40	40	An Act relating to municipal courts; authorizing
41	41	contracts for the collection of outstanding fines and
42	42	fees; authorizing contractors to collect fines and
43	43	fees; permitting payment in lieu of court appearance ;
44	44	directing that court shall re lease fine or fee upon
45	45	receipt of all sums due ; directing that the
46	46	provisions of contract be administered by a statewide
47	47	association of municipal government s; providing for
48	48	codification; and provi ding an effective date .

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 27-133 of Title 11, unless there
57	57	is created a duplication in numbering, reads as follows:
58	58	A. Unless otherwise provided in any other section of law, the
59	59	municipal court of any Oklahoma municipality may contract with a
60	60	statewide association of municipal governments to administer
61	61	contracts with third parties attempting to locate and notify persons
62	62	of their outstanding fines and fees. Municipalities contracting

90	90	administration of third -party contracts may assign thei r rights and
91	91	duties regarding these cont racts to the association.
92	92	B. A person may make payment directly to the municipal court,
93	93	as allowed by law, or the contractor shall be authorized to accept
94	94	payment on fines or fees by various means including, but not limited
95	95	to, payment by phone, mail, or Internet, and in any payment form
96	96	including, but not limited to, personal, cashier 's, traveler's,
97	97	certified, or guaranteed bank check, postal or commercial money
98	98	order, nationally recognized credit or debit card, or other
99	99	generally accepted payment form. Any payment collected and received
100	100	by the contractor shall be paid within fifteen (15) days to the
101	101	court clerk of the municipal court that issued the fine or fee.
102	102	C. As provided for by this act, a person may pay the fine or
103	103	fee in lieu of appearance befor e the court. Such payment accepted
104	104	by the court shall constitute a finding of guilty as though a plea
105	105	of nolo contendere h ad been entered by the defendant as allowed by
106	106	law and shall function as a written, dated, an d signed plea form
107	107	acceptable to the cou rt. Such payment shall serve as a written
108	108	waiver of a jury trial.
109	109	D. The court shall release the fine or fee upon receipt of all
110	110	sums due; or upon failure to pay, the court may take action under
111	111	Section 27-122 of Title 11 of the Oklahoma Statutes .

138	138	E. The provisions of any contract entered into by a municipal
139	139	court shall be administered by a statewide association o f municipal
140	140	governments in Oklahoma.
141	141	SECTION 2. This act shall become effective November 1, 2022.
