5148 BE IT ENACTED BY THE PEOPL E OF THE STATE OF OKLAHOMA:
5249 SECTION 1. AMENDATORY 51 O.S. 2021, Section 152 , is
5350 amended to read as follows:
5451 Section 152. As used in The Governmental Tort C laims Act:
5552 1. "Action" means a proceeding in a court of competent
5653 jurisdiction by which one party brings a suit against another;
5754 2. "Agency" means any board, commission, committee, d epartment
5855 or other instrumentality or entity designated to act in behalf of
5956 the state or a political subd ivision;
6057 3. "Charitable health care provi der" means a person who is
6158 licensed, certified, or otherwise authorized by the laws of this
6259 state to administer health care in the ordinary course of business
6360 or the practice of a p rofession and who provides care t o a medically

9187 indigent person, as defined in paragraph 9 of this section, with no
9288 expectation of or acceptance of compensation of any kind;
9389 4. "Claim" means any written demand presented by a claimant or
9490 the claimant's authorized representative in accordan ce with The
9591 Governmental Tort Claims Act t o recover money from the state or
9692 political subdivision as compensation for an act or omission of a
9793 political subdivision or the state or an employee;
9894 5. "Claimant" means the person or the person's authorized
9995 representative who files notice of a claim in accordance with The
10096 Governmental Tort Claims Act. Only the following persons and no
10197 others may be claimants:
10298 a. any person holding an interest in real or personal
10399 property which suffers a loss, provided that the c laim
104100 of the person shall be aggregated wit h claims of all
105101 other persons holding an interest in the property and
106102 the claims of all other persons which a re derivative
107103 of the loss, and that multiple claimants shall be
108104 considered a single claimant,
109105 b. the individual actually involved in the accident o r
110106 occurrence who suffers a loss, provided that the
111107 individual shall aggregate in the claim the losses of
112108 all other persons which are derivative of the loss, or
113109 c. in the case of death, an administrator, special
114110 administrator or a personal representative wh o shall

142137 aggregate in the claim all losses of all persons which
143138 are derivative of the death;
144139 6. "Community health care provider" means:
145140 a. a health care provider who volunteers serv ices at a
146141 community health center that has been deemed by the
147142 U.S. Department of Health and Human Services as a
148143 federally qualified health center as defined by 42
149144 U.S.C., Section 1396d (l)(2)(B),
150145 b. a health provider who provides services to an
151146 organization that has been deemed a federally
152147 qualified look-alike community health cen ter, and
153148 c. a health care provider who provides services to a
154149 community health center that has made applicati on to
155150 the U.S. Department of Health and Human Services for
156151 approval and deeming as a federally qualified look-
157152 alike community health center in comp liance with
158153 federal application guidance, and has received
159154 comments from the U.S. Department of Health and Hu man
160155 Services as to the status of such application with the
161156 established intent of resubmitting a modified
162157 application, or, if denied, a new applicat ion, no
163158 later than six (6) months from the date of the
164159 official notification from the U.S. Department of

194188 7. "Employee" means any person who is authorized to act in
195189 behalf of a politica l subdivision or the state whether that person
196190 is acting on a permanent or temporary basis, with or without b eing
197191 compensated or on a full-time or part-time basis.
198192 a. Employee also includes:
199193 (1) all elected or appointed officers, members of
200194 governing bodies and other persons designated to
201195 act for an agency or political subdivision, but
202196 the term does not mean a pe rson or other legal
203197 entity while acting in the capacity of an
204198 independent contractor or an employee of an
205199 independent contractor,
206200 (2) from September 1, 1991, through June 30, 1996,
207201 licensed physicians, licensed osteopathic
208202 physicians and certified nurse -midwives providing
209203 prenatal, delivery or infant care services to
210204 State Department of Health clients pursuan t to a
211205 contract entered into with the Stat e Department
212206 of Health in accordance with paragraph 3 of
213207 subsection B of Section 1 -106 of Title 63 of the
214208 Oklahoma Statutes but only insofar as services
215209 authorized by and in conform ity with the terms of

245238 (3) any volunteer, full-time or part-time firefighter
246239 when performing duties for a fire department
247240 provided for in subparagraph j of paragrap h 11 of
248241 this section.
249242 b. For the purpose of The Governmental Tort Claims Ac t,
250243 the following are employees of this state, regardless
251244 of the place in this state where duties as employees
252245 are performed:
253246 (1) physicians acting in an administrative capacity,
254247 (2) resident physicians and resident interns
255248 participating in a graduate medic al education
256249 program of the University of Oklahoma Health
257250 Sciences Center, the College of Osteopathic
258251 Medicine of Oklahoma State University, or the
259252 Department of Mental Health and S ubstance Abuse
260253 Services,
261254 (3) faculty members and staff of the University of
262255 Oklahoma Health Sciences Center and the College
263256 of Osteopathic Medicine of Oklahoma State
264257 University, while engaged in teaching duties,

293285 administrative capacity as an employee of an
294286 agency of the State of O klahoma,
295287 (5) physicians who provide medical care to inmates
296288 pursuant to a contract with the Department of
297289 Corrections,
298290 (6) any person who is licensed to practice medicine
299291 pursuant to Title 59 of the Oklahoma Statut es,
300292 who is under an administrative profess ional
301293 services contract with the Oklahoma Health Care
302294 Authority under the auspices of the Oklahoma
303295 Health Care Authority Chief Medical Officer, and
304296 who is limited to performing admi nistrative
305297 duties such as profess ional guidance for medical
306298 reviews, reimbursement rates, service
307299 utilization, health care delivery and benefit
308300 design for the Oklahoma Health Care Auth ority,
309301 only while acting within the scope of such
310302 contract,
311303 (7) licensed medical professionals under cont ract
312304 with city, county, or state entities who provide
313305 medical care to inmates or detainees in the
314306 custody or control of law enforcement agencies,

342333 (8) licensed mental health professionals as defined
343334 in Sections 1-103 and 5-502 of Title 43A of the
344335 Oklahoma Statutes, who are conducting initial
345336 examinations of individuals for the purpose of
346337 determining whether an individual meets the
347338 criteria for emergency d etention as part of a
348339 contract with the Department of Mental Health and
349340 Substance Abuse Services, and
350341 (9) licensed mental health professionals as d efined
351342 in Sections 1-103 and 5-502 of Title 43A of the
352343 Oklahoma Statutes, who are providing mental
353344 health or substance abuse treatment services
354345 under a professional services contrac t with the
355346 Department of Mental H ealth and Substance Abuse
356347 Services and are providing such treatment
357348 services at a state-operated facility.
358349 Physician faculty members and physician staff of the
359350 University of Oklahoma Health Sciences Center and the
360351 College of Osteopathic Medicine of Oklahom a State
361352 University not acting in an admini strative capacity or
362353 engaged in teaching duties are not employees or agents
363354 of the state.
364355 c. Except as provided in subparagraph b o f this
365356 paragraph, in no event shall the state be h eld liable

393383 for the tortious condu ct of any physician, resident
394384 physician or intern while practicing medicine or
395385 providing medical treatment to patients;
396386 8. "Loss" means death or injur y to the body or right s of a
397387 person or damage to real or personal proper ty or rights therein;
398388 9. "Medically indigent" means a person requiring med ically
399389 necessary hospital or other health care services for the person or
400390 the dependents of the person who ha s no public or private third-
401391 party coverage, and whose personal resource s are insufficient to
402392 provide for needed health care;
403393 10. "Municipality" means any incorporated city or town, and all
404394 institutions, agencies or instrumentalities of a municipality;
405395 11. "Political subdivision" means:
406396 a. a municipality,
407397 b. a school district, including, but not limited to, a
408398 technology center school district estab lished pursuant
409399 to Section 4410, 4411, 4420 or 4420.1 of Title 70 of
410400 the Oklahoma Statutes,
411401 c. a county,
412402 d. a public trust where th e sole beneficiary or
413403 beneficiaries are a city, to wn, school district or
414404 county. For purposes of The Governmental Tort Claim s
415405 Act, a public trust shall include:

443432 (1) a municipal hospital created pursuant to Sections
444433 30-101 through 30-109 of Title 11 of the Oklahoma
445434 Statutes, a county hospital created purs uant to
446435 Sections 781 through 796 of Title 19 of the
447436 Oklahoma Statutes, or i s created pursuant to a
448437 joint agreement between such governing
449438 authorities, that is operated for the public
450439 benefit by a public tru st created pursuant to
451440 Sections 176 through 180.4 of Title 60 of the
452441 Oklahoma Statutes and managed by a governing
453442 board appointed or elected by the municipality,
454443 county, or both, who exercises control of the
455444 hospital, subject to the a pproval of the
456445 governing body of the municipality, county, or
457446 both,
458447 (2) a public trust created pursuant t o Sections 176
459448 through 180.4 of Title 60 o f the Oklahoma
460449 Statutes after January 1, 2009, the primary
461450 purpose of which is to own, manage, or operate a
462451 public acute care hospi tal in this state that
463452 serves as a teaching hospit al for a medical
464453 residency program provided by a college of
465454 osteopathic medicine and provides care to
466455 indigent persons, and

503491 to the provisions of the Oklahoma Genera l Corporation
504492 Act for the primary purpose of developing and
505493 providing rural water supply and sewage disposal
506494 facilities to serve ru ral residents,
507495 g. for the purposes of The Governme ntal Tort Claims Act
508496 only, districts formed pursuant to the Rural Water,
509497 Sewer, Gas and Solid Waste Management Districts Act,
510498 h. for the purposes of The Governmental Tort Claims Act
511499 only, master conservancy districts formed pursuant to
512500 the Conservancy Act of Oklahoma,
513501 i. for the purposes of The Governmental Tort Claims Act
514502 only, a fire protection district created pursuant to

646631 use the property or tracks of the railroad for the
647632 provision of public passe nger rail service to the
648633 extent claims against the contract operator or
649634 railroad arise out of or are related to or in
650635 connection with such property int erest, services or
651636 operation of the public passenger rail service.
652637 Provided, the acquisition of commerci al liability
653638 insurance to cover the activi ties of the regional
654639 transportation authority, contract operator or
655640 railroad shall not operate as a waiver of any
656641 liabilities, immunities or defenses provided pursuant
657642 to the provisions of The Governmental Tort Cla ims Act,
658643 and all their institutions, instr umentalities or agencies;
659644 12. "Scope of employment" means performance by an employee
660645 acting in good faith wi thin the duties of the employee's office or
661646 employment or of tasks lawfu lly assigned by a competent autho rity
662647 including the operation or use of an agency vehicle or equipment
663648 with actual or implied consent of the supervisor of the employee,
664649 but shall not include corruption or f raud;
665650 13. "State" means the State of Oklahoma or any office,
666651 department, agency, a uthority, commission, board, institution,
667652 hospital, college, university, public trust created pursuant to
668653 Title 60 of the Oklahoma Statutes of which th e State of Oklahoma is
669654 the beneficiary, or other instrumentality thereof ; and

697681 14. "Tort" means a legal wrong, independent of contract,
698682 involving violation of a duty imposed by general law, statute, the
699683 Constitution of the State of Oklahoma, or otherwise, resulting in a
700684 loss to any person, association or corporation as the pro ximate
701685 result of an act or omissi on of a political subdivision or the state
702686 or an employee acting within the scope of employment.
703687 SECTION 2. This act shall become effe ctive November 1, 2022.
