42	42	tuition for children of military members; modifying
43	43	time span for applicability; creating in-state
44	44	tuition status for member of Armed Forces; creating
45	45	in-state tuition status for spouse and dependent
46	46	children of members of Armed Forces; providing for
47	47	codification; and providing an effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 70 O.S. 2021, Section 3247, is
56	56	amended to read as follows :
57	57	Section 3247. A. A student shall be eligible for in -state
58	58	status regardless of the residency of the student if the student is
59	59	a:
60	60	1. Dependent child or spouse of a person currently serving as a
61	61	member of the active uniformed services of the United States on
62	62	full-time active duty status of more than thirty (30) days and for
63	63	whom Oklahoma is the home of record;

90	90	2. Dependent child or spouse of a person currently serving as a
91	91	member of the military reserve on active duty orders of more than
92	92	thirty (30) days and for whom Oklahoma is the home of record;
93	93	3. Person, or spouse or dependent child of a person, currently
94	94	serving as a member of the uniformed services of the United States
95	95	who is on full-time active duty for a period of more than thirty
96	96	(30) days and is stationed or temporarily present in Oklahoma
97	97	through military orders;
98	98	4. Person, or spouse or dependent child of a person, who was
99	99	discharged or released from a period of not fewer than ninety (90)
100	100	days of active uniformed service, less than five (5) ten (10) years
101	101	before the date of enrollment in the course (s) concerned and for
102	102	whom Oklahoma is the home of record; or
103	103	5. Person who is participating in or has received a partial or
104	104	full scholarship from the Air Force Reserve Officers ' Training
105	105	Corps, Army Reserve Officers ' Training Corps or the Navy/Marines
106	106	Reserve Officers' Training Corps.
107	107	B. To be eligible for in-state status as provided for in
108	108	subsection A of this section and to maintain eligibi lity, the
109	109	student shall:
110	110	1. Satisfy admission and retention standards as determined by
111	111	the Oklahoma State R egents for Higher Education for an institution
112	112	within The Oklahoma State System of Higher Education; and

139	139	2. Have secured admission to and enrolls f ull-time or part-time
140	140	in a program of study at an institution within The Oklahoma State
141	141	System of Higher Education .
142	142	C. A student who files with the institution within The Oklahoma
143	143	State System of Higher Education at which the student intends to
144	144	register a letter of intent to establish residence in the state and
145	145	who resides in the state while enrolled in the instituti on shall be
146	146	eligible for in-state status, regardless of the residency of the
147	147	student or home of record, if the student:
148	148	1. Is a person who:
149	149	a. was discharged or released from a period of not fewer
150	150	than ninety (90) days of active duty uniformed
151	151	service, less than five (5) years before the date of
152	152	enrollment in the course(s) concerned, and
153	153	b. is pursuing a course of education with educational
154	154	assistance under Chapter 30 or 33 of Title 38 of the
155	155	United States Code while living in this state; or
156	156	2. Is a person who:
157	157	a. is entitled to assistance under Section 3311(b)(9) or
158	158	3319 of Title 38 of the United States Code by virtue
159	159	of a relationship to a pe rson who was discharged or
160	160	released from a period of not fewer than ninety (90)
161	161	days of active duty uniformed serv ices, and

188	188	b. enrolls in the course(s) concerned within five (5)
189	189	years of the date the related person was discharged or
190	190	released from a period of not fewer than ninety (90)
191	191	days of active duty uniformed services.
192	192	D. To be eligible for in -state status as provided for in
193	193	subsection C of this section and to maintain eligibility, the
194	194	student shall:
195	195	1. Satisfy admission and retention standards as de termined by
196	196	the Oklahoma State Regents for Higher Education for an institution
197	197	within The Oklahoma State System of Higher Education; and
198	198	2. Have secured admission to and enrolls full -time or part-time
199	199	in a program of study at an institution within The Okl ahoma State
200	200	System of Higher Education.
201	201	E. A student who meets the eligibility requirements for in -
202	202	state status shall maintain in-state status if the student remains
203	203	continuously enrolled at an institution within The Oklahoma State
204	204	System of Higher Educat ion after the student:
205	205	1. As described in paragraphs 1, 2 or 3 of subsection A of this
206	206	section is discharged or r eleased from active duty service;
207	207	2. As described in paragraph 4 of subsection A of this section
208	208	or paragraph 1 and 2 of subsection C of this section exceeds the
209	209	five-year period after being discharged or released from active duty
210	210	uniformed service;

238	238	has exhausted education assistance provided under Chapter 30 or 33
239	239	of Title 38 of the United States Code; or
240	240	4. As described in paragraph 2 of subsection C of this section
241	241	has exhausted education assistance provided under Section 3311(b)(9)
242	242	or 3319 of Title 38 of the United States Code.
243	243	F. For purposes of this section, "home of record" means the
244	244	place where one was living when the person enlisted or was
245	245	commissioned into the military or reenlisted in the military.
246	246	G. The State Regents for Higher Education shall develop
247	247	policies and procedures necessary to implement the provisions of
248	248	this section.
249	249	SECTION 2. NEW LAW A new section of law to be codified
250	250	in the Oklahoma Statute s as Section 3249 of Title 70, unless there
251	251	is created a duplication in numbering, reads as follows:
252	252	If a member of the Armed Forces has been stationed for more than
253	253	one (1) year in Oklahoma any time in the previous ten (10) years
254	254	before the date of enrollment in the course(s) concerned, then the
255	255	member, or the spouse or dependent child of the member , shall be
256	256	eligible for in-state tuition at a public institution of higher
257	257	education.
258	258	SECTION 3. This act shall become effective November 1, 2022.
