5958 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6059 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -145.8, is
6160 amended to read as follows:
6261 Section 3-145.8 A. It shall be the duty of each virtual
6362 charter school approved and sponsored by the Statewide Virtual
6463 School Board pursuant to the provisions of Section 3 -145.3 of Title
6564 70 of the Oklahoma Sta tutes this title to keep a full and complete
6665 record of the attend ance of all students enrolled in the v irtual
6766 charter school in one of the s tudent information systems approved by

9795 B. By July 1, 2020, the governing body o f each virtual charter
9896 school shall adopt an attendance policy. The policy may allow
9997 attendance to be a proportional amount of the required attendance
10098 policy provisions based upon the date of enrollmen t of the student.
10199 The attendance policy shall include the following provisions:
102100 1. The first date of attendance and membership shall be the
103101 first date the student completes an instructional activity.
104102 2. A student who attends a virtual charter school sha ll be
105103 considered in attendance for a quarter if the st udent:
106104 a. completes instructional acti vities on no less than
107105 ninety percent (90%) of the days within the quarter,
108106 b. is on pace for on-time completion of the course as
109107 defined by the governing board of the virtual charter
110108 school, or
111109 c. completes no less th an seventy-two instructional
112110 activities within the quarter of the academic year.
113111 3. For a student who does not meet any of the criteria set
114112 forth in paragraph 1 or 2 of this subsection, the amount of
115113 attendance recorded shall be the greater of:
116114 a. the number of school days during which the st udent
117115 completed the instructional act ivities during the
118116 quarter,

146143 b. the number of school days proportional to the
147144 percentage of the course that has been completed, or
148145 c. the number of school days proportional to the
149146 percentage of the required minimum numbe r of completed
150147 instructional activiti es during the quarter.
151148 C. For the purposes of this section, "instructional activities "
152149 shall include instructional meetings wi th a teacher, completed
153150 assignments that are used to r ecord a grade for a student that is
154151 factored into the student's grade for the semester during which the
155152 assignment is completed, testing and school -sanctioned field trips,
156153 and orientation.
157154 D. A student enrolled in a virtual charter school alternative
158155 education program designated by the State Department of Education
159156 who attends a full abbreviated school day shall be counted in full
160157 attendance for purposes of computing the average daily attendance
161158 and average daily me mbership of the virtual charter school . For the
162159 purposes of this subsection, "full abbreviated school day" shall
163160 mean one hundred eighty-nine (189) hours per quarter or seven
164161 hundred fifty-six (756) hours per school year.
165162 E. Each statewide virtual charter school approved and sponsored
166163 by the Statewide Virtual Charter School Board p ursuant to the
167164 provisions of Section 3-145.3 of this title shall offer a student
168165 orientation, notify the parent or legal guardian and each student
169166 who enrolls in that school of the requirement to participate in the

197193 student orientation, and require all stud ents enrolled to complete
198194 the student orientation prior to completing any other instructional
199195 activity. The Statewide Virtual Charter School Board shall
200196 promulgate rules to develop materials for orientation.
201197 E. F. Any student that who is behind pace and does not complete
202198 an instructional activity for a fifteen-school-day period (15)
203199 consecutive days, including weekends, shall be withdrawn for
204200 truancy. The virtual charter schoo l shall submit a notification to
205201 the parent or legal guardian of a student who has been withdrawn for
206202 truancy or is approaching truancy.
207203 F. A G. 1. Except as provid ed in paragraph 2 of this
208204 subsection, a student who is reported for truancy two times in the
209205 same school year shall be withdrawn a nd prohibited from enrolling in
210206 the same virtual charter school for the rem ainder of the school
211207 year.
212208 G. 2. If a student is enrolled in a virtual charter school
213209 alternative education program designated by the State Depart ment of
214210 Education, the virtual charter school may request a waiver of the
215211 enrollment prohibition from the Department on behalf of a student
216212 enrolled at the virtual charter school who is reported for truancy
217213 two times in the same school year. The office of accreditation
218214 shall review the waiver request and determine whet her the student
219215 should be allowed to con tinue attending the virtual charter school.

248243 while the waiver is being re viewed and until a final de termination
249244 is made.
250245 H. The governing body of each statewide virtual charter school
251246 shall develop, adopt and post on the school's website a policy
252247 regarding consequences for a student 's failure to attend school and
253248 complete instructional activities. The policy shall s tate, at a
254249 minimum, that if a student fails to consistently attend school a nd
255250 complete instructional activities after receiving a notification
256251 pursuant to subsection E F of this section and reasonable
257252 intervention strategies have been implemented, a studen t shall be
258253 subject to certain conseque nces including withdrawal from the sc hool
259254 for truancy.
260255 H. I. If a statewide virtual charter school withdraws a student
261256 pursuant to subsections F and G and H of this section, the vi rtual
262257 charter school shall immediatel y notify the student 's resident
263258 district in writing of the student's disenrollment.
264259 I. J. The provisions of subsections F, G and, H and I of this
265260 section shall not be in effect until the implementation of
266261 subsection H of Sect ion 3-145.3 of this title.
267262 J. K. The Statewide Virtual Charter Scho ol Board may promulgate
268263 rules to implement the provisions of th is section.
269264 SECTION 2. This act shall become effective November 1, 2022.
