3258 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2802, is

3560 Section 2802. As used in this act:

3761 1. "Authority" means the Oklahoma 9-1-1 Management Authority;

3962 2. "Basic system" means a telephone service which automatically

4694 3. "Direct dispatch method " means a method whereby a call over
4795 a basic or sophisticated system is connected to a centralized
4896 dispatch center providing for the dispatching of an appro priate
4997 emergency service unit upon receipt of a telephone request for such
5098 services and a decision as to the prope r action to be taken;

5299 4. "Methods", as used in paragraphs 3, 8, 9 and 11 of this
53100 section, means the procedures to be followed by the public a gency or
54101 public safety agency affected by such paragraphs;

73115 sophisticated system results in pertinent information being noted by

78146 10. "Sophisticated system" means a basic system with the
79147 additional capability of automatic i dentification of the caller 's
80148 number, holding the incoming call, reconnection on the same
81149 telephone line, clearing a telephone line or automat ic call routing
82150 or combinations of such capabilities; and

84151 11. "Transfer method" means a method whereby a call ove r a
85152 basic or sophisticated system i s received and directly transferred
86153 to an appropriate public safety agency or other provider of
87154 emergency services.

92157 Section 2805. In order to insure t hat proper preparation and
93158 implementation of such systems can be accomplished as provided in
94159 Section 2803 of this title, the Department of Public Safe ty Oklahoma
95160 9-1-1 Management Authority may develop an overall plan p rior to
96161 development of any system and shall coordinate the implementation of
97162 systems to be established pursuant to the provisions of Section 2803
98163 of this title. Any such plan shall contai n an estimate of the costs
99164 of installing alternate 911 systems and a n estimate of the first
100165 year's additional operating expenses, if any. The Department
101166 Authority may formulate a plan by which it and the public a gencies
102167 and public safety agencies involved may share proportionately the

103195 costs of any system and method from thei r current funds. The
104196 Department Authority may aid such agencies in the formulation of
105197 concepts, methods and procedures which will improve the operation of
106198 systems and which will increa se cooperation between public safety
107199 agencies. The Department Authority may consult at regular in tervals
108200 with the State Fire Marshal, the Oklahoma State Bureau of
109201 Investigation, the State Department of Health, th e Department of
110202 Emergency Management and th e public utilities in this state
111203 providing telephone service.

113204 SECTION 3. AMENDATORY 63 O.S. 2021, Section 2806, is
114205 amended to read as follows:

116206 Section 2806. The Department of Public Safety Oklahoma 9-1-1
117207 Management Authority may establish technical and oper ational
118208 standards for the development of basic and sophisticated systems.
119209 Such standards shall be forwarded to the Corporation Commission for
120210 consideration of any tariff limitations and conditions which may
121211 need revision to accommodate such standards; and the Corporation
122212 Commission may issue such revisions after whatever hearings or
123213 procedures it deems appropriate.

135249 B. If any public agency has implemented or is a part of a
136250 system which would be authorized by this act on the effective date
137251 of this act such public agency may submit in lieu of the tentative
138252 or final plan a report describing the system and statin g its
139253 operational date.

141254 C. Plans filed pursuant to subsection A of this section shall
142255 conform to minimum standards established pursuant to Section 6 2806
143256 of this act title.

145257 SECTION 5. AMENDATORY 63 O.S. 2021, Section 2813, is

148259 Section 2813. As used in the Nine-One-One Emergency Number Act,
149260 Section 2811 et seq. of this title, unless the context otherwise
150261 requires:

152262 1. "Area served" means the geographic area which shall be
153263 served by the emergency telephone service provided by the governing
154264 body of a county, municipality, part of a county or combination of
155265 such governing bodies;

157266 2. "Emergency telephone service " means any telephone system
158267 utilizing a three-digit number, nine-one-one (911), for reporting an
159268 emergency to the appropriate public agency providing law

161297 ancillary communications systems and personnel necessary to pass the
162298 reported emergency to the appropriate emergency service and
163299 personnel;

165300 3. "Emergency telephone fee" means a fee to finance the
166301 operation of emergency telephone servic e;

168302 4. "Governing body" means the board of county commissioners of
169303 a county, the city council or othe r governing body of a
170304 municipality, or a combination o f such boards, councils or other
171305 municipal governing bodies, which shall have an administering board
172306 as provided in subsection G of Section 2815 of this title. Any such
173307 combined administering board sha ll be formed and shall enter into an
174308 agreement between the governing body of each entity in accordance
175309 with the Interlocal Cooperation Act. The agreement shall be filed
176310 with the office of the county clerk and in the offices of each
177311 governmental entity inv olved;

179312 5. "Local exchange telephone company " means any company
180313 providing exchange telephone services to any service user in this
181314 state, and shall include any competitive local exchange carrier as
182315 defined in Section 139.102 of Title 17 of the Oklahoma Stat utes;

184316 6. "Person" means any service user, including b ut not limited
185317 to, any individual, firm, partnership, copartnership, joint venture,
186318 association, cooperative organization, private corporation, whether
187319 organized for profit or not, fraternal organizatio n, nonprofit
188320 organization, estate, trust, business or common law trust, receiver,

189348 assignee for the benefit of creditors, trustee or trustee in
190349 bankruptcy, the United States of America, the state, any political
191350 subdivision of the state, or any federal or st ate agency,
192351 department, commission, board or bureau;

194352 7. "Public agency" means any city, town, county, municipal
195353 corporation, public district, public trust or public authority
196354 located within this state which provides or has authority to provide
197355 fire fighting, law enforcement, ambulance, emergency medical or
198356 other emergency services;

200357 8. "Service user" means any person who is provided exchange
201358 telephone service in this state; and

203359 9. "Tariff rate" means the rate or rates billed by a local
204360 exchange telephone company stated in tariffs applicable for such
205361 company, as approved by the Oklahoma Corporation Commission, or the
206362 current equivalent of such rates, which represent the recurring
207363 charges of such local exchange telephone company for exchange
208364 telephone service or its equivalent, exclusive of all taxes, fees,
209365 licenses or similar charges whatsoever.

220399 2. "Governing body" means the board of cou nty commissioners of
221400 a county, the city council, tribal authority or other governing body
222401 of a municipality, or a combination of such boards, council s or
223-other municipal governing bodies including county or municipal ENR. H. B. NO. 3278 Page 6
402+other municipal governing bodies including county or municipal
224403 beneficiary public trusts, or other pub lic trusts which shall have
225404 an administering board. A governing body made up of two or more
226405 governmental entities shall have a board consisting of n ot less than
227406 three members and shall consist of at least one member representing
228407 each governmental entity, appointed by the governing body of e ach
229408 participating governmental entity, as set forth in the agreement
230409 forming the board. The members of the board shall serve for terms
231410 of not more than three (3) years as set forth in the agreement.
232411 Members may be appointed to serve more than one term. The names of
233412 the members of the governing body board and the appointing author ity
234413 of each member shall be maintai ned in the office of the county clerk
235414 in the county or counties in which the system operates, along with
236415 copies of the agreement forming the bo ard and any amendments to that
237416 agreement;

239417 3. "Next-generation 9-1-1" or "NG9-1-1" means an:

241418 a. IP-based system comprised of hardware, software, data,
242419 and operational policies and procedures that:

244420 (1) provides standardized interfaces from emergency
245421 call and message services to support emergency

256456 and other appropriate emergency entities,

258457 (5) supports data or video communications needs for
259458 coordinated incident response and management, and

271467 system whereby telephone subscribers may utilize a three-digit

274470 services, including ancilla ry communications systems and perso nnel
275471 necessary to pass the reported emergency to the appropriate

280502 5. "9-1-1 wireless telephone fee" means the fee imposed in
281503 Section 5 2865 of this act title to finance the installation and
282504 operation of emergency 9-1-1 services and any necessary equipment;

284505 6. "Place of primary use " means the street address
285506 representative of where the u se of the mobile telecommunications
286507 service of the customer primarily occurs, which shall be the
287508 residential street address or the primary business street address of
288509 the customer and shall be within the licensed service a rea of the
289510 home service provider in accordance with Section 55001 of Title 68
290511 of the Oklahoma Statutes and the federal Mobile Telecommunicatio ns
291512 Sourcing Act, P.L. No. 106-252, codified at 4 U.S.C. 116-126;

293513 7. "Prepaid wireless telecommunications service " means a
294514 telecommunications wireles s service that provides the right to
295515 utilize mobile wireless service as well as other telecommunications
296516 services including the download of digital produc ts delivered
297517 electronically, content and ancillary services, which are paid for
298518 in advance and sold in predetermined units or dollars of which the
299519 number declines with use in a known amount;

301520 8. "Proprietary information" means wireless service provider or
302521 VoIP service provider, subscriber, market share, cost and review

312556 10. "Public safety answering point" or "PSAP" means an entity
313557 responsible for receiving 9-1-1 calls and processing those calls
314558 according to specific operational policy;

316559 11. "Public safety telecommunicator" means a person who
317560 performs a public service by processing, analyzing, and dispatching
318561 calls for emergency a ssistance. The person is a first responder
319562 that provides pre-arrival instructions and has specialized training
320563 to mitigate the loss of life and prop erty;

322564 12. "Wireless service provider" means a provider of commercial
323565 mobile service under Section 332( d) of the Telecommunications Act of
324566 1996, 47 U.S.C., Section 151 et seq., Federal Communications
325567 Commission rules, and the Omnibus Budget Reconciliat ion Act of 1993,
326568 Pub. L. No. 103-66, and includes a provider of wireless two-way
327569 communication service, rad io-telephone communications related to
328570 cellular telephone service, network radio access lines or the
329571 equivalent, and personal communication service. The term does not
330572 include a provider of:

347611 provider of interconnected Voice over Internet Protocol service to
348612 end users in the state, includ ing resellers.

350613 SECTION 7. AMENDATORY 63 O.S. 2021, Section 2864, is
351614 amended to read as fol lows:

353615 Section 2864. The powers and duties of the Oklahoma 9-1-1
354616 Management Authority created in Section 2863 of this title shall be

358619 Coordinator by majority vote of the members. T he Authority shall

364651 2. Prepare grant solicitations for funding fo r the purposes of
365652 assisting public agencies with funding for consolidation of
366653 facilities or services, deplo yment of Phase II technology or
367654 successor technology, development of next -generation 9-1-1 regional
368655 emergency service networks, and for other purpose s it deems
369656 appropriate and necessary;

371657 3. Work in conjunction with the Oklahoma Department of
372658 Emergency Management to create an annual budget for the Authority,
373659 which shall be approved by majority vote of the me mbers;
374-
375660 4. Direct the Oklahoma Tax Commission to escrow all or any
376661 portion of funds collected pursuant to the Oklahoma 9-1-1 Management
377662 Authority Act attributable to a public agency, if the public agency
378663 fails to:

380664 a. submit or comply with master plans to d eliver Next
381665 Generation 9-1-1 (NG9-1-1) services as required by the
382666 Oklahoma 9-1-1 Management Authority Ac t and approved
383667 by the Authority. Local plans m ust align with the
384668 State's Master plan to deploy NG9 -1-1,

386669 b. meet standards of the National Emergency Nu mber
387670 Association (NENA) limited to call -taking and caller-
388671 location technology or comply with an improveme nt plan
389672 to meet such standards as directed by t he Authority,

391673 c. submit annual reports or audits as required by the
392674 Oklahoma 9-1-1 Management Authority Act,

395703 state, regional and local next-generation systems, or

397704 e. comply with the requirements of the Oklahoma 9-1-1
398705 Management Authority Act or procedures established by
399706 the Authority;

401707 5. Establish and su bmit to the Tax Commission a list of
402708 eligible governing bodies entitled to receive 9-1-1 telephone fees
403709 and establish annual population figures for the purpose of
404710 distributing fees collected pursuant to Section 2865 of this title,
405711 to be derived by dividing the population of each public agency 's
406712 response area by the total population of the state using data fro m
407713 the latest available Census estimates as of J uly 1 of each year;

409714 6. Assist any public agency the Authority determines is
410715 performing below standards of the NENA, as limited by paragraph 4 of
411716 this section, according to the improvement plan required by the
412717 Oklahoma 9-1-1 Management Authority Act. The Authority shall
413718 establish a time period for the public agency to come into
414719 compliance after which the Au thority shall escrow funds as
415720 authorized in this section. Improvement plans may include
416721 consideration and recommendations for consolidation with other
417722 public agencies, and sharing equipment and technology with other
418723 jurisdictions;

420751 7. Require an annual re port from public agencies regarding
421752 operations and financing of the public safety answering point (PSAP)
422753 and approve, modify or reject such reports;

424754 8. Conduct and review audits and financial records of the
425755 wireless service providers and review public age ncies' audits and
426756 financial records regarding the collection, remittance and
427757 expenditures of 9-1-1 wireless telephone fees as required by the
428758 Oklahoma 9-1-1 Management Authority Act;

430759 9. Develop a master plan to deploy next -generation 9-1-1
431760 services statewide. This will include the development of
432761 performance criteria critical to the function and performance of
433762 NG9-1-1 networks and systems;

435763 10. Establish rules for interoperability between state,
436764 regional and local NG9 -1-1 systems;

438765 11. Facilitate informati on-sharing among public agencies;
