4040 An Act relating to students; requiring certain

4242 mental health services; prescribing tim ing for
4343 disclosure; defining term; requiring meeting to
4444 determine if the student needs any accommodations;
4545 describing how meeting may be conducted; requiring
4646 compliance with certain federal laws; d irecting State
4747 Board of Education to promulgate rules; providing for
4848 codification; providing an effective date ; and

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law to be codified
5858 in the Oklahoma Statutes as S ection 24-100.9 of Title 70, unless
5959 there is created a duplication in numbering, reads as follows:
6060 A. Beginning with the 2022-2023 school year, the parent or
6161 legal guardian of a student shall disclose to the student's resident
6262 district, as determined by S ection 1-113 of Title 70 of the Oklahoma
6363 Statutes, if the student has received inpatient or emergency
6464 outpatient mental health services from a me ntal health facility in
6565 the previous twenty-four (24) months. The disclosure shall occur at

9292 least five (5) days prior to the student enrolling in or
9393 transferring to the school district. As used in this section,
9494 "facility" shall have the same meaning as Section 1-103 of Title 43A
9595 of the Oklahoma Statut es.
9696 B. Within ten (10) days of the disclosure, designated school
9797 personnel shall meet with the parent or legal guardian of the
9898 student and representatives o f the mental health facility to
9999 determine whether the student is in need of any accommodations
100100 including, but not limited to, an individualized education program
101101 (IEP) in accordance with the Individuals with Disabilities Education
102102 Act (IDEA) or a Section 5 04 Plan as defined by the R ehabilitation
103103 Act of 1973. The meeting required by this subsection may take place
104104 in person, via teleconference or via videoconference .
105105 C. The disclosure and subsequent handling of personal health
106106 information and related student e ducation records shall comply with
107107 the Family Educational Rights and Privacy Act of 1974 (FERPA) and
108108 the Health Insurance Portability and Accountability Act of 1996
109109 (HIPAA).
110110 D. The State Board of Education shall promulgate rules to
111111 implement the provisions of this section.
112112 SECTION 2. This act shall become effective July 1, 2022.
113113 SECTION 3. It being immediately necessary for the preservation
114114 of the public peace, health or safety, an emergency is hereby
