4040 An Act relating to prisons and reformatories;
4141 directing the Pardon and Parole Board to establish
4242 Conviction Integrity Review Unit; stating purpose of

4444 attorney and investigator; stating qualifications;
4545 authorizing inmates to submit certain petitions;
4646 specifying requirements for reviewing convictions;
4747 authorizing Review Unit to initiate certain
4848 investigations; directing the Review Unit to present
4949 its findings and recommendations to the Pardon and
5050 Parole Board; directing the Review Unit to provide
5151 copies of its report to certain agencies and persons;

6060 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6161 SECTION 1. NEW LAW A new section of law to be codified
6262 in the Oklahoma Statutes as Section 371 of Title 57, unless there is
6363 created a duplication in numbering, reads as follows:
6464 A. The Pardon and Parole Board is hereby authorized to
6565 establish a Conviction Integrity Review Unit for the purpose of
6666 reviewing convictions of those inm ates who have received death
6767 sentences.

9494 B. The Pardon and Parole Board shall employ and fix the duties
9595 and compensation of an attorney, who shall be licensed to practice
9696 law in this state and who shall have experience in criminal cases.
9797 The Pardon and Parole Board shall also employ and fix the duties a nd
9898 compensation of an investigator, who shall be certified by the
9999 Council on Law Enforcement Education and Training. The attorney and
100100 investigator hired by the Board shall not be a current employee of
101101 the Office of the Attorney General or the office of an y district
102102 attorney in this state.
103103 C. Any inmate who has received a sentence of death in this
104104 state shall be authorized to submit a petition to the Conviction
105105 Integrity Review Unit requesting the review of his or her
106106 conviction. The Pardon and Parole Boa rd shall determine the manner
107107 and form of the petition .
108108 D. The Conviction Integrity Review Unit shall be authorized to
109109 review any capital murder conviction that occurred within this state
110110 under the following circumstances:
111111 1. The inmate received a sentence of death;
112112 2. The inmate has presented in his or her petition for review a
113113 plausible claim of actual innocence of the crime which is:
114114 a. supported by information or evidence not pre viously
115115 presented, and
116116 b. capable of being invest igated and resolved; and

143143 3. The direct appeal of the inmate has become final, a mandate
144144 has been issued, and there is no pending litigation relating to the
145145 conviction.
146146 E. The Conviction Integrity Review Uni t shall also be
147147 authorized to initiate an investi gation to determine whether an
148148 inmate was convicted of an offense that he or she did not commit.
149149 F. Once an investigation has been completed by the Conviction
150150 Integrity Review Unit, the Unit shall present a report with its
151151 findings and recommendations to the Pardon and Parole Board. Copies
152152 of the report shall also be delivered to the Attorney General, the
153153 office of the district attorney who prosecuted the criminal case,
154154 the attorney who represented the inmate in the cri minal case, and
155155 the inmate.
156156 SECTION 2. This act shall become effective November 1, 2022.
