26156 BE IT ENACTED BY THE PEOPLE OF THE STATE O F OKLAHOMA:

28157 SECTION 1. AMENDATORY 43A O.S. 2021, Section 2-111, is
29158 amended to read as follows:

31159 Section 2-111. A. 1. The Board of Mental Health and Substance
32160 Abuse Services is hereby authorized and di rected to create a trust
33161 into which all real property held by o r for the benefit of the
34162 Department of Mental Health and Substa nce Abuse Services shall be
35163 transferred.

37164 2. The trust shall provide that:

39165 a. the property placed into the trust may never be sold ,
40166 except for the tracts specif ically described in
41167 subparagraph c of this paragraph, if it is determined

43195 Trust and by the Department that such a sale is in the
44196 best interests of the Department, and then the
45197 proceeds shall be used exclus ively for tangible

48200 be held in perpetuity for the sole benefit of the

54205 rentals shall be payable to the Department for use by
55206 the Department to fulfill the purposes of the
56207 Department, except as provided in s ubparagraph d of

112306 B. Upon the creation of the trust authorized i n subsection A of
113307 this section, the Office of Management and En terprise Services is
114308 directed to provide all necessary assistance to the Department of
115309 Mental Health and Substance Abuse Services to identify and transfer
116310 all property held by or for the benefi t of the Department of Mental
117311 Health and Substance Abuse Servic es to the trust. Except as
118312 provided in subsection C of this section, the Office of Management
119313 and Enterprise Services is authoriz ed and directed to provide all
120314 requested assistance to the Depa rtment of Mental Health and
121315 Substance Abuse Services in leasing property placed in such trust.

123342 C. The Commissioners of the Land Office are authorized and
