4040 An Act relating to cities and towns; amending 11 O.S.
4141 2021, Section 43-103, which relates to buildings and
4242 zoning; clarifying the procedure for when a conflict
4343 exists between municipal zoning laws and
4444 comprehensive plans; specifying that comprehensive
4545 plans shall not be legally binding ; establishing that
4646 applications for rezoning that conform to
4747 comprehensive plans shall be approved except in
4848 specified instances; and providing an effective date.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 11 O.S. 2021, Section 43-103, is
5656 amended to read as follows :
5757 Section 43-103. A. Municipal regulations as to buildings,
5858 structures and land shall be made in accordance with a comprehensive
5959 plan and be designed to accomplish any of the following objectives:
6060 1. To lessen congest ion in the streets;
6161 2. To secure safety from fire, panic and o ther dangers;
6262 3. To promote health and the general welfare, including the
6363 peace and quality of life of the district;
6464 4. To provide adequate light and air;

9191 5. To prevent the overcrowding of l and;
9292 6. To promote historical p reservation;
9393 7. To avoid undue concentration of population; or
9494 8. To facilitate the adequate provision of transportation,
9595 water, sewerage, schools, parks and other public requirements. The
9696 regulations shall be made with re asonable consideration, among o ther
9797 things, as to the characte r of the district and its peculiar
9898 suitability for particular uses, and with a view to conserving the
9999 value of buildings and encouraging the most appropriate use of land
100100 throughout the municipal ity. The governing body shall provide the
101101 manner in which regulations, restrictions and district boundaries
102102 shall be determined, established and enforced, and amended,
103103 supplemented or changed .; or
104104 B. Where a conflict exists between application of a
105105 municipality's zoning laws or regulation s and the municipality 's
106106 comprehensive plan, the zoning laws and regulations shall prevail
107107 over the comprehensive plan . A comprehensive plan shall not be
108108 legally binding. A comprehensive plan shall be considered a
109109 flexible plan that is merely a guide and advisory in nature.
110110 Further, if an application for rezoning is presented to a
111111 municipality and the proposed rezoning requests land use
112112 designations for the property that are in conformity to the land use
113113 designations in the municipality 's adopted comprehensive plan, and
114114 there are no reasonably verifiable and objective facts to support a

141141 determination that the aspects of the proposed rezoning s other than
142142 its land use designations will result in harm to the public 's
143143 health, safety, or general welfare, then the rezoning application
144144 shall be approved.
145145 SECTION 2. This act shall become effective November 1, 2022.
