5754 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5855 SECTION 1. AMENDATORY 70 O.S. 20 21, Section 16-102, is
5956 amended to read as follows:
6057 Section 16-102. A. The State Textbook Committee shall meet at
6158 the call of the chair as often as necessary, with two (2) weeks '
6259 public notice, to discharge its responsibilities. If nece ssary, not
6360 later than the first day of December of each year the State Textbook
6461 Committee shall meet to select textbooks for subjects taught in the
6562 public schools of the state for grades prekindergarten through
63+twelve, which selections shall be for not mor e than six (6) years
64+for every textbook.

93-twelve, which selections shall be for not mor e than six (6) years

9591 B. The Committee may suspend any currently pending selection
9692 process of textbooks and may extend by at least two (2) years the
9793 six-year adoption period of those textbooks currently on the state
9894 adopted list, for th e purpose of delaying for two (2) years the six -
9995 year adoption cycle of subjects.
10096 C. "Textbooks", as used in Sections 16 -101 through 16-124 of
10197 this title, means instructional materials that are designed for use
10298 by pupils as a learning resource. Instructio nal materials may be
10399 printed or nonprinted and may include t extbooks, technology-based
104100 and other educational materials.
105101 D. "List of textbooks" or "the list", as used in Sections 16 -
106102 101 through 16-111 of this title, means the official textbook list
107103 required by Section 6 of Article XIII of the Oklahoma Constitution.
108104 The list shall include the textbooks and other instructional
109105 materials selected by the State Textbook Committee for use in the
110106 common schools of the state.
111107 E. The State Department of Education, in coordination with the
112108 State Textbook Committee, shall ap prove an application process to
113109 assemble annually one or more review teams comprised of subject
114110 matter experts for each subject area under review to assist the
115111 Committee in reviewing textbooks and instructional materials. The
116112 number of review teams shall be contingent on the number of subject
113+areas under review each year. Members of the review teams shall
114+have specific expertise in the subject areas being reviewed that

144-areas under review each year. Members of the review teams shall
145-have specific expertise in the subject areas being reviewed that
146141 year. Review teams shall c onsist of no less than twelve members
147142 each, but may be as la rge as is deemed necessary by the State
148143 Textbook Committee and the State Department of Education. Subject
149144 to the availability of funds within the State Department of
150145 Education, members of the rev iew teams shall receive from the
151146 Department necessary travel ing expenses while in the performance of
152147 duties pursuant to the State Travel Reimbursement Act.
153148 F. The Committee shall select textbooks or series of textbooks
154149 for each subject, which, to the grea test extent possible, are
155150 aligned with the subject matter st andards adopted by the State Board
156151 of Education pursuant to Section 11 -103.6 of this title. The
157152 Committee, in consultation with the State Department of Education,
158153 shall adopt a rubric to be used by the review teams as a means of
159154 evaluating textbooks submi tted for review. The rubric shall contain
160155 a three-tiered rating system in which the first tier shall be
161156 labeled "Exemplifies Quality", the second tier shall be labeled
162157 "Approaching Quality", and the third tier shall be labeled "Not
163158 Representing Quality ". The rubric shall also include, but not be
164159 limited to, criteria for alignment to subject matter standards such
165160 that all standards are present and treated with the appropriate
166161 depth to support stud ents in learning the skills and information
167162 contained in the subject matter standards, as well as usability for
163+teacher planning, learning, assessment and differentiated
164+instruction. The Committee, in consultation with the review teams,

196-instruction. The Committee, in consultation with the review teams,
197191 may include additional criteria specific to the subject area being
198192 reviewed. The rubric shall require each criterion to be scored
199193 individually with justification, and shall provide an overall
200194 recommendation for the rating.
201195 G. Review teams shall review all materials in acc ordance with
202196 the rubric adopted in subsection F of this sect ion and shall submit
203197 the review and recommended rating to the Committee. The Committee
204198 shall consider but not be required to accept the recommended rating
205199 of the review teams. The Committee may request that the review
206200 teams supply additional information to support their recommendations
207201 or the Committee may provide its own justification utilizing the
208202 adopted rubric.
209203 H. The Committee, having verified that the review process has
210204 been conducted in a scrupulous and fair manner, shall adopt a final
211205 rating for each textbook prior to including it on the textbook list
212206 required by Section 16 -110 of this title. The completed rubric for
213207 each evaluated textbook, including the review team's
214208 recommendations, shall be made publicly available on the State
215209 Textbook Committee website.
216210 I. After a final textbook list is published, the State Textbook
217211 Committee may determine that unusual or extraordinary circumstances
218212 exist in a particular subject area during the peri od for which
213+textbooks have been selected for that subject a rea. Unusual or
214+extraordinary circumstances shall include but not be limited to

246-textbooks have been selected for that subject area. Unusual or
247-extraordinary circumstances shall include but not be limited to
248241 significant new techniques of teaching in a particular subject area
249242 or significant new findings or discoveries in a particular subject
250243 area. Upon a determination by three -fourths (3/4) of the members of
251244 the State Textbook Committee that unusual or extraordinary
252245 circumstances exist in a particular subject area, the Committee may
253246 select one or more textbooks in that sub ject area for the remainder
254247 of the adoption period.
255248 J. The State Department of Education shall house the website of
256249 the State Textbook Committee on its agency website.
257250 K. Five After a final textbook list is published, five or more
258251 district boards of education may petition the State Board of
259252 Education to add a book or series of textbooks to the approved list
260253 selected by the State Textbook Committee. The Board shall only
261254 approve a petition when it determines that unusual or extraordinary
262255 circumstances exist. Petitions shal l include a rigorous review
263256 process completed by the requesting school districts in a manner
264257 prescribed by the Board. At a minimum, the review shall include
265258 alignment to subject matter standards such that all stand ards are
266259 present and treated with the app ropriate depth to support students
267260 in learning the skills and information contained in the standards,
268261 as well as usability for teacher planni ng, learning, assessment, and
269262 differentiated instruction. The requesting school districts may
263+request support from the State Department of Education in their
264+review.

299291 L. The State Board of Education shall promulgate rules to
300292 implement the method and time frame for handling the petitions in
301293 the most expeditious manner.
302294 SECTION 2. It being immediately n ecessary for the preservation
303295 of the public peace, health or safety, an emergency is hereby
304296 declared to exist, by reason whereof this act shall take effect and
305297 be in full force from and after its passage an d approval.
