5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, is
5252 amended to read as follows:
5353 Section 1104. A. Unless otherwise provided by law, all fees,
5454 taxes and penalties collected or received pursuant to the Oklahoma
5555 Vehicle License and Registration Act or Section 1 -101 et seq. of
5656 this title shall be apportioned and distributed monthly by the
5757 Oklahoma Tax Commission i n accordance with this section.
5858 B. 1. The following percentages of the monies referred to in
5959 subsection A of this section shall be apportioned to the various
6060 school districts in accordance with paragraph 2 of this subsection:
6161 a. from October 1, 2000, u ntil June 30, 2001, thirty -five

139139 2. The monies apportioned pursuant to subparagraphs a through e
140140 of paragraph 1 of this subsection shall be apportioned to the
141141 various school districts so that each district shall receive an
142142 amount based upon the proportion that each district 's average daily
143143 attendance bears to the total average daily attendance of those
144144 districts entitled to receive funds pursuant to this section as
145145 certified by the State Department of Education.
146146 Each district's allocation of funds shall be remitted to the
147147 county treasurer of the county wherein the administrative
148148 headquarters of the district are located.
149149 No district shall be eligible for the funds herein provided
150150 unless the district makes an ad valorem tax levy of fif teen (15)
151151 mills and maintains nine (9) years of instr uction and pursuant to
152152 the rules of the State Board of Education, is authorized to maintain
153153 ten (10) years of instruction.
154154 C. The following percentages of the monies referred to in
155155 subsection A of this section shall be remitted to the State
156156 Treasurer to be credited to the General Revenue Fund of the State
157157 Treasury:
158158 1. From October 1, 2000, until June 30, 2001, forty -five and
159159 ninety-seven one-hundredths percent (45.97%);
160160 2. For the year beginning July 1 , 2001, and ending June 30,
161161 2002, forty-five and twenty-nine one-hundredths percent (45.29%);

336336 2. The monies apportioned pursuant to subparagraphs a through e
337337 of paragraph 1 of this subsecti on shall be apportioned as follows:
338338 forty percent (40%) of such sum shall be distributed to the various
339339 counties in that proportion which the county road mileage of each
340340 county bears to the entire state road mileage as certified by the
341341 Transportation Commi ssion and the remaining sixty percent (60% ) of
342342 such sum shall be distributed to the various counties on the basis
343343 which the population and area of each county bears to the total
344344 population and area of the state . The population shall be as shown
345345 by the last Federal Census or the most recent annual estimate
346346 provided by the United States Bureau of the Census . The funds shall
347347 be used for the purpose of constructing and maintaining county
348348 highways; provided, however, the county treasurer may deposit so
349349 much of the funds in the sinking fund as may be n ecessary for the
350350 retirement of interest and annual accrual of indebtedness created by
351351 the issuance of county or township bonds for road purposes . Such
352352 deposits to the sinking fund shall not exceed forty percent (4 0%) of
353353 the funds allocated to a county pur suant to this paragraph.
354354 F. 1. The following percentages of the monies referred to in
355355 subsection A of this section shall be remitted to the county
356356 treasurers of the respective counties and by them deposited in a
357357 separate special revenue fund to be used b y the county commissioners
358358 in accordance with paragraph 2 of this subsection:

387387 b. for the year beginning July 1, 2001 , and ending June

390390 c. for the year beginning July 1, 2002, through the year
391391 ending on June 30, 2015, two and fifty -nine one-
392392 hundredths percent (2.59%),
393393 d. for the year beginning July 1, 2015, throu gh the year
394394 ending on June 30, 2019, two a nd fifty-nine one-
395395 hundredths percent (2.59%), but in no event shall the
396396 amount apportioned in any fiscal year pursuant to this
397397 subparagraph exceed the total amount apportioned for
398398 the fiscal year ending on June 30, 2015. Any amounts
399399 in excess of such limi tation shall be placed to the
400400 credit of the General Revenue Fund, and
401401 e. for the year beginning July 1, 2019, and all
402402 subsequent years, two and fifty -nine one-hundredths
403403 percent (2.59%), but in no event shall the a mount
404404 apportioned in any fiscal year pursu ant to this
405405 subparagraph exceed the total amount apportioned for
406406 the fiscal year ending on June 30, 2015 . Any amounts
407407 in excess of such limitation shall be placed to the
408408 credit of the Rebuilding Oklahoma Access an d Driver

437437 2. The monies apportioned pursuant to subparagraphs a through e
438438 of paragraph 1 of this subsection shall be used for the primary
439439 purpose of matching federal funds for the co nstruction of federal
440440 aid projects on coun ty roads, or constructing and maintaining county
441441 or township highways and permanent bridges of such counties . The
442442 distribution of monies apportioned by this paragraph shall be made
443443 upon the basis of the current fo rmula based upon road mileage, area
444444 and population as related to county road improvement and maintenance
445445 costs. Provided, however, the Department of Transportation may
446446 update the formula factors from time to time as necessary to account
447447 for changing conditions.
448448 G. 1. The following percentages o f the monies referred to in
449449 subsection A of this section shall be transmitted by the Tax
450450 Commission to the various counties as set forth in paragraph 2 of
451451 this subsection:
452452 a. from October 1, 2000, until June 30, 20 01, three and
453453 fifty-five one-hundredths percent (3.55%),
454454 b. for the year beginning July 1, 2001, and ending June
455455 30, 2002, three and fifty -nine one-hundredths percent

495495 subsequent years, three and sixty -two one-hundredths
496496 percent (3.62%), but in no event shall the amount
497497 apportioned in any fiscal year pursuant to this
498498 subparagraph exceed the total amount apportioned for
499499 the fiscal year ending on June 30, 2015 . Any amounts
500500 in excess of such limitation shall b e placed to the
501501 credit of the Rebuilding Oklahoma Access and Driver
502502 Safety Fund created in Section 1521 of Title 69 of the
503503 Oklahoma Statutes.
504504 2. The monies apportioned pursuant to subparagraphs a through e
505505 of paragraph 1 of this subsection shall be transm itted to the
506506 various counties on the basis of a formula to be developed by the

534534 currently used for the distribution of County Bridge Program Funds ,
535535 but also taking into consideration the e ffect of terrain and traffic
536536 volume as related to county road improvement and maintenance costs .
537537 Provided, however, the Department of Transportation may update the
538538 formula factors from time to time as necessary to account for
539539 changing conditions. The funds shall be transmitted to the various
540540 county treasurers to be deposited in the county highway fund of
541541 their respective counties.
542542 H. 1. The following percentages of the monies referred to in
543543 subsection A of this section shall be apportioned to the variou s
544544 counties as set forth in paragraph 2 of this subsection:
545545 a. from October 1, 2000, until June 30, 2001, eighty -one
546546 one-hundredths percent (0.81%),
547547 b. for the year beginning July 1, 2001, and ending June
548548 30, 2002, eighty-two one-hundredths percent (0.82%),
549549 c. for the year beginning July 1, 2002, through the year
550550 ending on June 30, 2015, eighty -three one-hundredths
551551 percent (0.83%),
552552 d. for the year beginning July 1, 2015, through the year
553553 ending on June 30, 2019, eigh ty-three one-hundredths
554554 percent (0.83%), but in no event shall the amount
555555 apportioned in any fiscal year pursuant to this
556556 subparagraph exceed the total amount apportioned for

596596 2. The monies apportioned pursuant to subparagraphs a through e
597597 of paragraph 1 of this subsection shall be apportioned to the
598598 various counties based upon the proportion that each county 's
599599 population bears to the total state p opulation.
600600 Each county's allocation of funds shall be remitted to the
601601 various county treasurers to be deposited in the general fund of the
602602 county and used for the support of county government.
603603 I. 1. The following percentages of the monies referred to in
604604 subsection A of this section shall be a pportioned to the various
605605 cities and incorporated towns as set forth in paragraph 2 of this
606606 subsection:

649649 e. for the year beginning July 1, 2019, and all
650650 subsequent years, three and ten one -hundredths percent
651651 (3.10%), but in no event shall the amount apportioned
652652 in any fiscal year pursuant to this subparagraph
653653 exceed the total amount apportioned for the fiscal
654654 year ending on June 30, 2015 . Any amounts in excess
655655 of such limitation shall be placed to the credit of
656656 the Rebuilding Oklahoma Access a nd Driver Safety Fund

685685 2. The monies apportioned pursuant to subparagraphs a through e
686686 of paragraph 1 of this subsection shall be apportioned to the
687687 various cities and incorporated towns based u pon the proportion that
688688 each city or incorporated town's population bears to the total
689689 population of all cities and incorporated towns in the state . Such
690690 funds shall be remitted to the various county treasurers for
691691 allocation to the various cities and inc orporated towns. All such
692692 funds shall be used for the construction, maintenance, repair,
693693 improvement and lighting of streets and alleys . Provided, however,
694694 the governing board of any city or town may, with the approval of
695695 the county excise board, transfe r any surplus funds to the general
696696 revenue fund of such city or town whenever an emergency requires
697697 such a transfer.
698698 J. The following percentages of the monies referred to in
699699 subsection A of this section shall be remitted to the State
700700 Treasurer to be cred ited to the Oklahoma Law Enforcement Retirement
701701 Fund:
702702 1. From October 1, 2000, until June 30, 2001, one and twenty -
703703 two one-hundredths percent (1.22%);
704704 2. For the year beginning July 1, 2001, and ending June 30,
705705 2002, one and twenty -three one-hundredths percent (1.23%); and

732732 3. For the year beginning July 1, 2002, and all subsequent
733733 years, one and twenty -four one-hundredths percent (1.24%).
734734 K. Three one-hundredths of one percent (3/100 of 1%) of the
735735 monies referred to in subsection A of this section shall be remitted
736736 to the State Treasurer to be credited to the Wildlife Conservation
737737 Fund. Seventy-five percent (75%) of the funds shall be used for
738738 fish habitat restoration and twenty -five percent (25%) of the funds
739739 shall be used in the fish hatchery system f or fish production.
740740 L. 1. For the year beginning July 1, 2007, and ending June 30,
741741 2008, five percent (5%) of monies referred to in subsection A of
742742 this section shall be remitted to the State Treasurer to be credited
743743 to the County Improvements for Roads and Bridges Fund as created in
744744 Section 507 of Title 69 of the Oklahoma Statutes.
745745 2. For the year beginning July 1, 2008, and ending June 30,
746746 2009, ten percent (10%) of monies referred to in subsection A of
747747 this section shall be remitted to the State Treas urer to be credited
748748 to the County Improvements for Roads and Bridges Fund as created in
749749 Section 507 of Title 69 of the Oklahoma Statutes.
750750 3. For the period beginning July 1, 2009, and ending December
751751 31, 2012, fifteen percent (15%) of monies referred to i n subsection
752752 A of this section shall be remitted to the State Treasurer to be
753753 credited to the County Improvements for Roads and Bridges Fund as
754754 created in Section 507 of Title 69 of the Oklahoma Statutes.

781781 4. For the period beginning January 1, 2013, and e nding June
782782 30, 2013, fifteen and fifty one-hundredths percent (15.50%) of
783783 monies referred to in subsection A of this section shall be remitted
784784 to the State Treasurer to be credited to the County Improvements for
785785 Roads and Bridges Fund as created in Section 507 of Title 69 of the
786786 Oklahoma Statutes.
787787 5. For the year beginning July 1, 2013, and ending June 30,
788788 2014, eighteen percent (18%) of monies referred to in subsection A
789789 of this section shall be remitted to the State Treasurer to be
790790 credited to the County Improvements for Roads and Bridges Fund as
791791 created in Section 507 of Title 69 of the Oklahoma Statutes.
792792 6. For the year beginning July 1, 2014, twenty percent (20%) of
793793 monies referred to in subsection A of this section shall be remitted
794794 to the State Treasurer to be credited to the County Improve ments for
795795 Roads and Bridges Fund as created in Section 507 of Title 69 of the
796796 Oklahoma Statutes.
797797 7. For the year beginning July 1, 2015, through the year ending
798798 on June 30, 2019, twenty percent (20%) of monies ref erred to in
799799 subsection A of this section s hall be remitted to the State
800800 Treasurer to be credited to the County Improvements for Roads and
801801 Bridges Fund as created in Section 507 of Title 69 of the Oklahoma
802802 Statutes, but in no event shall the total amount ap portioned in any
803803 fiscal year pursuant to t his paragraph exceed One Hundred Twenty

838838 County Improvements for Roads and Br idges Fund as
839839 created in Section 507 of Title 69 of the Oklahoma
840840 Statutes, but in no event shall the total amount
841841 apportioned in any fiscal year pursuant to this
842842 paragraph exceed One Hundred Twenty Million Dollars
843843 ($120,000,000.00) One Hundred Fifty Million Dollars

882882 various counties of the state . The Commission
883883 shall distribute such funds monthly to each
884884 county treasurer as follows:
885885 (a) one-third (1/3) of such funds shall be
886886 distributed to the various counties in the
887887 proportion which the area of each county
888888 bears to the total area of the state,
889889 (b) one-third (1/3) of such funds shall be
890890 distributed to the various counties in the
891891 proportion which the certified county road
892892 miles of each county bear to the total sum
893893 of county road miles in the state, and
894894 (c) one-third (1/3) of such funds shall be
895895 distributed to the various counties in the
896896 proportion which the total replacement cost
897897 for obsolete or deficient bridges according
898898 to the most recent ODOT yearly Bridge
899899 Summary Report for County B ridges for each
900900 county bears to the total amount of such
901901 cost for all such county bridges in the
902902 state, and
903903 (2) for the fiscal year beginning July 1, 2026, and

981981 Each county treasurer shall deposit such fun ds to the
982982 county's county highway fund and such funds shall be used
983983 for maintenance and operations . In no event shall the
984984 total amount apportioned in any fiscal year pursuant to the
985985 provisions of subparagraphs a a nd b of this paragraph
986986 exceed One Hundred Twenty Million Dollars ($120,000,000.00)
987987 One Hundred Fifty Million Dollars ( $150,000,000.00).
988988 M. Twenty-four and eighty-four one-hundredths percent (24.84%)
989989 of the monies referred to in subsection A of this sectio n shall be
990990 remitted to the State Treasurer to be credited to the Rebuilding
991991 Oklahoma Access and Driver Safety Fund created in Section 1521 of
992992 Title 69 of the Oklahoma Statutes.
993993 N. Monies allocated to counties by this section may be
994994 estimated by the county excise board in the budget for the county as
995995 anticipated revenue to the extent of ninety percent (90%) of the
996996 previous year's income from such source; provided, not more than
997997 fifteen percent (15%) can be encumbered during any month.
998998 O. Notwithstanding any other provisions of this section, for
999999 the fiscal year beginning July 1, 2003, the first One Hundred
10001000 Thousand Dollars ($100,000.00) of the monies collected or rece ived
10011001 by the Tax Commission pursuant to the registration of motorcycles
10021002 and mopeds in this st ate shall be placed to the credit of the
10031003 Oklahoma Tax Commission Revolving Fund.
