40	40	An Act relating to school athletics; defining terms;
41	41	directing school athletic association to establish a
42	42	new category of competition; permitting certain
43	43	schools to elect to compete in new category;
44	44	specifying composition of existing category;
45	45	prescribing frequency for category election;
46	46	declaring applicability of election ; providing for
47	47	codification; and providing an effective date .

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A new section of law to be codified
54	54	in the Oklahoma Statutes as Section 27-201 of Title 70, unless there
55	55	is created a duplication in numbering, reads a s follows:
56	56	A. As used in this section:
57	57	1. "Schools of restricted enrollment " means schools that:
58	58	a. admit students based on entrance requirements
59	59	established by the school for admission and
60	60	enrollment,
61	61	b. decline enrollment of students based on standards
62	62	which differ from those established by the State
63	63	Department of Education ,

90	90	c. control enrollment size for the maintenance of a
91	91	maximum size standard, and
92	92	d. use tuition or costs of attendance as factors for
93	93	admission and enrollment; and
94	94	2. "Schools of unrestricted enrollment" means schools that:
95	95	a. admit all students for enrollment and attendance who
96	96	live within the established boundaries of the school s,
97	97	b. may accept transfer students who are living outside
98	98	the established boundaries of the schools,
99	99	c. follow residency rules of the State Department of
100	100	Education for school district residents and transfe r
101	101	students, and
102	102	d. do not collect tuition and fees for enro llment or
103	103	attendance.
104	104	B. Beginning with the 2023 -2024 school year, a school athletic
105	105	association as defined in Section 27-102 of Title 70 of the Oklahoma
106	106	Statutes shall establish a new category of competition for schools
107	107	of restricted enrollment. Schools of restricted enrollment may
108	108	elect to compete in the schools of restricted enrollment category by
109	109	requesting a move pursuan t to guidelines determined by the school
110	110	athletic association.
111	111	C. The existing alignment of classifications within the school
112	112	athletic association shall be in a category known as schools of
113	113	unrestricted and restricted enrollment and shall include schools of

141	141	Existing standards of enrollment size divisions for classes of
142	142	competition established by the school athletic association shall
143	143	remain in effect for the schools of unrestricted and restricte d
144	144	enrollment.
145	145	D. Schools of restricted enrollment shall elect once every four
146	146	(4) years in which category they want to compet e. The election
147	147	shall be applicable to all competitions which are governed by the
148	148	school athletic assoc iation.
149	149	SECTION 2. This act shall become effective November 1, 2022.
