6262 BE IT ENACTED BY THE PEOPLE OF THE S TATE OF OKLAHOMA:
6363 SECTION 1. AMENDATORY 47 O.S. 20 21, Section 2-106.1, is
6464 amended to read as follows:
6565 Section 2-106.1 Subject to the Merit System laws, the
6666 Commissioner of Public Safety is hereby auth orized to employ a
6767 supervisor of permit clerks, headquarters permit clerks and

9595 and/or overweight permits in accordance with the terms of Chapter 14
9696 of this title and to collect the fees th erefor and to remit the same
9797 to the Oklahoma Tax Commission All the powers, duties, functions,
9898 records, employees, proper ty, matters pending, funds, and
9999 responsibilities of the Size and Weight Permits Division of the
100100 Department of Public Safety are hereby transferred to the Department
101101 of Transportation effective July 1, 2022. An accurate, cu rrent
102102 inventory of all properties shall be maintained by the Department of
103103 Transportation.
104104 SECTION 2. AMENDATORY 47 O.S. 20 21, Section 14-101, is
105105 amended to read as foll ows:
106106 Section 14-101. A. It is a misdemeanor for any person to drive
107107 or move or for the owner to cause or knowingly permit to be dr iven
108108 or moved on any highway any vehicle or vehicles of a size or weight
109109 exceeding the limitation s stated in this chapter or otherwise in
110110 violation of this chapte r, and the maximum size and weight of
111111 vehicles herein specified shall be lawful throughout thi s state and
112112 local authorities shall have no power or authority to alter the
113113 limitations except as express authority may be g ranted in this
114114 chapter.
115115 B. The Commissioner of Public Safety Executive Director of the
116116 Department of Transportati on is directed to issue annual overweight
117117 permits to:

144144 1. Municipalities and rural fire districts for the
145145 transportation of firefighting appar atus at no cost to the
146146 municipalities or rural fire districts;
147147 2. Owners of implements of husbandry, which includ es tractors
148148 that are temporarily moved upon a highway at no cost to the owner;
149149 3. Retail implement dealers while hauling implements of
150150 husbandry at no cost to the dealer; and
151151 4. Owners of certain vehicles as provided for in Section 14 -
152152 103G of this title.
153153 C. If a vehicle is issued a license pursua nt to Section 1134.4
154154 of this title, the license shall also serve as the overweight permit
155155 required by this section.
156156 D. All size, weight and load provisions cover ed by this chapter
157157 shall be subject to the limitat ions imposed by Title 23, United
158158 States Code, Section 127, and such other rules and regulations
159159 developed herein. Provided further that any s ize and weight
160160 provision authorized by the United States Congres s for use on the
161161 National System of Interstate and Defense Highways, including, but
162162 not limited to, height, axle weight, gross weight, combinations of
163163 vehicles or load thereon shall be authori zed for immediate use on
164164 such segments of the National System of I nterstate and Defense
165165 Highways and any other highw ays or portions thereof as designated by
166166 the Transportation Commiss ion or their duly authorized

194194 E. All size, weight and loa d provisions covered by Sections 14-
195195 101 through 14-123 of this title shall be subject to a gross vehicle
196196 weight limit of ninety thousand (90,000) pounds when ap plied to a
197197 vehicle operating off the National System of Interstate and Defense
198198 Highways unless such vehicle is operating in full compliance with an
199199 overweight permit issued by the Commissioner of Public Safety
200200 Executive Director of the Department of Transportation.
201201 F. Any vehicle permitted for movement on the highways of this
202202 state as provided in Section 14-101 et seq. of this title, other
203203 than a vehicle permitted solely for overweight mov ement, shall be
204204 moved only during daylight hours. As used in Section 14 -101 et seq.
205205 of this title, "daylight hours" shall mean one-half (1/2) hour
206206 before sunrise to one-half (1/2) hour after sunset. The
207207 Commissioner of Public Safety Executive Director of the Department
208208 of Transportation, for good cause and consistent with the sa fe
209209 movement of the vehicle, may endorse a pe rmit for the movement of an
210210 oversize vehicle to authorize night time nighttime travel under such
211211 terms and restrictions as the Commissioner Executive Director of the
212212 Department of Transportation may require.
213213 G. 1. Any vehicle permitted for movement on the highways of
214214 this state as provided in Section 14-101 et seq. of this title shall
215215 not be moved at any time on the following holidays:
216216 a. New Year’s Day (January 1),
217217 b. Memorial Day (the last Monday in May),

250250 state as provided in Section 14 -101 et seq. of this title shall be

252252 a. Martin Luther King, Jr.’s Birthday (the third Monday
253253 in January),
254254 b. President’s Day, also known as Washi ngton’s Birthday
255255 (the third Monday in February), and
256256 c. Veteran’s Day (November 11).
257257 SECTION 3. AMENDATORY 47 O.S. 2021, Section 14-103, is
258258 amended to read as fol lows:
259259 Section 14-103. A. Except as otherwise provided f or by this
260260 chapter, no vehicle, with or without load, shall have a total
261261 outside width in excess of one hundred two (102) inches excluding:
262262 1. Tire bulge;
263263 2. Approved safety devices;
264264 3. A retracted awning with a width of eight (8) inches or less
265265 or other appurtenance of four (4) inches or less which is att ached
266266 to the side of a recreatio nal vehicle, as defined in Section 1102 of
267267 this title; and

294294 4. Pins used as a safety precaution or as a load -assisting
295295 device if the pins do not extend the overall width of the vehicle
296296 beyond nine (9) feet. The State of Okl ahoma hereby declares it has
297297 determined, in accordance with 23 C.F.R., Section 658.15, that such
298298 pins are necessary for the safe and efficient op eration of motor
299299 vehicles.
300300 The provisions of this subsect ion shall not apply to any person
301301 engaged in the hauli ng of round baled hay with a tot al outside width
302302 of eleven (11) feet or less when the hay is owned by such person and
303303 is being hauled for any pur pose other than resale. The provisions
304304 of this subsection shall also not apply to any county official or
305305 employee engaged in the hauling or pu lling of a trailer or equipment
306306 owned by the county on the county roa ds of such county.
307307 B. Except as otherwise p rovided for by this chapter:
308308 1. No vehicle, with or with out load, shall exceed a height of
309309 thirteen and one-half (13 1/2) feet on any county r oad, or fourteen
310310 (14) feet on any turnpike, interstate, U.S. or state highway, unless
311311 a greater height is authori zed by a special permit issued by the
312312 Commissioner of Public Safety Executive Director of the Department
313313 of Transportation or an authorized representative of the
314314 Commissioner in consultation with the Department of Transportation
315315 specifying the highways to be used, c onsistent with public
316316 convenience and safety. The prohibitions on moveme nt as prescribed
317317 in subsection F of Section 14 -101 of this title and paragraph 1 of

344344 subsection G of Section 14-101 of this title shall not apply to
345345 vehicles operated pursuant to such permits;
346346 2. An official state bridge vertical clearance map providing
347347 clearance heights as posted for bridges on the interstat e, U.S. and
348348 state highway system s shall be available on the Oklahoma Department
349349 of Transportation website; and
350350 3. Operators and owners of vehicles which exceed or have loads
351351 which exceed thirteen and o ne-half (13 1/2) feet shall be held
352352 liable for all damages to any part of structures s panning the
353353 highway or damages suffered by other affected parties caused by the
354354 vehicle or load exceeding the posted height;.
355355 C. Except as otherwise provided for by this chapter:
356356 1. No single truck, with or without load, sh all have an overall
357357 length, inclusive of front and rear bumpers, in excess of forty-five
358358 (45) feet;
359359 2. No single bus, with or w ithout load, shall have an overall
360360 length, inclusive of front and rear bum pers, in excess of forty-five
361361 (45) feet;
362362 3. a. On the National Network of Highways wh ich includes the
363363 National System of Interstate and Defense Highways and
364364 four-lane divided Federal Aid Primary System Highways,
365365 no semitrailer operating in a truck -
366366 tractor/semitrailer combination shall have a length
367367 greater than fifty-three (53) feet, excep t as provided

394394 in subsection C of Section 14-118 of this title which
395395 shall apply to semitrailers e xceeding fifty-three (53)
396396 feet but not exceeding fifty-nine (59) feet six (6)
397397 inches. On the National System of Interstate and
398398 Defense Highways and four -lane divided Federal Aid
399399 Primary System Highways, no semitrailer or trailer
400400 operating in a truck -tractor/semitrailer and trailer
401401 combination shall have a length greater than fi fty-
402402 three (53) feet;
403403 b. On roads and highways not a pa rt of the National
404404 System of Interstate and Defense Highways or four-lane
405405 divided Federal Aid Primary System Highways, no
406406 semitrailer operating in a truck-tractor/semitrailer
407407 combination shall have a le ngth greater than fifty-
408408 three (53) feet and no semitra iler or trailer
409409 operating in a truck-tractor/semitrailer and trailer
410410 combination shall have a length greater than twenty -
411411 nine (29) feet. Except as provided for in subsection
412412 D of Section 14-118 of this title, no other
413413 combination of vehicles shall have an overall length,
414414 inclusive of front and rear bumpers, in excess of
415415 seventy (70) feet on all roads and highways. For the
416416 purposes of this paragraph, oil field rig-up trucks

443443 shall be considered to be tru ck-tractors, when towing
444444 a trailer or semitrailer;
445445 c. On the National Network of High ways the overall length
446446 limitation of a towaway trailer transporter
447447 combination may exceed length restrictions up to
448448 eighty-two (82) feet;
449449 d. As used in this section:
450450 (1) The term "trailer transporter towing unit " shall
451451 mean a power unit that is not used t o carry
452452 property when operating in a towaway trailer
453453 transporter combination, and
454454 (2) The term "towaway trailer transporter
455455 combination" shall mean a combination of vehicl es
456456 consisting of a trailer transporter towing unit
457457 and two (2) trailers or semitraile rs with a total
458458 weight that does not exceed twenty-six thousand
459459 (26,000) pounds; and in which the trailers or
460460 semitrailers carry no property and constitute
461461 inventory property of a manufacturer, distributor
462462 or dealer of such trailers or semitrailers;
463463 4. No combination of vehicles shall consist of more than two
464464 units, except:

491491 a. one truck and semitrail er or truck-tractor/semitrailer
492492 combination may tow one complete trailer o r
493493 semitrailer, or
494494 b. vans, suburbans, blazers or other similar types of
495495 vehicles and self-propelled recreational vehicles with
496496 a three-quarter (3/4) ton or more rated capacity may
497497 tow a semitrailer and one complete trailer or
498498 semitrailer for recreational p urposes only, provided
499499 the overall length, inclusive o f the front and rear
500500 bumpers, does not exceed sixty-five (65) feet;
501501 5. Poles and gas lines used to maintain public utility
502502 services, not to include new construction, may be moved during
503503 daylight hours, and during nighttime hours only in an emergency,
504504 subject to traffic and road restric tions promulgated by the
505505 Commissioner of Public Safety Executive Director of the Department
506506 of Transportation, when the overall length does not ex ceed eighty
507507 (80) feet. When this length is exceede d, these loads are subject to
508508 the requirements of Sect ion 14-118 of this title;
509509 6. For the purposes of paragraphs 1, 3, and 4 of this
510510 subsection, the length of uniti zed equipment, which is defined to be
511511 equipment so constructed and attached to a rubber -tired vehicle that
512512 the vehicle and load become a unit an d are for all practic al
513513 purposes inseparable, shall be the length of the vehicle itself, and
514514 shall not include any protrusion of the equipment load so

541541 constructed or attached. The equipment shall not p rotrude for a
542542 distance greater than two -thirds (2/3) of the wheel base of t he
543543 vehicle, shall not impair the driver’s vision, and if less than
544544 seven (7) feet above the roadway, shall be safely marked, flagg ed or
545545 illuminated. Any such protruding structure s hall be securely held
546546 in place to prevent dropping or swaying. Unitized eq uipment shall
547547 carry such safety equipment as shall be determined to be necessary
548548 for the safety, health, and welfare of the drivin g public by the
549549 Commissioner of Public Safety Executive Director of the Department
550550 of Transportation;
551551 7. For the purposes of paragraphs 1, 3, and 4 of this
552552 subsection, a truck-tractor, when being towed by another vehicle
553553 with the wheels of its steering axle raised off the roadway, shall
554554 be considered to be a semitrailer as defined in Section 1-162 of
555555 this title;
556556 8. The provisions of paragraphs 1 and 3 of this subsection
557557 shall not apply to any contractor or subcontractor, or ag ents or
558558 employees of any contractor or subcontractor, w hile engaged in
559559 transporting material to the site of a project being constructed by,
560560 for, or on behalf of this state or any city, town, county, or
561561 subdivision of this state; and
562562 9. Special mobilized m achinery, as defined in Section 1102 of
563563 this title, which exceeds the size provisions of this secti on shall
564564 only use the highways of the State of Oklahoma this state by special

591591 permit issued by the Commissioner of Public Safety Executive
592592 Director of the Department of Transportation or an authorized
593593 representative of the Commissioner Executive Director of the
594594 Department of Transportation. Such special permit shall be:
595595 a. a single-trip permit issued under the provisions of
596596 Section 14-116 of this title, or
597597 b. a special annual oversize permit issued for one (1)
598598 calendar year period upon payment of a fee of Ten
599599 Dollars ($10.00) plus any amoun t as provided by
600600 subsection H of Section 14-118 of this title.
601601 SECTION 4. AMENDATORY 47 O.S. 2021, Section 14-103C, is
602602 amended to read as follows:
603603 Section 14-103C. A. The Commissioner of Public Safety
604604 Executive Director of the Department of Transportation shall upon
605605 proper application issue a special permit to any person allowing the
606606 movement on state and feder al highways of a structure in the form of
607607 a house or building, including, but not limited to, industrialized
608608 housing as defined described in Section 14-103A of this title, not
609609 exceeding thirty-two (32) feet in width at the base, and thirty -four
610610 (34) feet in width at t he top and twenty-one (21) feet in height.
611611 The permit shall specify the highways to be used, consistent with
612612 public convenience and safety, as determined by the Commissioner of
613613 Public Safety, in consultation with the Executive Director of the
614614 Department of Transportation. In addition to the prohibitions on

641641 movement as prescribed in Section 14-101 et seq. of this title, such
642642 structures shall not be moved on Saturday or Sunday.
643643 B. If any structure or housing described in subsection A of
644644 this section has a width in excess of sixteen (16) feet, the towing
645645 vehicle shall be a tandem-axle vehicle of no less than two hundred
646646 twenty (220) horsepower.
647647 SECTION 5. AMENDATORY 47 O.S. 2021, Section 14-103D, is
648648 amended to read as follows:
649649 Section 14-103D. A. No person shall transport or move a
650650 manufactured home on any public road or highway in thi s state,
651651 except as otherwise provided by law, with out a permit issued
652652 pursuant to the provisions of Sections 14-103A and 14-103C of this
653653 title and subsection B of this section, and without a current
654654 calendar year decal or current reg istration or a reposses sion
655655 affidavit issued pursuant to Sections 1110 an d 1126 of this title.
656656 B. In addition to the permit information required by the
657657 provisions of Sections 14-103A and 14-103C of this title, the permit
658658 shall also include the following:
659659 1. The name of the own er of the manufactured home;
660660 2. The serial number or identification number of the
661661 manufactured home;
662662 3. A legal description or the physical address of the location
663663 from which the manufactured home is to b e moved;

690690 4. A legal description or the physical a ddress of the location
691691 to which the manufactured h ome is to be moved; and
692692 5. The name of the firm or individual repossessing the
693693 manufactured home as it appears on the reposse ssion affidavit, if
694694 the movement is for repossession purp oses and the repossessi on
695695 affidavit is being u sed in lieu of current lice nse plate and decal,
696696 as provided in subsection E of Section 1113 of this title.
697697 C. Except as otherwise provided by law, the Executive Director
698698 of the Department of Public Safety Transportation shall not issue a
699699 permit to any person to transport or move a manufactured home
700700 without a current calend ar year decal or cur rent registration;
701701 provided:
702702 1. Upon proof of possession of a deal er or in-transit license
703703 plate, issued by the Oklahoma Tax Commission according to the
704704 provisions of subsection D of Section 11 28 of this title, the
705705 Department of Public Safety Transportation shall issue a permit to
706706 the holder of such license;
707707 2. The Executive Director of the Department of Transportation
708708 shall issue a permit to the holder of a perfected security interest
709709 in a manufactured home, or a licensed representative thereof,
710710 pursuant to a lawful repossession of the manufactured home, if the
711711 holder or representative is bonded by the state, to move the
712712 manufactured home to a sec ure location with a repossession
713713 affidavit; provided, all registration fees, excise taxes or ad

740740 valorem taxes due on such home shall be required to be paid within
741741 thirty (30) days of the issuanc e of the permit; and
742742 3. The Executive Director of the Department of Transportation
743743 shall issue a permit to tr ansport or move a manufacture d home used
744744 for commercial purposes during the second through the sixth day of
745745 the first month of the following calendar year if the applicant can
746746 provide a special waiver and a commercial move affida vit authorized
747747 pursuant to Section 2813 of Title 68 of t he Oklahoma Statutes. As
748748 used in this paragraph, "manufactured home used for commerc ial
749749 purposes" means a manufactured home owned by any lawfully recog nized
750750 business entity the primary purpose of whi ch is to provide temporary
751751 housing for the employees or contractors of such business entity.
752752 D. For the purposes of subs ections A and C of t his section, a
753753 manufactured home registration receipt and Manufactu red Home
754754 Registration Decal attached to a certif icate of title for a
755755 manufactured home or receipts and d ecal as authorized by subsection
756756 C of Section 1117 of this title shall be evidence of payment of the
757757 excise tax and registration fees required pursuant to the provisions
758758 of Section 1135 of this title and the Ad Valorem Tax Code.
759759 E. The Department of Public Safety Transportation shall notify
760760 the Oklahoma Tax Commission, the county assessor of the county from
761761 which the manufactured home is to be moved and the county assessor

805805 SECTION 7. AMENDATORY 47 O.S. 2021, Section 14-103G, is

807807 Section 14-103G. A. 1. The Department of Public Safety
808808 Transportation may issue an annual vehicle permit under the

856856 6. An annual vehicle per mit issued pursuant to this subsection
857857 shall be nontransferable between per mittees.
858858 7. The permitted vehicle or vehicle combination shall be
859859 registered in accordance with the provisions of Chapter 14 of this
860860 title for maximum weight.
861861 8. An annual vehicle permit issued pursuant to this subsection
862862 may be transferred from one vehi cle to another vehic le in the fleet

898898 b. the certificate of title to the permitted vehicle is
899899 transferred to someone other than the permittee, and

904904 9. A permit issued for loads specific to turbine blades, used
905905 for the purpose of wind generation, may exceed a length of one
906906 hundred ten (110) feet.
907907 B. 1. The Department of Public Safety Transportation may issue
908908 an annual vehicle permit under th is subsection to a specific motor
909909 carrier, for the movement of ov ersize or overweight loads that
910910 cannot reasonably be dismantled. An annual vehicle permit is sued
911911 under this subsection may be transferred from one vehicle to another
912912 vehicle in the fleet of the permittee provided:

997997 C. 1. The Department of Public Safety Transportation may issue
998998 an annual fleet permit under this subsection to an electric utility,
999999 regulated by the Corporation Commiss ion or a rural electric
10001000 cooperative solely for the movement of po les. An annual flee t
10011001 permit issued under this subsection may be used by any vehicle in
10021002 the fleet of the permittee provided that a certified copy of the
10031003 permit is carried in each vehicle that is being operated under the
10041004 terms of the permit.
10051005 2. Oversize loads operating under an annual permit issued
10061006 pursuant to this subsection shall not exceed:
10071007 a. twelve (12) feet in width,
10081008 b. fourteen (14) feet in height, or
10091009 c. fifty-five (55) feet in length.
10101010 3. The annual fee for an annual fleet permit issued pursuant to
10111011 this subsection shal l be Four Thousand Dollars ($4,000.00) and shall

10971097 D. 1. The Department of Public Safety Transportation shall
10981098 issue an annual vehicle permit under this subsection to a
10991099 transportation company or manufacturer of portable buildings solely
11001100 for the movement of oversize portable buildings for a s pecific
11011101 manufacturer of portable buildings. An annual vehicle pe rmit issued
11021102 under this subsection may not be transferred from one vehicle to
11031103 another vehicle in the fleet. The name of the manufacturer shall be
11041104 on the permit and on any portable building be ing moved. The
11051105 original certified permit shall be carried in the vehicle that is
11061106 being operated under the terms of the permit.
11071107 2. Oversize loads operating u nder an annual vehicle permit
11081108 issued pursuant to this subsection shall not exceed:
11091109 a. twelve (12) feet in width at the wall with no more
11101110 than a three-inch-eave overhang, or
11111111 b. fourteen (14) feet in height.

11491149 The annual vehicle permit shall not be duplicated. The annual
11501150 vehicle permit shall be replaced only if:
11511151 a. the permittee did not receive the original permit

11981198 SECTION 8. AMENDATORY 47 O.S. 2021, Section 14-109, is
11991199 amended to read as follo ws:
12001200 Section 14-109. A. On any road or highway:
12011201 1. No single axle weight shall exceed twenty thousand (20,000)
12021202 pounds; and
12031203 2. The total gross weight in pounds imposed thereon by a

12421242 exceeds the legal weight limits moving in interstate or intra state
12431243 commerce in excess of the legal load limits of this state.
12441244 D. 1. An annual special overload permit may be purchased for
12451245 vehicles transporting rock, sand, gravel, coal, flour, timber,
12461246 pulpwood, and chips in their natural state, oil field fluids, oil
12471247 field equipment or equipment us ed in oil and gas well drilling or
12481248 exploration, and vehicles transporting grain, fertilizer,
12491249 cottonseed, cotton, livestock, peanuts, canola, sunflower s,
12501250 soybeans, feed, any other raw agricultural products , and any other
12511251 unprocessed agricultural products, i f the following conditions are
12521252 met:
12531253 a. the vehicles are registered for the maximum allowable
12541254 rate,
12551255 b. the vehicles do not exceed five percent (5%) of the
12561256 gross limits set forth i n subsection A of this
12571257 section,
12581258 c. the vehicles do not exceed eight percent (8 %) of the
12591259 axle limits set forth in sub section A of this section,

12931293 for the maximum allowable rate and additionally shall purchase a
12941294 nontransferable annual special overload permit from the De partment
12951295 of Public Safety Transportation for a fee of Three Hundred Fifty
12961296 Dollars ($350.00). All monies collect ed shall be deposited to the
12971297 credit of the Highway Construction and Mainte nance Fund.
12981298 E. 1. Oversize or overweight vehicles used for specializ ed
12991299 transportation if the maximum weight does not exceed twenty-three
13001300 thousand (23,000) pounds on any single axle and:
13011301 a. is a dual lane trailer with dual lane a xles and the
13021302 width of the transport vehicle or trailer exc eeds
13031303 twelve (12) feet in width, or
13041304 b. the overall gross vehicle weight of a single trailer
13051305 meets or exceeds three hundred thousand (300,000)
13061306 pounds, originates or terminates at t he Tulsa Port of
13071307 Catoosa, and the trip is conf ined within a thirty-mile
13081308 radius of the Port.

13411341 F. Exceptions to this section will be:
13421342 1. Utility or refuse collection vehicles used by counties,
13431343 cities, or towns or by private companies contr acted by counties,
13441344 cities, or towns if the following conditions are me t:
13451345 a. calculation of weight for a utility or refuse
13461346 collection vehicle shall be "Gross Vehicle Weight ".
13471347 The "Gross Vehicle Weight" of a utility or refuse
13481348 collection vehicle may not exce ed the otherwise
13491349 applicable weight by more than fifteen percent (15%).
13501350 The weight on individual axles must not exceed the
13511351 manufacturer's component rating which includes axle,
13521352 suspension, wheels, rims, brakes , and tires as shown
13531353 on the vehicle certificatio n label or tag, and
13541354 b. utility or refuse collection vehicles operated under
13551355 these exceptions will not be allowed to operate on
13561356 interstate highways;
13571357 2. A combination of a wrecker or tow vehicle and another

13941394 National System of Interstat e and Defense Highways unles s it is a
13951395 covered heavy-duty tow and recovery vehicle that:
13961396 a. is transporting a disabled vehicle from the place
13971397 where the vehicle becam e disabled to the nearest
13981398 appropriate repair facility, and
13991399 b. has a gross vehicle weight tha t is equal to or exceeds
14001400 the gross vehicle weight of the disabled vehicle being
14011401 transported; and
14021402 4. On the interstate highway system a vehic le designed to be
14031403 used under emergency conditions to transport personnel and equipment
14041404 and to support the suppressi on of fires and mitigation o f other
14051405 hazardous situations with a vehicle we ight limit up to a maximum
14061406 gross vehicle weight of eighty -six thousand (86,000) pounds with

14421442 G. 1. Any vehicle utilizing an auxiliary power or idle
14431443 reduction technology unit in order to promote red uction of fuel use
14441444 and emissions because of engine idling shall be allowed an
14451445 additional four hundred (400) pounds t otal to the total gross weight
14461446 limits set by this section.
14471447 2. To be eligible for the except ion provided in this
14481448 subsection, the operator of the vehicle must obtain w ritten proof or
14491449 certification of the weight of the auxiliary power or idle reduction
14501450 technology unit and be able to demonstrate or certify that the idle
14511451 reduction technology is fully functional.
14521452 3. Written proof or certification of the weight of the
14531453 auxiliary power or idle reduction tec hnology unit must be available
14541454 to law enforcement officers if the vehicle is found in violation of
14551455 applicable weight laws. The additional weight allo wed cannot exceed
14561456 four hundred (400) pounds or t he actual proven or certif ied weight
14571457 of the unit, whicheve r is less.

14881488 wrecker or tow vehicle as described in paragraphs 1 and 2 of
14891489 subsection F of this section operating under exceptions shall
14901490 purchase an annual special overload permit from the Department of
14911491 Public Safety Transportation for One Hundred Dollars ($100.00). All
14921492 monies collected shall be deposited to the credi t of the Highway
14931493 Construction and Maintenance Fund.
14941494 SECTION 9. AMENDATORY 47 O.S. 2021, Section 14-116, is
14951495 amended to read as follows :
14961496 Section 14-116. A. The Commissioner of Public Safety Executive
14971497 Director of the Department of Transportation shall charge a minimum
14981498 permit fee of Forty Dollars ($40.00) fo r any permit issued pursuant
14991499 to the provisions of Section 14 -101 et seq. of this title. In
15001500 addition to the permit fee, the Commissioner Executive Director of
15011501 the Department of Transportation shall charge a fee of Ten Dollars
15021502 ($10.00) for each thousand pounds in excess of the legal load limit.
15031503 The Commissioner of Public Safety Executive Director of the
15041504 Department of Transportation shall establish any necessary rules fo r
15051505 collecting the fees.
15061506 B. The Department of Public Safety Transportation is authorized
15071507 to establish an escrow account system for the payment of permit

15351535 requirements may participate in the escrow a ccount system for
15361536 permits purchased fro m all size and weight permit offices in this
15371537 state. Carriers not choosing to participate in the escrow account
15381538 system shall be required to make payment of the requir ed fee or fees
15391539 upon purchase of each permit as requ ired by law. All monies
15401540 collected through the escrow account system shall be deposit ed to a
15411541 special account of the Department of Public Safety Transportation
15421542 and placed in the custody of the State Treasur er. Proceeds from
15431543 permits purchased using the escr ow account system shall be
15441544 distributed as provided for in subsection H of this sectio n.
15451545 However, fees collected through such accounts for the electronic
15461546 transmission, transfer or delivery of permits, as p rovided for in
15471547 Section 14-118 of this title, shall be credited to the Department of
15481548 Public Safety Restricted Revolving State Transportation Fund
15491549 established pursuant to Section 1501.1 of Title 69 of the Okla homa
15501550 Statutes.
15511551 C. 1. Application for per mits shall be made a reasonable time
15521552 in advance of the expected time o f movement of such vehicles . For
15531553 emergencies affecting the health or safety of persons or a
15541554 community, permits ma y be issued for immediate movement.
15551555 2. Size and weight permit offices i n all districts where
15561556 applicable shall issue per mits to authorize carr iers by telephone
15571557 during weekdays.

15841584 D. No overweight permit shall be valid until all license taxes
15851585 due the State of Oklahoma have been paid.
15861586 E. No permit violation shall be deemed to ha ve occurred when an
15871587 oversize or overweight movem ent is made pursuant t o a permit whose
15881588 stated weight or size exceeds the actual load.
15891589 F. Any permit issued for a truck or truck-tractor operating in
15901590 combination with a trailer or a semitrailer shall contain only the
15911591 license plate number for the truck or t ruck-tractor if the permittee
15921592 provides to the Department of Transportation a list containing the
15931593 license plate number, and such other in formation as the Department
15941594 of Transportation may prescribe by rule, for each trailer or
15951595 semitrailer which may be used f or movement with the p ermit. When
15961596 the permittee provides the list described in this subsection, th e
15971597 license plate number for any traile r or semitrailer to be moved with
15981598 the permit shall not be included on th e permit; provided, a trailer
15991599 or semitrailer which is not on the list shall not be authorized to
16001600 be used for movement with the permit. It shall be the
16011601 responsibility of the permittee to ensure the list provided to the
16021602 Department of Transportation is maintained and updated with any
16031603 fleet changes. The D epartment of Transportation shall adopt any
16041604 rules deemed necessary to administer the provisions of this
16051605 subsection.
16061606 G. The first delive rer of motor vehicles designated truck
16071607 carriers or well service carriers manufactured in Oklahoma shall not

16401640 section collected monthly shall be a pportioned as provided in
16411641 Section 1104 of this title. For the fiscal year beginning July 1,
16421642 2016, and ending June 30, 2017, the next Two Million One Hundred
16431643 Fifty Thousand Dollar s ($2,150,000.00) of procee ds from both the
16441644 permit fees and the overweight pe rmit fees imposed pursuant to
16451645 subsection A of this section collected monthly shall be remitted to
16461646 the Department of Public Safety for the purpose of training the
16471647 Department of Public Safety port of entry of ficers whose powers and
16481648 duties shall be specified by the Department of Public Safety through
16491649 the promulgation of rules. For the fiscal year beginning July 1,
16501650 2017, and all subsequent years, the next One Mil lion Five Hundred
16511651 Thousand Dollars ($1,500,000.00 ) of proceeds from both the permit
16521652 fees and the overweight permit fees imposed pursuant to subsection A
16531653 of this section collected monthly shall be remitted to the
16541654 Department of Public Safety for the purpose of staffing the port o f
16551655 entry weigh stations with Department of Public Safety port of entry
16561656 officers whose powers and duties shall be sp ecified by the
16571657 Department of Public Safety through the promulgation of rules. For

16961696 ($2,716,000.00) shall be deposited in the Weigh Station Improveme nt
16971697 Revolving Fund as provided in Section 1167 of t his title for the
16981698 purpose set forth in that section and may be used for motor carrier
16991699 permitting systems and motor carrier safety and enforcement.
17001700 SECTION 10. AMENDATORY 47 O.S. 20 21, Section 14-116a, is

17021702 Section 14-116a. Any person, firm, or corporation who moves or

17471747 or manufactured home who is in possession of a permit authorizing
17481748 the movement of the load or ma nufactured home.
17491749 SECTION 11. AMENDATORY 47 O.S. 20 21, Section 14-118, is

17511751 Section 14-118. A. 1. Pursuant to such rules as may be
17521752 prescribed by Oklahoma agencies of jurisdiction, Oklahoma motor

17871787 2. Such rules shall be the basis for the development of a
17881788 system by the Commissioner of Public Safety Executive Director of
17891789 the Department of Transportation for the issuance of permits for the
17901790 movement of oversize or overw eight vehicles or loads. Such system
17911791 shall include, but not be l imited to, provisions for duration,
17921792 seasonal factors, hours of the day or days when valid, special
17931793 requirements as to flags, flagmen and warning or safety devices , and
17941794 other such items as may be consistent with the intent of this
17951795 section. The permit syste m shall include provisions for the
17961796 collection of permit fees as well as for the issuance of the permits
17971797 by telephone, electronic transfe r or such other methods of issuance
17981798 as may be deemed feasible.
17991799 3. The Department of Public Safety Transportation is authorized
18001800 to charge a fee of Two Dollars ($2.00) for each permit requested to
18011801 be issued by facsimile machine or by any other means of elec tronic
18021802 transmission, transfer or delivery. The fee sha ll be in addition to
18031803 any other fee or fees assessed for the permi t. The fee shall be
18041804 deposited in the State Treasury to the credit of the Department of
18051805 Public Safety Restricted Revolving Fund Transportation and the

18341834 4. It is the purpose of this section to permit the movement of
18351835 necessary overweight and oversize vehicles or loads consistent with
18361836 the following obligations:
18371837 a. protection of the motoring public fro m potential
18381838 traffic hazards,
18391839 b. protection of highway surfaces, structures, and
18401840 private property, and
18411841 c. provision for normal flow of traffic with a minimum of
18421842 interference.
18431843 B. The Transportation Comm ission shall prepare and publish a
18441844 map of the State of Oklahoma this state showing by appropriate
18451845 symbols the various highway structures and bridges in terms of
18461846 maximum size and weight restrictions. T his map shall be titled
18471847 "Oklahoma Load Limit Map " and shall be revised periodically to
18481848 maintain a reasonably c urrent status and in no event shall a period
18491849 of two (2) years lapse between revisions and publication of the
18501850 printed version of the Oklahoma Load Limit Map. This map shall also
18511851 be made available by the De partment of Transportation on the
18521852 Internet, and in no event shall a per iod of six (6) months lapse
18531853 between revisions of the information provided on the Internet.
18541854 Provided, further, the Secretary o f the Department of Transportation
18551855 shall prepare and publis h a map of the State of Oklahoma this state

18851885 C. The Commissioner of Public Safety Executive Director of the
18861886 Department of Transportation, or an authorized representative, shall
18871887 have the authority, within the li mitations formulated under
18881888 provisions of this chapter, to issue, withhold or revoke special
18891889 permits for the operation of vehicles or combinations of vehicles or
18901890 loads which exceed the size or weight limitations of this chapter.
18911891 Every such permit shall be carried in the vehicle or com bination of
18921892 vehicles to which it re fers and shall be open to inspection by any
18931893 law enforcement officer or authorized agent of any author ity
18941894 granting such permit, and no person shall violate any of the terms
18951895 or conditions of suc h special permit.
18961896 D. It shall be permissible in the transportat ion of empty
18971897 trucks on any road or highway to tow by use of saddlemounts ;, i.e.,
18981898 mounting the front wh eels of one vehicle on the bed of another
18991899 leaving the rear whee ls only of such towed vehicle in contact with
19001900 the roadway. One vehicle may be fullmounted o n the towing or towed
19011901 vehicles engaged in any driveaway or towaway operation. No more
19021902 than three saddlemounts may be permitted in such combinations. The
19031903 towed vehicles shall be securely fas tened and operated under the
19041904 applicable safety requirements of th e United States Department of
19051905 Transportation and such combinations shall not exceed an overall

19371937 Department of Transportation, upon application of any person engaged
19381938 in the transportation of forest products in the raw state, which is
19391939 defined to be tree-length logs moving from the forest directly to
19401940 the mill, or upon application of any person engaged in the hauling
19411941 for hire or for resale , of round baled hay with a total outside
19421942 width of eleven (11) feet or les s, shall issue an annual permit,
19431943 upon payment of a fee of Twenty-five Dollars ($25.00) each year,
19441944 authorizing the operation by such persons of such motor vehicle load
19451945 lengths and widths upon the highways of this state except on the
19461946 National System of Inter state and Defense Highways. Provided,
19471947 however, the restriction on use of the National System of Interstate
19481948 and Defense Highways shall not be applicable to persons engaged in
19491949 the hauling of round baled hay with a total outside width of eleven
19501950 (11) feet or less.
19511951 F. The Commissioner of Public Safety Executive Director of the
19521952 Department of Transportation, upon application of any person engaged
19531953 in the transportation of overwidth or overheight equipment us ed in
19541954 soil conservation work with a total outside width of twelve (12)
19551955 feet or less, shall issue an annual permit, upo n payment of a fee of

19861986 G. Farm equipment including, but not limited to, implements of
19871987 husbandry as defined in Section 1 -125 of this title shall be
19881988 exempted from the req uirement for special permits due to size. Such
19891989 equipment may move on any highway, except those highways which are
19901990 part of the National System o f Interstate and Defense Highways,
19911991 during the hours of darkness and shall be subject to the
19921992 requirements as prov ided in Section 12-215 of this title. In
19931993 addition to those requirements, tractors pulling machinery over
19941994 thirteen (13) feet wide must have two amber flashing warning lamps
19951995 symmetrically mounted, laterally and widely spaced as practicable,
19961996 visible from both front and rear, mounted at least thirty-nine (39)
19971997 inches high.
19981998 H. Any rubber-tired road construction vehicle includ ing rubber-
19991999 tired truck cranes and special mobilized machinery either self-
20002000 propelled or drawn carrying no load other than component parts
20012001 safely secured to the machinery and its own weight, but which is
20022002 overweight by any provisions of this chapter, shall be authorized to
20032003 move on the highways of the State of Oklahoma this state. Movement
20042004 of such vehicles shall be authorized on the Federal Interstate
20052005 System of Highways National System of Interstate and Defense

20332033 Public Safety Executive Director of the Department of Transportation
20342034 or an authorized representative upon determination that the
20352035 objectives of this s ection will be served by such a permit and that
20362036 federal weight restrictions will not be violated. The specia l
20372037 permit shall be:
20382038 1. A single-trip permit issued under the provisions of this
20392039 section and Section 14-116 of this title; or
20402040 2. A special annual overweight permit which shall be issued for
20412041 one calendar year period upon payment of a f ee of Sixty Dollars
20422042 ($60.00).
20432043 The weight of any such vehicle shall not exceed six hundred
20442044 fifty (650) pounds multiplied by the nominal width of the tire. The
20452045 vehicle shall be required to carry the safety equipment adjudged
20462046 necessary for the health and wel fare of the driving pu blic. If any
20472047 oversized vehicle does not come under the other limitations of the
20482048 present laws, it shall be deemed that the same shall travel only
20492049 between the hours of sunrise a nd sunset. The vehicle, bein g
20502050 overweight but of legal dim ension, shall be allow ed continuous
20512051 travel. The vehicles, except special mobilized machinery, shall be
20522052 exempt from the laws of this state relating to motor vehicle
20532053 registration, licensing or other fees or taxes in lieu of ad v alorem
20542054 taxes.

20842084 feet, then the permit may restrict movement to a fifty-mile radius
20852085 from an established operati ng base, and may designate highways to be
20862086 traveled, hours of travel and when flagmen may be required to
20872087 precede or follow the equipment.
20882088 2. Possession of a permit shall in no way be construed as
20892089 exempting such equipment from the auth ority of the Executive
20902090 Director of the Department of Transportation to restrict use of
20912091 particular highways, nor shall it exempt owners or operators of such
20922092 equipment from the responsibility for damage to high ways caused by
20932093 movement of the equipment. Nothing in this subsection shall appl y
20942094 to machinery used in highway construction or road material
20952095 production.
20962096 3. Upon the issuance of a special mobilized machinery driveaway
20972097 permit as provided in this subsection, special mobilized machinery
20982098 manufactured in Oklahoma shal l be permitted to move upon the
20992099 highways of this state from the place of manufacture to the state
21002100 line for delivery and exclusive use outside the state, and may be
21012101 temporarily returned to Oklahoma f or modification and repair, w ith
21022102 subsequent movement back out of the state. Spe cial driveaway
21032103 permits for such movements shall be issued by the Commissioner of

21402140 use of highways of the interstate system.
21412141 5. When such equipment has a width greater than eight and one -
21422142 half (8 1/2) feet, or a lengt h exclusive of load of fo rty-five (45)
21432143 feet, or a height in excess of thirteen and one-half (13 1/2) feet,
21442144 the permit may designate highways to be traveled, hours of travel
21452145 and when flagmen may be required to precede or follow the equipment.
21462146 6. Possession of a special driveaway p ermit shall in no way be
21472147 construed as exempting such equip ment from the authority of the
21482148 Executive Director of the Department of Transportation to restrict
21492149 use of particular highways, nor shall it exempt the owners or
21502150 operators of such equip ment from the responsibil ity for damage to
21512151 highways caused by the movemen t of such equipment.

22322232 or U.S. highway in Oklahoma. Provided, however, the Commissioner of
22332233 Public Safety Executive Director of the Department of Transportat ion
22342234 is authorized to allow such items in exce ss of twenty-three (23)
22352235 feet in width to travel on such highway if it is in the best
22362236 interest of the state and a s pecial moving permit has been issued.
22372237 Provided, further, that no such load in excess of the limitations
22382238 set forth in the applicable United St ates Code shall be permitted to
22392239 travel upon any portion of the National System of Interstate and
22402240 Defense Highways.
22412241 B. Every person desiring to transpo rt manufactured items
22422242 pursuant to the provisions of this section shall apply to the
22432243 Department of Public Safety Transportation for a special movement
22442244 permit on an application form prescribed by the Department. Upon
22452245 approval of the application by the Depar tment of Transportation, a
22462246 special movement permit shall be issued for a fee of Five Hundred
22472247 Dollars ($500.00). Except as provided in Section 4 of this act 14-
22482248 122 of this title, monies received from such special movement permit
22492249 fees shall be deposited in the State Treasury to the credit of the
22502250 General Revenue Fund. A permit issued purs uant to the provisions of
22512251 this subsection shall expire upon the completion of one trip

22852285 SECTION 14. AMENDATORY 47 O.S. 2 021, Section 14-120.1,
22862286 is amended to read as follows:
22872287 Section 14-120.1 A. 1. Any vehicle or combination of vehicles
22882288 with an outside width that excee ds twelve (12) feet operating on
22892289 highways in the state, including the National Syst em of Interstate
22902290 and Defense Highways, shall, in addition to being in compliance with
22912291 provisions of Section 14-101 et seq. of this t itle, be accompanied
22922292 by an escort vehicle or vehicles, as prescribed by the Department of
22932293 Public Safety Transportation.
22942294 2. Escort vehicle requirements shall not apply to retail
22952295 implement dealers transporting farm implements from a retail
22962296 distribution point to a fa rm or other location within a one hundred
22972297 fifty (150) air-mile radius from the distribution point . For the
22982298 purposes of this subsection , "retail implement dealers " shall mean a
22992299 business engaged primarily in the sale of farm tractors as defined
23002300 in Section 1-118 of this title or implements of husbandry as defined
23012301 in Section 1-125 of this title or a combination thereo f.

23282328 B. No person shall operate an escort vehicle for hire, as
23292329 required by this section, unless the person has been certified by
23302330 the Department of Public Safety Transportation as an escort vehicle
23312331 operator.
23322332 C. Any person not required to be certified by the Dep artment of
23332333 Public Safety Transportation as an escort vehicle operator may tow a
23342334 trailer when escorting a m anufactured home. Such trail er shall not
23352335 exceed eight and one -half (8 1/2) feet in width and twenty (20) feet
23362336 in length with siding not to exceed fou r (4) feet in height measu red
23372337 from the bed of the trailer.
23382338 The trailer may only be u sed to transport suppl ies and equipment
23392339 necessary to carry out the mission of escort vehi cle operators.
23402340 D. The Commissioner of Public Safety Executive Director of the
23412341 Department of Transportation shall promulgate rules for the
23422342 certification of operators of escort vehicles and the use of escort
23432343 vehicles, as required by this section.
23442344 E. The Commissioner of Public Safety Executive Director of the
23452345 Department of Transporta tion is hereby authorized to enter into
23462346 reciprocal compacts and agreements with oth er states for the purpose
23472347 of recognizing escort vehicle operator certifications issued by
23482348 those states.

23792379 agency or commission to have a law enforcement escort provided by
23802380 the Oklahoma Highway Patrol Division of the Department of Public
23812381 Safety for the transport of any oversized load or haza rdous shipment
23822382 by road or rail shall pay to the Department of Public Safety
23832383 Transportation a fee covering the full cost to administer, plan , and
23842384 carry out the escort within this state.
23852385 B. If the Highway Patrol provides an esco rt to accompany the
23862386 transport of an oversized load or hazardou s shipment by road or rail
23872387 at the request of any person that is not requi red to have a law
23882388 enforcement escort pursua nt to subsection A of this section, then
23892389 the requestor shall pay to the Depart ment of Public Safety
23902390 Transportation a fee covering the full cost to administer, plan , and
23912391 carry out the escort within this state.
23922392 C. The Department of Public Safety Transportation shall adopt a
23932393 schedule of fees necessary to implement this section.
23942394 D. All fees collected by the Depar tment pursuant to this
23952395 section shall be deposited to the credit of the Department of Public
23962396 Safety Restricted Revolving State Transportation Fund established
23972397 pursuant to Section 1501.1 of Title 69 of the Oklahoma Statutes.

24262426 Section 14-121. A. No person shall operate a special
24272427 combination vehicle within this state without a special c ombination
24282428 vehicle permit for the vehicle i ssued by the Department of Public
24292429 Safety Transportation. Such permit may be i ssued for operation upon
24302430 Federal Aid Interstate Highways or four-lane divided Federal Aid
24312431 Primary Highways and for access or egress bet ween points of origin
24322432 or destination.
24332433 B. The Commissioner of Public Safety Executive Director of the
24342434 Department of Transportation shall promulgate rules for the issuance
24352435 of special combination vehicle permits and shall collec t an annual
24362436 fee of Two Hundred Forty Dol lars ($240.00) for each such permit
24372437 issued. Except as provided in Section 4 14-122 of this act title,
24382438 fees collected pursuant to this sec tion shall be remitted to the
24392439 State Treasurer to be credited to the General Re venue Fund in the
24402440 State Treasury.
24412441 C. For the purposes of this section, a special combination
24422442 vehicle shall consist of a truck-tractor semitrailer combination
24432443 towing two complete trailers or semitrailers. No semitrailer or
24442444 trailer used in such a combinati on shall have a length greater than
24452445 twenty-nine (29) feet nor shall a special combination vehicle exceed
24462446 the weight limitations imposed by Sections 14-109 and 14-116 of this
24472447 title.

24772477 1. "Affected area" means the entire width of the right -of-way

24802480 2. "High-wide load" means a motor vehicle transpor ting property
24812481 on any portion of a route where the vehicle exceeds the limitations
24822482 on size imposed by Section 14 -103 of Title 47 of the Oklahoma
24832483 Statutes and no portion of the motor ve hicle or the transported
24842484 property has a greater width than twenty -eight (28) feet or a
24852485 greater height than twenty -three (23) feet; and
24862486 3. "Political subdiv ision" means a city, village, town or
24872487 county.
24882488 B. The following routes through Oklahoma are designat ed as

26772677 the Department of Transportation.
26782678 E. Upon the effective date of this sectio n, and exclusive of
26792679 incorporated municipal lim its, no person may do any of the foll owing
26802680 within the affected area:
26812681 1. Install any permanent structure without the authorization of
26822682 the Department of Transportation; or
26832683 2. Take any action that would make any portion of the affected
26842684 area permanently unav ailable for use by a high-wide load.
26852685 F. The Department of Transportation shall create additional
26862686 design standards for improvements to the Oklahoma high -wide routes
26872687 to prevent interference from permanent struct ures. These standards
26882688 shall:
26892689 1. Maintain a minimum eighteen feet and zero inches (18'-0")
26902690 vertical clearance above the road surface for all future overhead
26912691 obstructions. Where bridges cross over the Oklahoma high -wide
26922692 routes, they shall be designed, whe re possible, to allow for high -
26932693 wide loads to quickly egress and ingress around the bridge utilizing
26942694 on- and off-ramps;
26952695 2. Require all future overhead signage to be of cantilever
26962696 design, where possible, to allow high -wide loads to shift lanes to
26972697 prevent interference; and

27302730 the affected parties and with persons using the high -wide route for
27312731 high-wide loads regarding the allocation of costs and provision of
27322732 services related to removing p ermanent structures that interfere
27332733 with the use of any portion of the affected area by high-wide loads.
27342734 H. Political subdivisions in which any portion of the Oklahoma
27352735 high-wide route is located shall attempt to reach agreements among
27362736 the affected parties and with persons using the high -wide route for
27372737 high-wide loads to provide timely vehicle escorts for persons using
27382738 the high-wide route for high-wide loads.
27392739 SECTION 18. AMENDATORY 69 O.S. 2021, Section 306, is
27402740 amended to read as follows:
27412741 Section 306. Immediately upon the election and qualification of
27422742 the Executive Director of the Department of Transportation , he or
27432743 she shall become vested with the duties and powers of the management
27442744 and control of the Department, under such orders, rules and

28342834 claims for the purchase of equipment, m aterials and supplies
28352835 theretofore authorized by the Commission;
28362836 (h) 8. To make emergency purchases of equipment, materials , and
28372837 supplies, and emergency contracts for construction and repairs ,
28382838 under rules and regulations prescribed by the Commission;
28392839 (i) 9. To grant permission to state age ncies, municipalities
28402840 and water companies or districts to lay any water pipeline within
28412841 the rights-of-way of state highways, when approved by the
28422842 Commission; and
28432843 (j) 10. To act for the Department in all matters except as
