40	40	An Act relating to education grants; creating the
41	41	Digital Wallet Program Act; describing program
42	42	purpose; defining terms; directing the Governor or
43	43	designee to administer the program; providing for
44	44	distribution of grant funding; requiring submissi on
45	45	of an annual report of the program; prescribing
46	46	contents of report; providing for codification;
47	47	providing an effective date; and declaring an
48	48	emergency.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 1-201 of Title 70, unless there
57	57	is created a duplication in num bering, reads as follows:
58	58	A. This act shall be known and may be cited as the "Digital
59	59	Wallet Program Act".
60	60	B. There is hereby created the Digital Wallet Program to
61	61	increase learning opportunities for students, establish new
62	62	flexibilities for families, em power families to create education
63	63	solutions that fit the uniq ue needs of their children , and to
64	64	empower and encourage the state to directly support families.

91	91	C. As used in this act:
92	92	1. "Federal poverty level " means a measure of annualized incom e
93	93	that is published annually in the Federal Regi ster by the United
94	94	States Department of Health and Human Services;
95	95	2. "Grant" means the amount of money allocated to a parent ;
96	96	3. "Grant funding" means the amount of funding in the Digital
97	97	Wallet Program that is not allocated for administrative purposes;
98	98	4. "Parent" means any person who is the parent or legal
99	99	guardian of a child who is entitled to receive a fre e and
100	100	appropriate public education according to state statutes; and
101	101	5. "Student" means any person who is e ntitled to receive a free
102	102	and appropriate public education acc ording to state statutes .
103	103	D. The Digital Wallet Program shall be administered by the
104	104	Governor, or his or her designee, to provide funds directly to
105	105	parents for educational supplies, tutoring, t echnology needs, or
106	106	other educational expenses.
107	107	E. The Governor, or his or her designee , shall annually
108	108	distribute all available grant funding to parents in the Digital
109	109	Wallet Program in the following order:
110	110	1. On or after July 1 and before August 1 of each year, grants
111	111	shall only be distributed to parents whose household income is equal
112	112	to or less than one hundred eighty -five percent (185%) of the
113	113	federal poverty level;

140	140	2. On or after August 1 and before September 1 of each year,
141	141	and if there are availa ble funds, grants shall only be distributed
142	142	to parents whose household income is equal t o or less than three
143	143	hundred percent (300%) of the federal poverty level;
144	144	3. On or after September 1 and before Octob er 1 of each year,
145	145	and if there are available fund s, grants shall only be distributed
146	146	to parents whose household income is equal to or less than three
147	147	hundred fifty percent (350%) of the federal poverty level; and
148	148	4. On or after October 1 of each year, and if there are
149	149	available funds, grants shall be di stributed to parents of all
150	150	income levels until all available funds in the program ar e
151	151	distributed.
152	152	F. On or by December 31 of each year, the Governor, or his or
153	153	her designee, shall submit an annual report on the Digital Wallet
154	154	Program to the Preside nt Pro Tempore of the Oklahoma State Senate
155	155	and the Speaker of the Oklahoma House of Representatives. The
156	156	contents of the report shall include, but are not limited to, the
157	157	following information:
158	158	1. The number of grants awarded to parents in each month of the
159	159	year;
160	160	2. The number of grants awarded to parents by income le vel;
161	161	3. The average amount of funds distributed to parents and the
162	162	median amount of funds distributed to parents;
163	163	4. The number of applicants for grants; and

190	190	5. The amount of funds expended f or the administration of the
191	191	program.
192	192	SECTION 2. This act shall become effective July 1, 2022.
193	193	SECTION 3. It being immediately necessary for the preservation
194	194	of the public peace, health or safety, an emergency is hereby
195	195	declared to exist, by reason whereof thi s act shall take effect and
196	196	be in full force from and after its passage and approval.
