as Section 2606 of Title 63, unless there
5555 is created a duplication in numbering, reads as follows:
5656 This act shall be known and may be cited as the "Oklahoma Save
5757 Adolescents from Experimentation (SAFE) Act".
5858 SECTION 2. NEW LAW A new section of law to be codified
5959 in the Oklahoma Statutes as Section 2607 of Title 63, unless there
6060 is created a duplication in numbering, reads as follows:
6161 A. As used in this section:
6262 1. "Biological sex" means the biological indication of male and
6363 female in the context of reproductive potential or capacity, su ch as

9090 sex chromosomes, naturally occur ring sex hormones, gonads, and
9191 nonambiguous internal and external genitalia present at birth,
9292 without regard to an individual's psychological, cho sen or
9393 subjective experience of gender ;
9494 2. "Cross-sex hormones" means testosterone or other androgens
9595 given to biological females in amounts that are larger or more
9696 potent than would normally occur naturally in healthy biological
9797 females and estrogen give n to biological males in amounts that a re
9898 larger or more potent than woul d normally occur naturally in healthy
9999 biological males;
100100 3. "Gender" means the psychological, behavioral, social , and
101101 cultural aspects of being male or female;
102102 4. "Gender reassignment surgery" means any medical or surgical
103103 service that seeks to surgically alter or remove healthy physical or
104104 anatomical characteristics or features that are typical for the
105105 individual's biological sex, in order to instill or create
106106 physiological or anatomical characteristics that resemble a se x
107107 different from the individual 's biological sex, including, but not
108108 limited to, genital or nongenital gender reassignment surgery
109109 performed for the purpose of assisting an individual with gender
110110 transition;
111111 5. "Gender transition" means the process in which a person goes
112112 from identifying and living as a gender that corresponds to his or
113113 her biological sex to identifying and living as a gender different

140140 from his or her biological sex, and ma y involve social, legal or
141141 physical changes;
142142 6. "Gender transition procedures" means any medical or surgical
143143 service, including, but not limited to , physician's services,
144144 inpatient and outpatient hospital services, or pres cribed drugs
145145 related to gender transition that seeks to:
146146 a. alter or remove physical or anatomical character istics
147147 or features that are t ypical for the individual's
148148 biological sex, or
149149 b. instill or create phy siological or anatomical
150150 characteristics that re semble a sex different from the
151151 individual's biological sex, including, but not
152152 limited to, medical services that provide puberty-
153153 blocking drugs, cross-sex hormones, or other
154154 mechanisms to promote the development of feminizing or
155155 masculinizing features in the opposite biological sex,
156156 or genital or nongenital rea ssignment surgery
157157 performed for the purpose of assis ting an individual
158158 with a gender transition.
159159 Gender transition procedures do not include:
160160 a. services to persons born with a medically verifiable
161161 disorder of sex devel opment, including a person with
162162 external biological sex characterist ics that are
163163 irresolvably ambiguous, such as those born with 46 XX

190190 chromosomes with virilization, 46 XY chromosomes with
191191 under virilization, or having both ovarian and
192192 testicular tissue,
193193 b. services provided when a physician has otherwise
194194 diagnosed a disorder of se xual development that the
195195 physician has determined through genetic or
196196 biochemical testing t hat the person does not have
197197 normal sex chromosomes structure, sex steroid hormone
198198 production or sex steroid hormone action ,
199199 c. treatment of any infection, injury, disease, or
200200 disorder that has been c aused by or exacerbated by the
201201 performance of gender transition procedures , whether
202202 or not the gender transition p rocedure was performed
203203 in accordance with state and federal l aw or whether or
204204 not funding for the gender transition procedure is
205205 permissible under this act, or
206206 d. any procedure undertaken because the individual
207207 suffers from a physical disorder, physical injury , or
208208 physical illness that would, as certif ied by a
209209 physician, place the individual in imminent danger of
210210 death or impairment of major bodily function unless
211211 such procedure is performed;

238238 7. "Genital gender reassignment surger y" means a medical
239239 procedure performed. For the purpose of assisting a n individual
240240 with a gender transition, including, but not limited to :
241241 a. surgical procedures such as penectomy, orchiectomy,
242242 vaginoplasty, clitoroplasty, or vulvoplasty for
243243 biologically male patients or hysterectom y or
244244 ovariectomy for biologically female pa tients,
245245 b. reconstruction of the fixed part of the urethra with
246246 or without a metoidioplasty , or
247247 c. phalloplasty, vaginectomy, scrotoplasty or
248248 implantation of erection or testicular prostheses for
249249 biologically female patients;
250250 8. "Health care professional" means a person who is licensed,
251251 certified or otherwise authorized by the laws of this state to
252252 administer health care in the ordinary course of the p ractice of his
253253 or her profession;
254254 9. "Nongenital gender reassign ment surgery" means medical
255255 procedures performed for the purpose of assisting an individual with
256256 a gender transition including, but not limited to:
257257 a. surgical procedures for biologically male patients,
258258 such as augmentation ma mmoplasty, facial feminization
259259 surgery, liposuction, lipofilling, voice surgery,
260260 thyroid cartilage reduction, gluteal augmentation,

287287 hair reconstruction or various aesthetic procedures,
288288 or
289289 b. surgical procedures for biologically female pa tients,
290290 such as subcutaneous mastectom y, voice surgery,
291291 liposuction, lipofilling, pectoral implants , or
292292 various aesthetic procedures;
293293 10. "Physician" means a person who is licensed in t his state to
294294 practice medicine;
295295 11. "Puberty-blocking drugs" means gonadotropin-releasing
296296 hormone analogues or other synthetic drugs used in biological males
297297 to stop luteinizing hormone secretion and therefore testosterone
298298 secretion or synthetic drugs used in biological females which stop
299299 the production of estrogen an d progesterone when used to delay or
300300 suppress pubertal development in children for the purpose of
301301 assisting an individual with a gender transition; and
302302 12. "Public funds" means state, county, or local government
303303 monies, in addition to any department, agency or instrumentality
304304 authorized or appropr iated under state law or derived from any fund
305305 in which such monies are deposited.
306306 B. A physician or other health care professional shall not
307307 provide gender transition procedures to any individual under
308308 eighteen (18) years of age.
309309 C. A physician or other health care professional shall not
310310 refer any individual under eighteen (18) years of age to any

337337 physician or health care professional for gender transition
338338 procedures.
339339 D. It shall be prohibited for any public monies to be directly
340340 or indirectly used, granted, paid , or distributed to any entity,
341341 organization, or individual who provides gender transition
342342 procedures to an individual under eighteen (18) years of age.
343343 E. Any referral for or provision of gender transition
344344 procedures to an individual under eighteen (18) years of age shall
345345 be considered unprofessional conduct a nd is subject to disciplinary
346346 action by the appropriate licensing body or disciplinary review
347347 board with jurisdiction in this state.
348348 1. A person may assert an actual or threatened violation of
349349 this act as a claim or defense in a judicial or administrative
350350 proceeding and obtain compensatory damages, in junctive relief,
351351 declaratory relief or any other appropriate relief.
352352 2. A person shall bring a claim for a violation of this act no
353353 later than two (2) years after the day the cause of action occurs.
354354 3. An individual under eighteen (18) years of age may bring an
355355 action throughout his or her minority through a parent or next
356356 friend, and may bring an action in his or her own name upon reaching
357357 majority at any time from that point until twenty (20) years after
358358 reaching the age of majority.

385385 4. In any action or proceeding to enforce a provision of this
386386 act, a prevailing party who est ablishes a violation of this act
387387 shall recover reasonable attorneys ' fees.
388388 F. Insurance coverage for gender transition procedures within
389389 this state for individuals under eighte en (18) years of age shall be
390390 prohibited.
391391 1. A health benefit plan under an in surance policy or other
392392 plan providing health care coverage in this state shall not include
393393 reimbursement for gender transition pr ocedures for a person under
394394 eighteen (18) years of age.
395395 2. A health benefit plan under a n insurance policy or other
396396 plan providing health care coverage in this state is not required to
397397 provide coverage for g ender transition procedures.
398398 SECTION 3. This act shall become effective November 1, 2022.
