5148 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5249 SECTION 1. AMENDATORY 59 O.S. 2021, Section 396, is
5350 amended to read as follows:
5451 Section 396. There is hereby re-created, to continue until July
5552 1, 2023, in accordance with the provisions of the Oklahoma Sunset
5653 Law, the Oklahoma Funeral Board. Any reference in the statutes to
5754 the Oklahoma State Board of Embalmers and Funeral Directors shall be
5855 a reference to the Oklahom a Funeral Board. The Board shall consist
5956 of seven (7) persons, who shall be appointed by the Governor. A
6057 majority of the members of the Board shall constitute a quorum at
6158 any meeting, and a majority of the required quorum shall be
6259 sufficient for the Board to take action by vote. The term of
6360 membership of each me mber of the Board shall be five (5) years from

91-the expiration of the term of the member succeeded. Any member
9288 having served as a member of the Board shall be eligible for
9389 reappointment. Provided that, a member of the Board shall serve no
9490 more than two consecutive terms and any unexpired term that a member
9591 is appointed to shall not apply to this limit. The Governor shall
9692 appoint the necessary members to the Board upon vacancies and
9793 immediately prior to the expiration of the various terms. Upon
9894 request of the Governor, appointments of a licensed embalmer and
9995 funeral director member of the Board shall be made from a list of
10096 five qualified persons submitted by the Oklahoma Funeral Directors
10197 Association. An appointment to fill a vacancy shall be for the
10298 unexpired term. A member of the Board shall serve until a successor
10399 is appointed and qualified. No person shall be a member of the
104100 Board, unless, at the time of appointment, the person is of good
105101 moral character and a resident of this state. Five of the mem bers
106102 shall have been actively engaged in the practice of embalming and
107103 funeral directing in this state for not less than seven (7)
108104 consecutive years immediately prior to the appointment of the
109105 person, shall have an active license as provided by the Funeral
110106 Services Licensing Act, shall keep the license effective, and remain
111107 a resident of this state during the entire time the person serves on
112108 the Board. Two of the members of the Board shall be chose n from the
113109 general public, one of whom shall, if possible, be a person licensed
114110 and actively engaged in the health care field, and shall not be
111+licensed funeral directors or embalmers or have any interest,

142-licensed funeral directors or embalmers or have any interest,
143138 directly or indirectly, in any funeral establishme nt or any business
144139 dealing in funeral services, supplies or equipment. These two
145140 members shall be appointed to serve for five -year terms.
146141 SECTION 2. This act shall become effective November 1, 2022.
