4955 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
5056 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-317, is
5157 amended to read as follows:
5258 Section 1-317. A. A death certific ate for each death which
5359 occurs in this state shall be filed with the State Department of
5460 Health, within three (3) days after such death.
5561 B. The funeral director shall personally sign the death
5662 certificate and shall be responsible for filing the death
5763 certificate. If the funeral director is not available, the person
5864 acting as such who first assumes custody of a d ead body in
5965 accordance with Section 1158 of T itle 21 of the Oklahoma Statutes
60-shall personally sign and file the death certificate. The personal

93+shall personally sign and file the death certificate. The personal
8794 data shall be obtained from the next of kin or the best qualified
8895 person or source available. The certificate shall be completed as
8996 to personal data and d elivered to the attending physician or the
9097 medical examiner responsible for completing the medical
9198 certification portion of the certificate of death within twenty -four
9299 (24) hours after the death. No later than July 1, 2012, the
93100 personal data, and no later than July 1, 2017, the medical
94101 certificate portion, shall be entered into the prescribed electronic
95102 system provided by the State Registrar of Vital Statistics and the
96103 information submitted to the State Registra r of Vital Statistics.
97104 The resultant certifi cate produced by the electronic system shall be
98105 provided to the physician or medical examiner for me dical
99106 certification within twenty -four (24) hours after the death.
100107 C. The medical certification shall be compl eted and signed
101108 within forty-eight (48) hours after death by the physician or
102109 advanced practice registered nurse in charge of the patient 's care
103110 for the illness or condition which resulted in death, except when
104111 inquiry as to the cause of death is required by Section 938 of this
105112 title. No later than July 1, 2017, the medical certification
106113 portion of certificate data shall be entered into the prescr ibed
107114 electronic system provided by the State Registrar of Vital
108115 Statistics and the information submitted to the State Registrar of
109116 Vital Statistics.

136144 D. In the event that the physician or advanced practi ce
137145 registered nurse in charge of the patient 's care for the illness or
138146 condition which resulted in death is not in attendance at the time
139147 of death, the medical cert ification shall be completed and signed
140148 within forty-eight (48) hours after death by the phy sician or
141149 advanced practice registered nurse in atten dance at the time of
142150 death, except:
143151 1. When the patient is under hospice care at the time of death,
144152 the medical certification may be signed by the hospice 's medical
145153 director; and
146154 2. When inquiry as to the cause of death is required by Section
147155 938 of this title.
148156 Provided, that such certification, if signed by other than the
149157 attending physician or advanced practice registered nurse, shall
150158 note on the face the name of the attending physician or advanced
151159 practice registered nurse and that the information show n is only as
152160 reported.
153161 E. A certifier completing cause of death on a certificate of
154162 death who knows that a let hal drug, overdose or other means of
155163 assisting suicide within the meaning of Sections 3141.2 through
156164 3141.4 of this title caused or contributed t o the death shall list
157165 that means among the chain of events under cause of death or list it
158166 in the box that describes how the injury occurred. If such mean s is
159167 in the chain of events under cause of deat h or in the box that

187196 "suicide" as the manner of death.
188197 F. In addition to any other requirements pro vided by law, all
189198 death certificates shall include the driver license number or state
190199 identification card number of the decedent, if available.
191200 SECTION 2. It being immediately necessary for the preservation
192201 of the public peace, health or safety, an emergency is hereby
193202 declared to exist, by reason whereof this act shall take effect a nd
194203 be in full force from and after its passage an d approval.
