44	41		amending 59 O.S. 2021, Section 396, which relates to
45	42		the Oklahoma Funeral Board; providing for quorum; and

51	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	49		SECTION 1. AMENDATORY 59 O.S. 2021, Section 396, is
53	50		amended to read as follows:
54	51		Section 396. There is hereby re-created, to continue until July
55	52		1, 2023, in accordance with the provisions of the Oklahoma Sunset
56	53		Law, the Oklahoma Funeral Board. Any reference in the statutes to
57	54		the Oklahoma State Board of Embalmers and Funeral Directors shall be
58	55		a reference to the Oklahom a Funeral Board. The Board shall consist
59	56		of seven (7) persons, who shall be appointed by the Governor. A
60	57		majority of the members of the Board shall constitute a quorum at
61	58		any meeting, and a majority of the required quorum shall be
62	59		sufficient for the Board to take action by vote. The term of
63	60		membership of each me mber of the Board shall be five (5) years from

91		-	the expiration of the term of the member succeeded. Any member
92	88		having served as a member of the Board shall be eligible for
93	89		reappointment. Provided that, a member of the Board shall serve no
94	90		more than two consecutive terms and any unexpired term that a member
95	91		is appointed to shall not apply to this limit. The Governor shall
96	92		appoint the necessary members to the Board upon vacancies and
97	93		immediately prior to the expiration of the various terms. Upon
98	94		request of the Governor, appointments of a licensed embalmer and
99	95		funeral director member of the Board shall be made from a list of
100	96		five qualified persons submitted by the Oklahoma Funeral Directors
101	97		Association. An appointment to fill a vacancy shall be for the
102	98		unexpired term. A member of the Board shall serve until a successor
103	99		is appointed and qualified. No person shall be a member of the
104	100		Board, unless, at the time of appointment, the person is of good
105	101		moral character and a resident of this state. Five of the mem bers
106	102		shall have been actively engaged in the practice of embalming and
107	103		funeral directing in this state for not less than seven (7)
108	104		consecutive years immediately prior to the appointment of the
109	105		person, shall have an active license as provided by the Funeral
110	106		Services Licensing Act, shall keep the license effective, and remain
111	107		a resident of this state during the entire time the person serves on
112	108		the Board. Two of the members of the Board shall be chose n from the
113	109		general public, one of whom shall, if possible, be a person licensed
114	110		and actively engaged in the health care field, and shall not be

144	139		dealing in funeral services, supplies or equipment. These two
145	140		members shall be appointed to serve for five -year terms.
146	141		SECTION 2. This act shall become effective November 1, 2022.
