51	48		BE IT ENACTED BY THE PEOPL E OF THE STATE OF OKLAHOMA:
52	49		SECTION 1. AMENDATORY 51 O.S. 2021, Section 152 , is
53	50		amended to read as follows:
54	51		Section 152. As used in The Governmental Tort C laims Act:
55	52		1. "Action" means a proceeding in a court of competent
56	53		jurisdiction by which one party brings a suit against another;
57	54		2. "Agency" means any board, commission, committee, d epartment
58	55		or other instrumentality or entity designated to act in behalf of
59	56		the state or a political subd ivision;
60	57		3. "Charitable health care provi der" means a person who is
61	58		licensed, certified, or otherwise authorized by the laws of this
62	59		state to administer health care in the ordinary course of business
63	60		or the practice of a p rofession and who provides care t o a medically

91	87		indigent person, as defined in paragraph 9 of this section, with no
92	88		expectation of or acceptance of compensation of any kind;
93	89		4. "Claim" means any written demand presented by a claimant or
94	90		the claimant's authorized representative in accordan ce with The
95	91		Governmental Tort Claims Act t o recover money from the state or
96	92		political subdivision as compensation for an act or omission of a
97	93		political subdivision or the state or an employee;
98	94		5. "Claimant" means the person or the person's authorized
99	95		representative who files notice of a claim in accordance with The
100	96		Governmental Tort Claims Act. Only the following persons and no
101	97		others may be claimants:
102	98		a. any person holding an interest in real or personal
103	99		property which suffers a loss, provided that the c laim
104	100		of the person shall be aggregated wit h claims of all
105	101		other persons holding an interest in the property and
106	102		the claims of all other persons which a re derivative
107	103		of the loss, and that multiple claimants shall be
108	104		considered a single claimant,
109	105		b. the individual actually involved in the accident o r
110	106		occurrence who suffers a loss, provided that the
111	107		individual shall aggregate in the claim the losses of
112	108		all other persons which are derivative of the loss, or
113	109		c. in the case of death, an administrator, special
114	110		administrator or a personal representative wh o shall

142	137		aggregate in the claim all losses of all persons which
143	138		are derivative of the death;
144	139		6. "Community health care provider" means:
145	140		a. a health care provider who volunteers serv ices at a
146	141		community health center that has been deemed by the
147	142		U.S. Department of Health and Human Services as a
148	143		federally qualified health center as defined by 42
149	144		U.S.C., Section 1396d (l)(2)(B),
150	145		b. a health provider who provides services to an
151	146		organization that has been deemed a federally
152	147		qualified look-alike community health cen ter, and
153	148		c. a health care provider who provides services to a
154	149		community health center that has made applicati on to
155	150		the U.S. Department of Health and Human Services for
156	151		approval and deeming as a federally qualified look-
157	152		alike community health center in comp liance with
158	153		federal application guidance, and has received
159	154		comments from the U.S. Department of Health and Hu man
160	155		Services as to the status of such application with the
161	156		established intent of resubmitting a modified
162	157		application, or, if denied, a new applicat ion, no
163	158		later than six (6) months from the date of the
164	159		official notification from the U.S. Department of

193	187		new application;
194	188		7. "Employee" means any person who is authorized to act in
195	189		behalf of a politica l subdivision or the state whether that person
196	190		is acting on a permanent or temporary basis, with or without b eing
197	191		compensated or on a full-time or part-time basis.
198	192		a. Employee also includes:
199	193		(1) all elected or appointed officers, members of
200	194		governing bodies and other persons designated to
201	195		act for an agency or political subdivision, but
202	196		the term does not mean a pe rson or other legal
203	197		entity while acting in the capacity of an
204	198		independent contractor or an employee of an
205	199		independent contractor,
206	200		(2) from September 1, 1991, through June 30, 1996,
207	201		licensed physicians, licensed osteopathic
208	202		physicians and certified nurse -midwives providing
209	203		prenatal, delivery or infant care services to
210	204		State Department of Health clients pursuan t to a
211	205		contract entered into with the Stat e Department
212	206		of Health in accordance with paragraph 3 of
213	207		subsection B of Section 1 -106 of Title 63 of the
214	208		Oklahoma Statutes but only insofar as services
215	209		authorized by and in conform ity with the terms of

244	237		233 of Title 63 of the Oklahoma Statutes, and
245	238		(3) any volunteer, full-time or part-time firefighter
246	239		when performing duties for a fire department
247	240		provided for in subparagraph j of paragrap h 11 of
248	241		this section.
249	242		b. For the purpose of The Governmental Tort Claims Ac t,
250	243		the following are employees of this state, regardless
251	244		of the place in this state where duties as employees
252	245		are performed:
253	246		(1) physicians acting in an administrative capacity,
254	247		(2) resident physicians and resident interns
255	248		participating in a graduate medic al education
256	249		program of the University of Oklahoma Health
257	250		Sciences Center, the College of Osteopathic
258	251		Medicine of Oklahoma State University, or the
259	252		Department of Mental Health and S ubstance Abuse
260	253		Services,
261	254		(3) faculty members and staff of the University of
262	255		Oklahoma Health Sciences Center and the College
263	256		of Osteopathic Medicine of Oklahoma State
264	257		University, while engaged in teaching duties,

293	285		administrative capacity as an employee of an
294	286		agency of the State of O klahoma,
295	287		(5) physicians who provide medical care to inmates
296	288		pursuant to a contract with the Department of
297	289		Corrections,
298	290		(6) any person who is licensed to practice medicine
299	291		pursuant to Title 59 of the Oklahoma Statut es,
300	292		who is under an administrative profess ional
301	293		services contract with the Oklahoma Health Care
302	294		Authority under the auspices of the Oklahoma
303	295		Health Care Authority Chief Medical Officer, and
304	296		who is limited to performing admi nistrative
305	297		duties such as profess ional guidance for medical
306	298		reviews, reimbursement rates, service
307	299		utilization, health care delivery and benefit
308	300		design for the Oklahoma Health Care Auth ority,
309	301		only while acting within the scope of such
310	302		contract,
311	303		(7) licensed medical professionals under cont ract
312	304		with city, county, or state entities who provide
313	305		medical care to inmates or detainees in the
314	306		custody or control of law enforcement agencies,

342	333		(8) licensed mental health professionals as defined
343	334		in Sections 1-103 and 5-502 of Title 43A of the
344	335		Oklahoma Statutes, who are conducting initial
345	336		examinations of individuals for the purpose of
346	337		determining whether an individual meets the
347	338		criteria for emergency d etention as part of a
348	339		contract with the Department of Mental Health and
349	340		Substance Abuse Services, and
350	341		(9) licensed mental health professionals as d efined
351	342		in Sections 1-103 and 5-502 of Title 43A of the
352	343		Oklahoma Statutes, who are providing mental
353	344		health or substance abuse treatment services
354	345		under a professional services contrac t with the
355	346		Department of Mental H ealth and Substance Abuse
356	347		Services and are providing such treatment
357	348		services at a state-operated facility.
358	349		Physician faculty members and physician staff of the
359	350		University of Oklahoma Health Sciences Center and the
360	351		College of Osteopathic Medicine of Oklahom a State
361	352		University not acting in an admini strative capacity or
362	353		engaged in teaching duties are not employees or agents
363	354		of the state.
364	355		c. Except as provided in subparagraph b o f this
365	356		paragraph, in no event shall the state be h eld liable

393	383		for the tortious condu ct of any physician, resident
394	384		physician or intern while practicing medicine or
395	385		providing medical treatment to patients;
396	386		8. "Loss" means death or injur y to the body or right s of a
397	387		person or damage to real or personal proper ty or rights therein;
398	388		9. "Medically indigent" means a person requiring med ically
399	389		necessary hospital or other health care services for the person or
400	390		the dependents of the person who ha s no public or private third-
401	391		party coverage, and whose personal resource s are insufficient to
402	392		provide for needed health care;
403	393		10. "Municipality" means any incorporated city or town, and all
404	394		institutions, agencies or instrumentalities of a municipality;
405	395		11. "Political subdivision" means:
406	396		a. a municipality,
407	397		b. a school district, including, but not limited to, a
408	398		technology center school district estab lished pursuant
409	399		to Section 4410, 4411, 4420 or 4420.1 of Title 70 of
410	400		the Oklahoma Statutes,
411	401		c. a county,
412	402		d. a public trust where th e sole beneficiary or
413	403		beneficiaries are a city, to wn, school district or
414	404		county. For purposes of The Governmental Tort Claim s
415	405		Act, a public trust shall include:

443	432		(1) a municipal hospital created pursuant to Sections
444	433		30-101 through 30-109 of Title 11 of the Oklahoma
445	434		Statutes, a county hospital created purs uant to
446	435		Sections 781 through 796 of Title 19 of the
447	436		Oklahoma Statutes, or i s created pursuant to a
448	437		joint agreement between such governing
449	438		authorities, that is operated for the public
450	439		benefit by a public tru st created pursuant to
451	440		Sections 176 through 180.4 of Title 60 of the
452	441		Oklahoma Statutes and managed by a governing
453	442		board appointed or elected by the municipality,
454	443		county, or both, who exercises control of the
455	444		hospital, subject to the a pproval of the
456	445		governing body of the municipality, county, or
457	446		both,
458	447		(2) a public trust created pursuant t o Sections 176
459	448		through 180.4 of Title 60 o f the Oklahoma
460	449		Statutes after January 1, 2009, the primary
461	450		purpose of which is to own, manage, or operate a
462	451		public acute care hospi tal in this state that
463	452		serves as a teaching hospit al for a medical
464	453		residency program provided by a college of
465	454		osteopathic medicine and provides care to
466	455		indigent persons, and
467	456

499	487		only, a housing authority created pursuant to the
500	488		provisions of the Oklahoma Housing Authority Act,
501	489		f. for the purposes of T he Governmental Tort Claims Act
502	490		only, corporations organized not for profit pursuan t
503	491		to the provisions of the Oklahoma Genera l Corporation
504	492		Act for the primary purpose of developing and
505	493		providing rural water supply and sewage disposal
506	494		facilities to serve ru ral residents,
507	495		g. for the purposes of The Governme ntal Tort Claims Act
508	496		only, districts formed pursuant to the Rural Water,
509	497		Sewer, Gas and Solid Waste Management Districts Act,
510	498		h. for the purposes of The Governmental Tort Claims Act
511	499		only, master conservancy districts formed pursuant to
512	500		the Conservancy Act of Oklahoma,
513	501		i. for the purposes of The Governmental Tort Claims Act
514	502		only, a fire protection district created pursuant to
515	503		the provisions of Section 901.1 et seq. of Title 19 of
516	504		the Oklahoma Statutes,

610	596		Section 687.1 of Title 69 of the Oklahoma Statutes,

612	598		s. for purposes of The Governmental Tort Claims Act only,
613	599		a regional transportati on authority created p ursuant
614	600		to Section 1370.7 of Title 68 of the Oklah oma Statutes
615	601		including its contra ct operator and any railroad
616	602		operating in interstate commerce that sells a property
617	603		interest or provides services to a regional
618	604		transportation authorit y or allows the author ity to

646	631		use the property or tracks of the railroad for the
647	632		provision of public passe nger rail service to the
648	633		extent claims against the contract operator or
649	634		railroad arise out of or are related to or in
650	635		connection with such property int erest, services or
651	636		operation of the public passenger rail service.
652	637		Provided, the acquisition of commerci al liability
653	638		insurance to cover the activi ties of the regional
654	639		transportation authority, contract operator or
655	640		railroad shall not operate as a waiver of any
656	641		liabilities, immunities or defenses provided pursuant
657	642		to the provisions of The Governmental Tort Cla ims Act,
658	643		and all their institutions, instr umentalities or agencies;
659	644		12. "Scope of employment" means performance by an employee
660	645		acting in good faith wi thin the duties of the employee's office or
661	646		employment or of tasks lawfu lly assigned by a competent autho rity
662	647		including the operation or use of an agency vehicle or equipment
663	648		with actual or implied consent of the supervisor of the employee,
664	649		but shall not include corruption or f raud;
665	650		13. "State" means the State of Oklahoma or any office,
666	651		department, agency, a uthority, commission, board, institution,
667	652		hospital, college, university, public trust created pursuant to
668	653		Title 60 of the Oklahoma Statutes of which th e State of Oklahoma is
669	654		the beneficiary, or other instrumentality thereof ; and

697	681		14. "Tort" means a legal wrong, independent of contract,
698	682		involving violation of a duty imposed by general law, statute, the
699	683		Constitution of the State of Oklahoma, or otherwise, resulting in a
700	684		loss to any person, association or corporation as the pro ximate
701	685		result of an act or omissi on of a political subdivision or the state
702	686		or an employee acting within the scope of employment.
703	687		SECTION 2. This act shall become effe ctive November 1, 2022.
