41	41	disclosure of inpatient or emergency outpatient
42	42	mental health services; prescribing tim ing for
43	43	disclosure; defining term; requiring meeting to
44	44	determine if the student needs any accommodations;
45	45	describing how meeting may be conducted; requiring
46	46	compliance with certain federal laws; d irecting State
47	47	Board of Education to promulgate rules; providing for
48	48	codification; providing an effective date ; and

56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. NEW LAW A new section of law to be codified
58	58	in the Oklahoma Statutes as S ection 24-100.9 of Title 70, unless
59	59	there is created a duplication in numbering, reads as follows:
60	60	A. Beginning with the 2022-2023 school year, the parent or
61	61	legal guardian of a student shall disclose to the student's resident
62	62	district, as determined by S ection 1-113 of Title 70 of the Oklahoma
63	63	Statutes, if the student has received inpatient or emergency
64	64	outpatient mental health services from a me ntal health facility in
65	65	the previous twenty-four (24) months. The disclosure shall occur at

92	92	least five (5) days prior to the student enrolling in or
93	93	transferring to the school district. As used in this section,
94	94	"facility" shall have the same meaning as Section 1-103 of Title 43A
95	95	of the Oklahoma Statut es.
96	96	B. Within ten (10) days of the disclosure, designated school
97	97	personnel shall meet with the parent or legal guardian of the
98	98	student and representatives o f the mental health facility to
99	99	determine whether the student is in need of any accommodations
100	100	including, but not limited to, an individualized education program
101	101	(IEP) in accordance with the Individuals with Disabilities Education
102	102	Act (IDEA) or a Section 5 04 Plan as defined by the R ehabilitation
103	103	Act of 1973. The meeting required by this subsection may take place
104	104	in person, via teleconference or via videoconference .
105	105	C. The disclosure and subsequent handling of personal health
106	106	information and related student e ducation records shall comply with
107	107	the Family Educational Rights and Privacy Act of 1974 (FERPA) and
108	108	the Health Insurance Portability and Accountability Act of 1996
109	109	(HIPAA).
110	110	D. The State Board of Education shall promulgate rules to
111	111	implement the provisions of this section.
112	112	SECTION 2. This act shall become effective July 1, 2022.
113	113	SECTION 3. It being immediately necessary for the preservation
114	114	of the public peace, health or safety, an emergency is hereby
