4141 amending 59 O.S. 2021, Section 509 , which relates to

4343 modifying basis for determination of unprofessional
4444 conduct; providing standard based on information
4545 related to COVID; and providing an effective date.

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 59 O.S. 2021, Section 509, is
5252 amended to read as follows :
5353 Section 509. The words "unprofessional conduct " as used in
5454 Sections 481 through 518.1 of this title are hereby declared to
5555 include, but shall not be limited to, the following:
5656 1. Procuring, aiding o r abetting a criminal operation;
5757 2. The obtaining of any fee or offering to accept any fee,
5858 present or other form of remuneration whatsoever, on the assurance
5959 or promise that a manifestly incurable disease can or will be cured;
6060 3. Willfully betraying a p rofessional secret to the detriment
6161 of the patient;

8888 4. Habitual intemperance or the habitual use of habit -forming
8989 drugs;
9090 5. Conviction or confession of, or plea of guilty, nolo
9191 contendere, no contest or Alford plea to a felony or an y offense
9292 involving moral turpitude;
9393 6. All advertising of medical business in which statements are
9494 made which are grossly untrue or improbable and calculated to
9595 mislead the public;
9696 7. Conviction or confession of, or plea of guilty, nolo
9797 contendere, no contest or Alford plea to a crime involving v iolation
9898 of:
9999 a. the antinarcotic or prohibition laws and regulations
100100 of the federal government,
101101 b. the laws of this state,
102102 c. State Commissioner of Health rules, or
103103 d. a determination by a judge or jury;
104104 8. Dishonorable or immoral co nduct which is likely to deceive,
105105 defraud, or harm the public;
106106 9. The commission of any act which is a violation of the
107107 criminal laws of any state when such act is connected with the
108108 physician's practice of medicine. A complaint, in dictment or
109109 confession of a criminal violati on shall not be necessary for the

137137 while in the practice of medicine or under the guise of the practice
138138 of medicine shall be unprofessional conduc t;
139139 10. Failure to keep complete and accurat e records of purchase
140140 and disposal of controlled drugs or of narcotic drugs;
141141 11. The writing of false or fictitious prescriptions for any
142142 drugs or narcotics declared by the laws of this state to be
143143 controlled or narcotic drugs;
144144 12. Prescribing or adminis tering a drug or treatment without
145145 sufficient examination and the establishment of a valid physician -
146146 patient relationship and not prescribing in a safe, medically
147147 accepted manner;
148148 13. The violation, or attempted violation, direct or indirect,
149149 of any of the provisions of the Oklahoma Allopathic Medical and
150150 Surgical Licensure and Supervision Act, either as a principal,
151151 accessory or accomplice;
152152 14. Aiding or abetting, directly or indirectly, the practice of
153153 medicine by any person not du ly authorized under th e laws of this
154154 state;
155155 15. The inability to practice medicine with reasonable skill
156156 and safety to patients by reason of age, illness, drunkenness,
157157 excessive use of drugs, narcotics, chemicals, or any other type o f
158158 material or as a res ult of any mental or p hysical condition. In
159159 enforcing this section the State Board of Medical Licensure and
160160 Supervision may, upon probable cause, request a physician to submit

187187 to a mental or physical examination by physicians designa ted by it.
188188 If the physician refuses to subm it to the examination, the Board
189189 shall issue an order requiring the physician to show cause why the
190190 physician will not submit to the examination and shall schedule a
191191 hearing on the order within thirty (30) days a fter notice is served
192192 on the physician, excl usive of the day of service. The physician
193193 shall be notified by either personal service or by certified mail
194194 with return receipt requested. At the hearing, the physician and
195195 the physician's attorney are entitle d to present any testi mony and
196196 other evidence to show why the physician should not be required to
197197 submit to the examination. After a complete hearing, the Board
198198 shall issue an order either requiring the physician to submit to the
199199 examination or withdrawin g the request for exam ination. The medical
200200 license of a physician ordered to submit for examination may be
201201 suspended until the results of the examination are received and
202202 reviewed by the Board;
203203 16. a. Prescribing, dispensing or administering of controlled
204204 substances or narcoti c drugs in excess of t he amount
205205 considered good medical practice,
206206 b. Prescribing, dispensing or administering controlled
207207 substances or narcotic drugs without medical need in
208208 accordance with pertinent licensing board standards,

236236 c. Prescribing, dispensing or administering opio id drugs
237237 in excess of the maximum limits authorized in Section
238238 2-309I of Title 63 of the Oklahoma Statutes;
239239 17. Engaging in physical conduct with a patient which is sexual
240240 in nature, or in any verbal behavior wh ich is seductive or se xually
241241 demeaning to a patient;
242242 18. Failure to maintain an office record for each patient which
243243 accurately reflects the evaluation, treatment, and medical necessity
244244 of treatment of the patient;
245245 19. Failure to provide necessary ongoin g medical treatment wh en
246246 a doctor-patient relationship has been established, which
247247 relationship can be severed by either party providing a reasonable
248248 period of time is granted;
249249 20. Performance of an abortion as defined by Section 1 -730 of
250250 Title 63 of the Oklahoma Statutes, exc ept for an abortion n ecessary
251251 to prevent the death of the mother or to prevent substantial or
252252 irreversible physical impairment of the mother that substantially
253253 increases the risk of death. The performance of an abortion on the
254254 basis of the mental or emoti onal health of the mo ther shall be a
255255 violation of this paragraph, notwithstanding a claim or diagnosis
256256 that the woman may engage in conduct which she intends to result in
257257 her death. The Board shall impose a penalty as provided in Sec tion
258258 509.1 of this title on a licensee who violates this paragraph. The

285285 penalty shall include, but not be limited to, suspension of the
286286 license for a period of not less than one (1) year; or
287287 21. Failure to provide a proper and safe medical facility
288288 setting and qualified assis tive personnel for a recognized medical
289289 act, including but not limited to an initial in -person patient
290290 examination, office surgery, diagnostic service or any other medical
291291 procedure or treatment. Adequate medical records to support
292292 diagnosis, procedure, t reatment or prescribe d medications must be
293293 produced and maintained ; or
294294 22. Generating and spreading C OVID-19 vaccine misinformation or
295295 disinformation including, but not limited to:
296296 a. any information that is not factual, scientifically
297297 grounded and consensus-driven for the betterment of
298298 public health,
299299 b. information that contradicts the eth ical
300300 responsibility to practice medicine in the best
301301 interests of patients, or
302302 c. information which threatens to further erode public
303303 trust in the medical profession and puts patients at
304304 risk.
305305 SECTION 2. This act shall become effective November 1, 2022.
