4040 An Act relating to education grants; creating the
4141 Digital Wallet Program Act; describing program
4242 purpose; defining terms; directing the Governor or
4343 designee to administer the program; providing for
4444 distribution of grant funding; requiring submissi on
4545 of an annual report of the program; prescribing
4646 contents of report; providing for codification;
4747 providing an effective date; and declaring an
4848 emergency.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 1-201 of Title 70, unless there
5757 is created a duplication in num bering, reads as follows:
5858 A. This act shall be known and may be cited as the "Digital
5959 Wallet Program Act".
6060 B. There is hereby created the Digital Wallet Program to
6161 increase learning opportunities for students, establish new
6262 flexibilities for families, em power families to create education
6363 solutions that fit the uniq ue needs of their children , and to
6464 empower and encourage the state to directly support families.

9191 C. As used in this act:
9292 1. "Federal poverty level " means a measure of annualized incom e
9393 that is published annually in the Federal Regi ster by the United
9494 States Department of Health and Human Services;
9595 2. "Grant" means the amount of money allocated to a parent ;
9696 3. "Grant funding" means the amount of funding in the Digital
9797 Wallet Program that is not allocated for administrative purposes;
9898 4. "Parent" means any person who is the parent or legal
9999 guardian of a child who is entitled to receive a fre e and
100100 appropriate public education according to state statutes; and
101101 5. "Student" means any person who is e ntitled to receive a free
102102 and appropriate public education acc ording to state statutes .
103103 D. The Digital Wallet Program shall be administered by the
104104 Governor, or his or her designee, to provide funds directly to
105105 parents for educational supplies, tutoring, t echnology needs, or
106106 other educational expenses.
107107 E. The Governor, or his or her designee , shall annually
108108 distribute all available grant funding to parents in the Digital
109109 Wallet Program in the following order:
110110 1. On or after July 1 and before August 1 of each year, grants
111111 shall only be distributed to parents whose household income is equal
112112 to or less than one hundred eighty -five percent (185%) of the
113113 federal poverty level;

140140 2. On or after August 1 and before September 1 of each year,
141141 and if there are availa ble funds, grants shall only be distributed
142142 to parents whose household income is equal t o or less than three
143143 hundred percent (300%) of the federal poverty level;
144144 3. On or after September 1 and before Octob er 1 of each year,
145145 and if there are available fund s, grants shall only be distributed
146146 to parents whose household income is equal to or less than three
147147 hundred fifty percent (350%) of the federal poverty level; and
148148 4. On or after October 1 of each year, and if there are
149149 available funds, grants shall be di stributed to parents of all
150150 income levels until all available funds in the program ar e
151151 distributed.
152152 F. On or by December 31 of each year, the Governor, or his or
153153 her designee, shall submit an annual report on the Digital Wallet
154154 Program to the Preside nt Pro Tempore of the Oklahoma State Senate
155155 and the Speaker of the Oklahoma House of Representatives. The
156156 contents of the report shall include, but are not limited to, the
157157 following information:
158158 1. The number of grants awarded to parents in each month of the
159159 year;
160160 2. The number of grants awarded to parents by income le vel;
161161 3. The average amount of funds distributed to parents and the
162162 median amount of funds distributed to parents;
163163 4. The number of applicants for grants; and

190190 5. The amount of funds expended f or the administration of the
191191 program.
192192 SECTION 2. This act shall become effective July 1, 2022.
193193 SECTION 3. It being immediately necessary for the preservation
194194 of the public peace, health or safety, an emergency is hereby
195195 declared to exist, by reason whereof thi s act shall take effect and
196196 be in full force from and after its passage and approval.
