4040 An Act relating to legislative transparency; amending

5252 BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 2 5 O.S. 2021, Section 304, is
5454 amended to read as follows:
5555 Section 304. As used in the Oklahoma Open Meeting Act:
5656 1. "Public body" means the governing bodi es of all
5757 municipalities located within this state, boards of county
5858 commissioners of the counties i n this state, boards of public and
5959 higher education in this state and all boards, bureaus, commissions,
6060 agencies, trusteeships, authorities, councils, commi ttees, public
6161 trusts or any entity created by a public trust, including an y
6262 committee or subcommitte e composed of any of the members of a public
6363 trust or other legal entity receiving funds from the Rural Economic

9090 Action Plan Fund as authorized by Section 2 007 of Title 62 of the
9191 Oklahoma Statutes, task forces or study groups in t his state
9292 supported in whole or in part by public funds or entrusted with the
9393 expending of public funds, or administering public property, and
9494 shall include all committees or subcomm ittees of any public bo dy.
9595 Public body shall not include the state judici ary, the Council on
9696 Judicial Complaints when conducting, discussing, or de liberating any
9797 matter relating to a complaint received or filed with the Council,
9898 the Legislature, or administrative staffs of publ ic bodies,
9999 including, but not limited to, faculty m eetings and athletic staff
100100 meetings of institutions of higher education wh en those staffs are
101101 not meeting with the public body, or entry -year assistance
102102 committees. Furthermore, pub lic body shall not incl ude the
103103 multidisciplinary teams provided for in Sec tion 1-9-102 of Title 10A
104104 of the Oklahoma Statutes and subsection C of Sec tion 1-502.2 of
105105 Title 63 of the Oklahoma Statutes or any school board meeting for
106106 the sole purpose of consid ering recommendations o f a
107107 multidisciplinary team and deciding the placeme nt of any child who
108108 is the subject of the recommendations. Furthermore, p ublic body
109109 shall not include meetings conducted by stewards designated by the
110110 Oklahoma Horse Racing Commissi on pursuant to Section 203.4 of Title
111111 3A of the Oklahoma Statutes when the stewards are officiating at
112112 races or otherwise enforcing rules of the Com mission. Furthermore,

139139 public body shall not include the board of directors of a Federally
140140 Qualified Health Center;
141141 2. "Meeting" means the conduct of business of a public body by
142142 a majority of its members be ing personally together or, as
143143 authorized by Section 307.1 of this title, together pursuant to a
144144 videoconference. Meeting shall not include informal gather ings of a
145145 majority of the members of the public body when no business of t he
146146 public body is discusse d;
147147 3. "Regularly scheduled meeting " means a meeting at which the
148148 regular business of the public body is conducted;
149149 4. "Special meeting" means any meeting of a public body other
150150 than a regularly scheduled meeting or emergency mee ting;
151151 5. "Emergency meeting" means any meeting called for the purpose
152152 of dealing with an emergency. For purposes of the Oklahoma Open
153153 Meeting Act, an emergency is defined as a situ ation involving injury
154154 to persons or injury and damage to public or person al property or
155155 immediate financial loss when the time requirements for pub lic
156156 notice of a special meeting would make such procedure impractical
157157 and increase the likelihood of injury or damage or immediate
158158 financial loss;
159159 6. "Continued or reconvened meetin g" means a meeting which i s
160160 assembled for the purpose of finishing busines s appearing on an
161161 agenda of a previous meeting. For the purposes of the Oklahoma Open
162162 Meeting Act, only mat ters on the agenda of t he previous meeting at

189189 which the announcement of th e continuance is made may be discussed
190190 at a continued or reconvened meetin g;
191191 7. "Videoconference" means a conference among members of a
192192 public body remote from one another who are l inked by interactive
193193 telecommunication devices or technology and/or techno logy permitting
194194 both visual and auditory communication between and among m embers of
195195 the public body and/or between and among members of the public body
196196 and members of the public. Du ring any videoconferenc e, both the
197197 visual and auditory communications func tions shall attempt to be
198198 utilized; and
199199 8. "Teleconference" means a conference among members of a
200200 public body remote from one another who are linked by
201201 telecommunication devices and /or technology permitti ng auditory
202202 communication between and among members of the public body and/or
203203 between and among members of the public body an d members of the
204204 public.
205205 SECTION 2. AMENDATORY 51 O.S. 2021, Section 24A.3, is
206206 amended to read as follows :
207207 Section 24A.3 As used in the Oklahoma Open Recor ds Act:
208208 1. "Record" means all documents, including, but not limited to,
209209 any book, paper, photograph, microfilm, data files created by or
210210 used with computer software, computer tape, di sk, record, sound
211211 recording, film recording, video record or other mater ial regardless
212212 of physical form or characteristic, created by, received b y, under

239239 the authority of, or coming into the custody, control or possession
240240 of public officials, public bodies , or their representatives in
241241 connection with the transaction of public business, the expenditure
242242 of public funds or the administering of public property. "Record"
243243 does not mean:
244244 a. computer software,
245245 b. nongovernment personal effects,
246246 c. unless public disclosure is required by other laws or
247247 regulations, vehicle movement reco rds of the Oklahoma
248248 Transportation Authority obtained in connection with
249249 the Authority's electronic toll collection system,
250250 d. personal financial information, credit reports or
251251 other financial data obtained by or submitted to a
252252 public body for the purpose of evaluating credit
253253 worthiness, obtaining a license, permit, or for the
254254 purpose of becoming qualified to contract with a
255255 public body,
256256 e. any digital audio/video recordings of the toll
257257 collection and safeguarding activities of the Oklahoma
258258 Transportation Authority,
259259 f. any personal information provided by a guest at any
260260 facility owned or operated by the Oklahoma Tourism and
261261 Recreation Department or the Board of Trustees of the
262262 Quartz Mountain Arts and Conference Center and Nature

290290 purchaser of a product sold by or through the Okla homa
291291 Tourism and Recreation Department or the Quartz
292292 Mountain Arts and Conference Center and Nature Park,
293293 g. a Department of Defense Form 214 (DD Form 214) filed
294294 with a county clerk, including any DD Form 214 filed
295295 before July 1, 2002, or
296296 h. except as provided for in Section 2 -110 of Title 47 of
297297 the Oklahoma Statutes,
298298 (1) any record in connection with a Motor Vehic le
299299 Report issued by the Department of Public Safety,
300300 as prescribed in Section 6-117 of Title 47 of the
301301 Oklahoma Statutes, or
302302 (2) personal information within driver records, as
303303 defined by the Driver 's Privacy Protection Act,
304304 18 United States Code, Sections 2721 through
305305 2725, which are stored and maintained by the
306306 Department of Public Safety;
307307 2. "Public body" shall include, but not be limited to, an y
308308 office, department, board, bureau, commission, agency, trusteeship,
309309 authority, council, committee, including a committee of either
310310 chamber of the Legislature, trust or any entity cr eated by a trust,
311311 county, city, village, town, township, district, school district,
312312 fair board, court, executive office, advisory group, task force,

339339 study group, or any subdivision the reof, supported in wh ole or in
340340 part by public funds or entrusted with th e expenditure of public
341341 funds or administering or operating public proper ty, and all
342342 committees, or subcommittees thereof. Except for the records
343343 required by Section 24A.4 of this tit le, "public body" does not mean
344344 judges, justices, or the Council on Judicial Complaints, the
345345 Legislature, or legislators;
346346 3. "Public office" means the physical location where public
347347 bodies conduct business or keep records;
348348 4. "Public official" means any official or employee of any
349349 public body as defined herein; and
350350 5. "Law enforcement agency" means any public body charged with
351351 enforcing state or lo cal criminal laws and initiating criminal
352352 prosecutions, including, but not limited to, police departments,
353353 county sheriffs, the D epartment of Public Safety, the Oklahoma State
354354 Bureau of Narcotics and Danger ous Drugs Control, the Alcoholic
355355 Beverage Laws Enforcement Commission, and the Oklahoma State Bureau
356356 of Investigation.
357357 SECTION 3. This act shall become effective November 1, 2022.
