49	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
50	56		SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-317, is
51	57		amended to read as follows:
52	58		Section 1-317. A. A death certific ate for each death which
53	59		occurs in this state shall be filed with the State Department of
54	60		Health, within three (3) days after such death.
55	61		B. The funeral director shall personally sign the death
56	62		certificate and shall be responsible for filing the death
57	63		certificate. If the funeral director is not available, the person
58	64		acting as such who first assumes custody of a d ead body in
59	65		accordance with Section 1158 of T itle 21 of the Oklahoma Statutes

	93	+	shall personally sign and file the death certificate. The personal
87	94		data shall be obtained from the next of kin or the best qualified
88	95		person or source available. The certificate shall be completed as
89	96		to personal data and d elivered to the attending physician or the
90	97		medical examiner responsible for completing the medical
91	98		certification portion of the certificate of death within twenty -four
92	99		(24) hours after the death. No later than July 1, 2012, the
93	100		personal data, and no later than July 1, 2017, the medical
94	101		certificate portion, shall be entered into the prescribed electronic
95	102		system provided by the State Registrar of Vital Statistics and the
96	103		information submitted to the State Registra r of Vital Statistics.
97	104		The resultant certifi cate produced by the electronic system shall be
98	105		provided to the physician or medical examiner for me dical
99	106		certification within twenty -four (24) hours after the death.
100	107		C. The medical certification shall be compl eted and signed
101	108		within forty-eight (48) hours after death by the physician or
102	109		advanced practice registered nurse in charge of the patient 's care
103	110		for the illness or condition which resulted in death, except when
104	111		inquiry as to the cause of death is required by Section 938 of this
105	112		title. No later than July 1, 2017, the medical certification
106	113		portion of certificate data shall be entered into the prescr ibed
107	114		electronic system provided by the State Registrar of Vital
108	115		Statistics and the information submitted to the State Registrar of
109	116		Vital Statistics.

136	144		D. In the event that the physician or advanced practi ce
137	145		registered nurse in charge of the patient 's care for the illness or
138	146		condition which resulted in death is not in attendance at the time
139	147		of death, the medical cert ification shall be completed and signed
140	148		within forty-eight (48) hours after death by the phy sician or
141	149		advanced practice registered nurse in atten dance at the time of
142	150		death, except:
143	151		1. When the patient is under hospice care at the time of death,
144	152		the medical certification may be signed by the hospice 's medical
145	153		director; and
146	154		2. When inquiry as to the cause of death is required by Section
147	155		938 of this title.
148	156		Provided, that such certification, if signed by other than the
149	157		attending physician or advanced practice registered nurse, shall
150	158		note on the face the name of the attending physician or advanced
151	159		practice registered nurse and that the information show n is only as
152	160		reported.
153	161		E. A certifier completing cause of death on a certificate of
154	162		death who knows that a let hal drug, overdose or other means of
155	163		assisting suicide within the meaning of Sections 3141.2 through
156	164		3141.4 of this title caused or contributed t o the death shall list
157	165		that means among the chain of events under cause of death or list it
158	166		in the box that describes how the injury occurred. If such mean s is
159	167		in the chain of events under cause of deat h or in the box that

187	196		"suicide" as the manner of death.
188	197		F. In addition to any other requirements pro vided by law, all
189	198		death certificates shall include the driver license number or state
190	199		identification card number of the decedent, if available.
191	200		SECTION 2. It being immediately necessary for the preservation
192	201		of the public peace, health or safety, an emergency is hereby
193	202		declared to exist, by reason whereof this act shall take effect a nd
194	203		be in full force from and after its passage an d approval.
