41	41	O.S. 2021, Section 427.15a, which relates to the
42	42	Oklahoma Medical Marijuana and Pat ient Protection
43	43	Act; increasing percentage amount of equity in
44	44	certain Oklahoma businesses that publicly traded
45	45	companies may purchase; and providing an effect ive

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.15a, is
54	54	amended to read as follows:
55	55	Section 427.15a For purposes of this se ction, "publicly traded
56	56	company" means a business entity organized under the laws of the
57	57	United States or Canada where the dom icile for the business entity
58	58	permits the sale of marijuana and such business entity ha s a class
59	59	of securities that are registered and traded for investment p ursuant
60	60	to the Security Exchange Act of 1934 or listed and traded fo r
61	61	investment on a reputable re cognized foreign stock exchange or
62	62	foreign market exchange.

89	89	On and after the effective date of this act, a publicly traded
90	90	company as defined herein is autho rized to purchase up to forty
91	91	percent (40%) one hundred percent (100%) of the equity in an
92	92	existing Oklahoma business that holds a valid Oklahoma medical
93	93	marijuana grower, processor or transporter license; provide d,
94	94	however, the only Oklahoma business qual ified for investment or
95	95	equity purchase under this section must have held a valid medical
96	96	marijuana grower, processor or transporter license for at least
97	97	eighteen (18) months prior to the investment or equity purc hase and
98	98	must be currently operating in good standing in this state. A
99	99	licensed medical marijuana dispensary shall not be qualified for
100	100	investment or equity purchase under the provisions o f this section.
101	101	SECTION 2. This act shall become effective November 1, 2022.
