40	40	An Act relating to cities and towns; amending 11 O.S.
41	41	2021, Section 41-101, which relates to survey and
42	42	plat for subdivisions or propose d municipality;
43	43	establishing that a preliminary or final plat
44	44	application in conformity to zoning, engineering
45	45	codes, ordinances, regulations , and criteria shall be
46	46	approved; mandating approval for application
47	47	variances or exemptions that do not result in harm to
48	48	public health, safety, or general welfare; and
49	49	providing an effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 11 O.S. 2021, Section 41-101, is
56	56	amended to read as follows :
57	57	A person intending to lay out a municipality or an addition or
58	58	subdivision shall cause a survey and plat to be made of the land
59	59	which is to be laid out. The plat shall particularly d escribe and
60	60	set forth all streets, alleys, easements, commons or public g rounds,
61	61	all lots and blocks, and fractional lots within or adjoining the
62	62	land, and give their names, width, courses, boundaries, and extent.
63	63	If an application for preliminary or final plat is submitted i n
64	64	conformity to the applicable property 's zoning designation and to

91	91	the municipality's adopted subdivision and engineering codes,
92	92	ordinances, regulations, and criteria, then the application shall be
93	93	approved. Further, if any variances or exemptions to the
94	94	municipality's adopted subdivision and engineering codes,
95	95	ordinances, regulati ons, or criteria are requested by the
96	96	application of such preliminary or final plat, such variances or
97	97	exemptions shall be approved if there are not reasonably verifiable
98	98	and objective facts to support a determination that the p roposed
99	99	variances or exempti ons will result in harm to the public 's health,
100	100	safety, or general welfare .
101	101	SECTION 2. This act shall become effective November 1, 2022.
