4040 An Act relating to higher education; enacting the
4141 Hunger-free Campus Act; providing short title;
4242 defining terms; requiring the Oklahoma State Regents
4343 for Higher Education to administer the Hunger-free
4444 Campus Grant Pilot Program, develop a certain form,
4545 and designate certain campuses at certain public
4646 institutions of highe r education as hunger–free
4747 campuses using certain criteria ; authorizing certain
4848 public institutions of higher education to develop
4949 procedures; requiring certain public institutions of
5050 higher education to make certain information publicly
5151 available; requiring the Oklahoma State Regents for
5252 Higher Education to allocate grant fund ing for
5353 certain public institutions of higher education;
5454 requiring the Oklahoma State Regents for Higher
5555 Education to determine the amount of grant funding to
5656 each eligible public institution of higher education;
5757 requiring the Oklahoma State Regents for Higher
5858 Education to include a strategic plan; requiring the

9797 SECTION 1. NEW LAW A new section of la w to be codified
9898 in the Oklahoma Statutes as Section 2501 of Title 70, unless there
9999 is created a duplication in numbering, reads as follows:
100100 This act shall be known and may be cited as the "Hunger-free
101101 Campus Act".
102102 SECTION 2. NEW LAW A new section of law to be codifi ed
103103 in the Oklahoma Statut es as Section 2502 of Title 70, unless there
104104 is created a duplication in numberin g, reads as follows:
105105 As used in the Hunger-free Campus Act:
106106 1. "Emergency assistance" means immediate direct assist ance
107107 provided by a hunger –free campus to any student facing an
108108 unanticipated financial crisis or hardship ;
109109 2. "Hunger–free campus" means a campus of any four–year public
110110 institution of higher education that meets the requirements of
111111 subsection A of Section 4 of this act or any two–year public
112112 institution of highe r education that meets the requirements of
113113 subsection B of Section 4 of this act; and
114114 3. "Program" means the Hunger–free Campus Grant Program.
115115 SECTION 3. NEW LAW A new sect ion of law to be codified
116116 in the Oklahoma Statutes as Secti on 2503 of Title 70, unless there

118118 The Oklahoma State Regents for Higher Education shall administer
119119 the Hunger-free Campus Grant Program and shall develop the form to

148148 SECTION 4. NEW LAW A new section of law to b e codified
149149 in the Oklahoma Statutes as Secti on 2504 of Title 70, unless there
150150 is created a duplication in numbering, rea ds as follows:
151151 A. The Oklahoma State Regents for Higher Education shall
152152 designate as a hunger –free campus any campus of a four–year public
153153 institution of higher education that:
154154 1. Has established a hunger task force that :
155155 a. meets at least two times per academic year, and
156156 b. sets at least two goals with action plans ;
157157 2. Has a designated a staff member re sponsible for:
158158 a. assisting students in enrolli ng in the Supplemental
159159 Nutrition Assistance Program, or
160160 b. connecting students with available Supplemental
161161 Nutrition Assistance Program outreach partners that
162162 can assist students in enrolling in the Supplemental
163163 Nutrition Assistance Program;
164164 3. Has designated a staff member responsible for informing
165165 students participating in the Federal Work–Study Program regarding
166166 eligibility for the Supplemental Nutrition Assistance Program;
167167 4. Facilitates collaboration with campus retailers to provide
168168 options for students to utilize Supplemental Nutrition Assistance
169169 Program benefits at campus retailers;

196196 5. Provides students with information on the names and
197197 locations of off–campus retailers that accept Supplemental Nutrition
198198 Assistance Program benefits;
199199 6. Participates in an awareness day campa ign activity and
200200 complete at least one campus awa reness event during Hunger Action
201201 Month in September;
202202 7. Provides at least one food pantry on campus or enables
203203 students in need to receive food through a separate , stigma–free
204204 arrangement;
205205 8. Facilitates efforts between campus administrators and food
206206 service operations or vendors to develop and maintain a meal–sharing
207207 program that allows students to donate their unused meal plan
208208 credits to be distributed to students in need for use in campus
209209 dining halls or at an on–campus food pantry, if applicable;
210210 9. Conducts a standardized ann ual student survey on hunger and
211211 submits the results to the Oklahoma State Regents for Higher
212212 Education; and
213213 10. Submits an annual report detailing its efforts to address
214214 student hunger to the Oklahoma State Regents for Higher Education.
215215 B. The Oklahoma State Regents for Higher Education shall
216216 designate as a hunger –free campus any campus of a two–year public
217217 institution of higher education that meets all the requirements for
218218 four–year public institutions of higher education identified in

245245 subsection A of this section, with the exception of the requirements
246246 in paragraphs 4 and 7 of subsection A of this section.
247247 C. 1. Each public institution of higher educ ation may develop
248248 its own procedures for a meal –sharing program.
249249 2. Each public institution of higher education shall make
250250 information about the meal–sharing program publicl y available,
251251 including:
252252 a. how a student may donate unused meal plan credits,
253253 b. how a student in need may apply to receive donated
254254 meal plan credits, and
255255 c. the methodology that a n institution of higher
256256 education uses to ensure that unused donated meal plan
257257 credits are used to purchase food to support an on –
258258 campus food pantry, if applicable.
259259 SECTION 5. NEW LAW A new section of law to be codified
260260 in the Oklahoma Statutes as Section 2505 of Title 70, unless there
261261 is created a duplication in numbering, reads as follows:
262262 A. The Oklahoma State Regents for Higher Education shall
263263 allocate grant funding, as available through state appropriations,
264264 to any four–year or two–year public institution of higher education
265265 that:
266266 1. Pledges a matching contribution to be used to implement the
267267 goals of the program; and

294294 2. Meets the requirements to be designated as a hunger –free
295295 campus.
296296 B. The Oklahoma State Regents for Higher Education shall
297297 determine the amount of each institutional grant based on available
298298 funding and may retain grant funds for administrative costs at or
299299 below the allowable annual indirect cost rate negotiated by the
300300 State Regents with the U.S. Department of Educati on.
301301 C. The Oklahoma State Regents for Higher Education shall
302302 develop a strategic plan starting when this act becomes effective to
303303 address meeting the basic needs of higher education students by
304304 2030.
305305 D. 1. The Oklahoma State Regents for Higher Education shall
306306 have six (6) months after receiving appropriation to develop the
307307 process for selecting institutions for the pilot program as well as
308308 the metrics that will be tracked from August 2023 through May 2028.
309309 2. The Oklahoma State Re gents for Higher Educat ion must select
310310 institutions for pilot participation and award funds no later than
311311 June 2023. Participating institutions must submit data metrics
312312 outlined by the Oklahoma State Regents for Higher Education and this
313313 act no later than the first day of August of each year.
314314 E. 1. The Oklahoma State Regents fo r Higher Education shall
315315 adopt regulations necessary to carry out the requirement s of this
316316 act.

343343 2. The regulations adopted under this subsection shall allow
344344 grant recipients to use grant funds fle xibly to implement the goals
345345 of the program, including giving recipients the ability to :
346346 a. support emergency assistance ,
347347 b. hire staff to manage initiatives related to the
348348 program, and
349349 c. use grant funds for ope rational activities related to
350350 the program.
351351 SECTION 6. NEW LAW A new section of law to be codified
352352 in the Oklahoma Statutes as Section 2506 of Title 70, unless there
353353 is created a duplication in numbering, reads as follows:
354354 A. Not later than five (5) years after establishing the
355355 program, the Oklahoma State Regents for Higher Education shall
356356 provide a written report to the Governor and the Legislature on the
357357 implementation of this act.
358358 B. The report shall include:
359359 1. The number and amounts of grants awarded;
360360 2. The impact of the program on establishing hunger-free
361361 campuses at public institutions of higher education ;
362362 3. The impact of awarded grants on reducing the number of
363363 students experiencing food insecurity; and
364364 4. Recommendations on expanding the program.
365365 SECTION 7. This act shall be come effective July 1, 2022.

392392 SECTION 8. It being immediately necessary for the preservation
393393 of the public peace, health or safety, an emergency is hereby
394394 declared to exist, by reason whereof thi s act shall take eff ect and
395395 be in full force from and after its passage a nd approval.
