52	52	BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 2 5 O.S. 2021, Section 304, is
54	54	amended to read as follows:
55	55	Section 304. As used in the Oklahoma Open Meeting Act:
56	56	1. "Public body" means the governing bodi es of all
57	57	municipalities located within this state, boards of county
58	58	commissioners of the counties i n this state, boards of public and
59	59	higher education in this state and all boards, bureaus, commissions,
60	60	agencies, trusteeships, authorities, councils, commi ttees, public
61	61	trusts or any entity created by a public trust, including an y
62	62	committee or subcommitte e composed of any of the members of a public
63	63	trust or other legal entity receiving funds from the Rural Economic

90	90	Action Plan Fund as authorized by Section 2 007 of Title 62 of the
91	91	Oklahoma Statutes, task forces or study groups in t his state
92	92	supported in whole or in part by public funds or entrusted with the
93	93	expending of public funds, or administering public property, and
94	94	shall include all committees or subcomm ittees of any public bo dy.
95	95	Public body shall not include the state judici ary, the Council on
96	96	Judicial Complaints when conducting, discussing, or de liberating any
97	97	matter relating to a complaint received or filed with the Council,
98	98	the Legislature, or administrative staffs of publ ic bodies,
99	99	including, but not limited to, faculty m eetings and athletic staff
100	100	meetings of institutions of higher education wh en those staffs are
101	101	not meeting with the public body, or entry -year assistance
102	102	committees. Furthermore, pub lic body shall not incl ude the
103	103	multidisciplinary teams provided for in Sec tion 1-9-102 of Title 10A
104	104	of the Oklahoma Statutes and subsection C of Sec tion 1-502.2 of
105	105	Title 63 of the Oklahoma Statutes or any school board meeting for
106	106	the sole purpose of consid ering recommendations o f a
107	107	multidisciplinary team and deciding the placeme nt of any child who
108	108	is the subject of the recommendations. Furthermore, p ublic body
109	109	shall not include meetings conducted by stewards designated by the
110	110	Oklahoma Horse Racing Commissi on pursuant to Section 203.4 of Title
111	111	3A of the Oklahoma Statutes when the stewards are officiating at
112	112	races or otherwise enforcing rules of the Com mission. Furthermore,

139	139	public body shall not include the board of directors of a Federally
140	140	Qualified Health Center;
141	141	2. "Meeting" means the conduct of business of a public body by
142	142	a majority of its members be ing personally together or, as
143	143	authorized by Section 307.1 of this title, together pursuant to a
144	144	videoconference. Meeting shall not include informal gather ings of a
145	145	majority of the members of the public body when no business of t he
146	146	public body is discusse d;
147	147	3. "Regularly scheduled meeting " means a meeting at which the
148	148	regular business of the public body is conducted;
149	149	4. "Special meeting" means any meeting of a public body other
150	150	than a regularly scheduled meeting or emergency mee ting;
151	151	5. "Emergency meeting" means any meeting called for the purpose
152	152	of dealing with an emergency. For purposes of the Oklahoma Open
153	153	Meeting Act, an emergency is defined as a situ ation involving injury
154	154	to persons or injury and damage to public or person al property or
155	155	immediate financial loss when the time requirements for pub lic
156	156	notice of a special meeting would make such procedure impractical
157	157	and increase the likelihood of injury or damage or immediate
158	158	financial loss;
159	159	6. "Continued or reconvened meetin g" means a meeting which i s
160	160	assembled for the purpose of finishing busines s appearing on an
161	161	agenda of a previous meeting. For the purposes of the Oklahoma Open
162	162	Meeting Act, only mat ters on the agenda of t he previous meeting at

190	190	at a continued or reconvened meetin g;
191	191	7. "Videoconference" means a conference among members of a
192	192	public body remote from one another who are l inked by interactive
193	193	telecommunication devices or technology and/or techno logy permitting
194	194	both visual and auditory communication between and among m embers of
195	195	the public body and/or between and among members of the public body
196	196	and members of the public. Du ring any videoconferenc e, both the
197	197	visual and auditory communications func tions shall attempt to be
198	198	utilized; and
199	199	8. "Teleconference" means a conference among members of a
200	200	public body remote from one another who are linked by
201	201	telecommunication devices and /or technology permitti ng auditory
202	202	communication between and among members of the public body and/or
203	203	between and among members of the public body an d members of the
204	204	public.
205	205	SECTION 2. AMENDATORY 51 O.S. 2021, Section 24A.3, is
206	206	amended to read as follows :
207	207	Section 24A.3 As used in the Oklahoma Open Recor ds Act:
208	208	1. "Record" means all documents, including, but not limited to,
209	209	any book, paper, photograph, microfilm, data files created by or
210	210	used with computer software, computer tape, di sk, record, sound
211	211	recording, film recording, video record or other mater ial regardless
212	212	of physical form or characteristic, created by, received b y, under

240	240	of public officials, public bodies , or their representatives in
241	241	connection with the transaction of public business, the expenditure
242	242	of public funds or the administering of public property. "Record"
243	243	does not mean:
244	244	a. computer software,
245	245	b. nongovernment personal effects,
246	246	c. unless public disclosure is required by other laws or
247	247	regulations, vehicle movement reco rds of the Oklahoma
248	248	Transportation Authority obtained in connection with
249	249	the Authority's electronic toll collection system,
250	250	d. personal financial information, credit reports or
251	251	other financial data obtained by or submitted to a
252	252	public body for the purpose of evaluating credit
253	253	worthiness, obtaining a license, permit, or for the
254	254	purpose of becoming qualified to contract with a
255	255	public body,
256	256	e. any digital audio/video recordings of the toll
257	257	collection and safeguarding activities of the Oklahoma
258	258	Transportation Authority,
259	259	f. any personal information provided by a guest at any
260	260	facility owned or operated by the Oklahoma Tourism and
261	261	Recreation Department or the Board of Trustees of the
262	262	Quartz Mountain Arts and Conference Center and Nature

290	290	purchaser of a product sold by or through the Okla homa
291	291	Tourism and Recreation Department or the Quartz
292	292	Mountain Arts and Conference Center and Nature Park,
293	293	g. a Department of Defense Form 214 (DD Form 214) filed
294	294	with a county clerk, including any DD Form 214 filed
295	295	before July 1, 2002, or
296	296	h. except as provided for in Section 2 -110 of Title 47 of
297	297	the Oklahoma Statutes,
298	298	(1) any record in connection with a Motor Vehic le
299	299	Report issued by the Department of Public Safety,
300	300	as prescribed in Section 6-117 of Title 47 of the
301	301	Oklahoma Statutes, or
302	302	(2) personal information within driver records, as
303	303	defined by the Driver 's Privacy Protection Act,
304	304	18 United States Code, Sections 2721 through
305	305	2725, which are stored and maintained by the
306	306	Department of Public Safety;
307	307	2. "Public body" shall include, but not be limited to, an y
308	308	office, department, board, bureau, commission, agency, trusteeship,
309	309	authority, council, committee, including a committee of either
310	310	chamber of the Legislature, trust or any entity cr eated by a trust,
311	311	county, city, village, town, township, district, school district,
312	312	fair board, court, executive office, advisory group, task force,

340	340	part by public funds or entrusted with th e expenditure of public
341	341	funds or administering or operating public proper ty, and all
342	342	committees, or subcommittees thereof. Except for the records
343	343	required by Section 24A.4 of this tit le, "public body" does not mean
344	344	judges, justices, or the Council on Judicial Complaints, the
345	345	Legislature, or legislators;
346	346	3. "Public office" means the physical location where public
347	347	bodies conduct business or keep records;
348	348	4. "Public official" means any official or employee of any
349	349	public body as defined herein; and
350	350	5. "Law enforcement agency" means any public body charged with
351	351	enforcing state or lo cal criminal laws and initiating criminal
352	352	prosecutions, including, but not limited to, police departments,
353	353	county sheriffs, the D epartment of Public Safety, the Oklahoma State
354	354	Bureau of Narcotics and Danger ous Drugs Control, the Alcoholic
355	355	Beverage Laws Enforcement Commission, and the Oklahoma State Bureau
356	356	of Investigation.
357	357	SECTION 3. This act shall become effective November 1, 2022.
