52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 2606 of Title 63, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	This act shall be known and may be cited as the "Oklahoma Save
57	57	Adolescents from Experimentation (SAFE) Act".
58	58	SECTION 2. NEW LAW A new section of law to be codified
59	59	in the Oklahoma Statutes as Section 2607 of Title 63, unless there
60	60	is created a duplication in numbering, reads as follows:
61	61	A. As used in this section:
62	62	1. "Biological sex" means the biological indication of male and
63	63	female in the context of reproductive potential or capacity, su ch as

90	90	sex chromosomes, naturally occur ring sex hormones, gonads, and
91	91	nonambiguous internal and external genitalia present at birth,
92	92	without regard to an individual's psychological, cho sen or
93	93	subjective experience of gender ;
94	94	2. "Cross-sex hormones" means testosterone or other androgens
95	95	given to biological females in amounts that are larger or more
96	96	potent than would normally occur naturally in healthy biological
97	97	females and estrogen give n to biological males in amounts that a re
98	98	larger or more potent than woul d normally occur naturally in healthy
99	99	biological males;
100	100	3. "Gender" means the psychological, behavioral, social , and
101	101	cultural aspects of being male or female;
102	102	4. "Gender reassignment surgery" means any medical or surgical
103	103	service that seeks to surgically alter or remove healthy physical or
104	104	anatomical characteristics or features that are typical for the
105	105	individual's biological sex, in order to instill or create
106	106	physiological or anatomical characteristics that resemble a se x
107	107	different from the individual 's biological sex, including, but not
108	108	limited to, genital or nongenital gender reassignment surgery
109	109	performed for the purpose of assisting an individual with gender
110	110	transition;
111	111	5. "Gender transition" means the process in which a person goes
112	112	from identifying and living as a gender that corresponds to his or
113	113	her biological sex to identifying and living as a gender different

141	141	physical changes;
142	142	6. "Gender transition procedures" means any medical or surgical
143	143	service, including, but not limited to , physician's services,
144	144	inpatient and outpatient hospital services, or pres cribed drugs
145	145	related to gender transition that seeks to:
146	146	a. alter or remove physical or anatomical character istics
147	147	or features that are t ypical for the individual's
148	148	biological sex, or
149	149	b. instill or create phy siological or anatomical
150	150	characteristics that re semble a sex different from the
151	151	individual's biological sex, including, but not
152	152	limited to, medical services that provide puberty-
153	153	blocking drugs, cross-sex hormones, or other
154	154	mechanisms to promote the development of feminizing or
155	155	masculinizing features in the opposite biological sex,
156	156	or genital or nongenital rea ssignment surgery
157	157	performed for the purpose of assis ting an individual
158	158	with a gender transition.
159	159	Gender transition procedures do not include:
160	160	a. services to persons born with a medically verifiable
161	161	disorder of sex devel opment, including a person with
162	162	external biological sex characterist ics that are
163	163	irresolvably ambiguous, such as those born with 46 XX

191	191	under virilization, or having both ovarian and
192	192	testicular tissue,
193	193	b. services provided when a physician has otherwise
194	194	diagnosed a disorder of se xual development that the
195	195	physician has determined through genetic or
196	196	biochemical testing t hat the person does not have
197	197	normal sex chromosomes structure, sex steroid hormone
198	198	production or sex steroid hormone action ,
199	199	c. treatment of any infection, injury, disease, or
200	200	disorder that has been c aused by or exacerbated by the
201	201	performance of gender transition procedures , whether
202	202	or not the gender transition p rocedure was performed
203	203	in accordance with state and federal l aw or whether or
204	204	not funding for the gender transition procedure is
205	205	permissible under this act, or
206	206	d. any procedure undertaken because the individual
207	207	suffers from a physical disorder, physical injury , or
208	208	physical illness that would, as certif ied by a
209	209	physician, place the individual in imminent danger of
210	210	death or impairment of major bodily function unless
211	211	such procedure is performed;

238	238	7. "Genital gender reassignment surger y" means a medical
239	239	procedure performed. For the purpose of assisting a n individual
240	240	with a gender transition, including, but not limited to :
241	241	a. surgical procedures such as penectomy, orchiectomy,
242	242	vaginoplasty, clitoroplasty, or vulvoplasty for
243	243	biologically male patients or hysterectom y or
244	244	ovariectomy for biologically female pa tients,
245	245	b. reconstruction of the fixed part of the urethra with
246	246	or without a metoidioplasty , or
247	247	c. phalloplasty, vaginectomy, scrotoplasty or
248	248	implantation of erection or testicular prostheses for
249	249	biologically female patients;
250	250	8. "Health care professional" means a person who is licensed,
251	251	certified or otherwise authorized by the laws of this state to
252	252	administer health care in the ordinary course of the p ractice of his
253	253	or her profession;
254	254	9. "Nongenital gender reassign ment surgery" means medical
255	255	procedures performed for the purpose of assisting an individual with
256	256	a gender transition including, but not limited to:
257	257	a. surgical procedures for biologically male patients,
258	258	such as augmentation ma mmoplasty, facial feminization
259	259	surgery, liposuction, lipofilling, voice surgery,
260	260	thyroid cartilage reduction, gluteal augmentation,

288	288	or
289	289	b. surgical procedures for biologically female pa tients,
290	290	such as subcutaneous mastectom y, voice surgery,
291	291	liposuction, lipofilling, pectoral implants , or
292	292	various aesthetic procedures;
293	293	10. "Physician" means a person who is licensed in t his state to
294	294	practice medicine;
295	295	11. "Puberty-blocking drugs" means gonadotropin-releasing
296	296	hormone analogues or other synthetic drugs used in biological males
297	297	to stop luteinizing hormone secretion and therefore testosterone
298	298	secretion or synthetic drugs used in biological females which stop
299	299	the production of estrogen an d progesterone when used to delay or
300	300	suppress pubertal development in children for the purpose of
301	301	assisting an individual with a gender transition; and
302	302	12. "Public funds" means state, county, or local government
303	303	monies, in addition to any department, agency or instrumentality
304	304	authorized or appropr iated under state law or derived from any fund
305	305	in which such monies are deposited.
306	306	B. A physician or other health care professional shall not
307	307	provide gender transition procedures to any individual under
308	308	eighteen (18) years of age.
309	309	C. A physician or other health care professional shall not
310	310	refer any individual under eighteen (18) years of age to any

339	339	D. It shall be prohibited for any public monies to be directly
340	340	or indirectly used, granted, paid , or distributed to any entity,
341	341	organization, or individual who provides gender transition
342	342	procedures to an individual under eighteen (18) years of age.
343	343	E. Any referral for or provision of gender transition
344	344	procedures to an individual under eighteen (18) years of age shall
345	345	be considered unprofessional conduct a nd is subject to disciplinary
346	346	action by the appropriate licensing body or disciplinary review
347	347	board with jurisdiction in this state.
348	348	1. A person may assert an actual or threatened violation of
349	349	this act as a claim or defense in a judicial or administrative
350	350	proceeding and obtain compensatory damages, in junctive relief,
351	351	declaratory relief or any other appropriate relief.
352	352	2. A person shall bring a claim for a violation of this act no
353	353	later than two (2) years after the day the cause of action occurs.
354	354	3. An individual under eighteen (18) years of age may bring an
355	355	action throughout his or her minority through a parent or next
356	356	friend, and may bring an action in his or her own name upon reaching
357	357	majority at any time from that point until twenty (20) years after
358	358	reaching the age of majority.

385	385	4. In any action or proceeding to enforce a provision of this
386	386	act, a prevailing party who est ablishes a violation of this act
387	387	shall recover reasonable attorneys ' fees.
388	388	F. Insurance coverage for gender transition procedures within
389	389	this state for individuals under eighte en (18) years of age shall be
390	390	prohibited.
391	391	1. A health benefit plan under an in surance policy or other
392	392	plan providing health care coverage in this state shall not include
393	393	reimbursement for gender transition pr ocedures for a person under
394	394	eighteen (18) years of age.
395	395	2. A health benefit plan under a n insurance policy or other
396	396	plan providing health care coverage in this state is not required to
397	397	provide coverage for g ender transition procedures.
398	398	SECTION 3. This act shall become effective November 1, 2022.
