59	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	55		SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.189, is
61	56		amended to read as follows:
62	57		Section 1210.189 A. A board of education of a public school
63	58		district or a technology center school district, the board of
64	59		regents of an institution within The Oklahoma State System of Higher
65	60		Education, the governing board of a private postsecondary
66	61		educational institution, the Oklahoma State Regents for Higher
	62	+	Education, the State Board of Education or the State Board of Career
	63	+	and Technology Education shall not:

94		-	Education, the State Board of Education or the State Board of Career
95		-	and Technology Education shall not:
96	90		1. Require a vaccination against Coronavirus dise ase 2019
97	91		(COVID-19) as a condition of admittance to or attendance of the
98	92		school or institution;
99	93		2. Require a vaccine passport as a co ndition of admittance to
100	94		or attendance of the school or instit ution; or
101	95		3. Implement a mask mandate for students who have not been
102	96		vaccinated against COVID-19.
103	97		B. As used in this section, "vaccine passport" means
104	98		documentation that an individual has bee n vaccinated against COVID-
105	99		19.
106	100		C. Nothing in this section shal l be construed to apply to any
107	101		public or private healthcare se tting.
108	102		D. A sheriff of any county shall have autho rity to make an
109	103		arrest of any person, including , but not limited to, a
110	104		superintendent, principal, administrator, teacher, school nurse,
111	105		board member of the education district, university staff, or other
112	106		school staff for violating this section.
113	107		SECTION 2. NEW LAW A new section of law to be codified
114	108		in the Oklahoma Statutes as Section 9000 of Title 70, unless there
115	109		is created a duplication in numbering, reads as follows:
116	110		A. Any person, including , but not limited to, a superintendent,
117	111		principal, administrator, teacher, school nurse, board member of the
	112	+	education district, university s taff, or other school staff shall

147	140		1. Require a vaccination against COVID-19 as a condition of

152	145		vaccinated against COVID-19.
153	146		B. The sheriff of a county shall have the authority to m ake an
154	147		arrest of any person, including, but not limited to, a
155	148		superintendent, principal, administrator, teacher, school nurse,
156	149		board member of the education district, university staff, or other
157	150		school staff for violating this section.
158	151		C. Any person who directly or in directly violates any provision
159	152		of this section shall be guilty of a misdemeanor pu nishable by a
160	153		fine of Five Hundred Dollars ($500.00) for the first offense, and a
161	154		fine of Five Hundred Dollars ($500.00) for the second offense a nd/or
162	155		not more than ten (10) days in the local county jail .
163	156		D. Nothing in this section shall be construed to apply to a ny
164	157		public or private health care setting.
165	158		SECTION 3. AMENDATORY 70 O.S. 2021, Section 1210.190, is
166	159		amended to read as follows:
167	160		Section 1210.190 A. A board of education of a public school
168	161		district or a technology center scho ol district may only implement a
	162	+	mandate to wear a mask or any other medical device as provided in
	163	+	this subsection.

198	190		1. A board of education of a public sc hool district or a
199	191		technology center school distric t may only implement a ma ndate to
200	192		wear a mask or any other medical device after consultation with the
201	193		local county health department or city-county health departm ent
202	194		within the jurisdiction of where the board is located and when the
203	195		jurisdiction of where the board is located is un der a current state
204	196		of emergency declared by the Governor.
205	197		2. The mandate shall explicitly list the purposes for the
206	198		mandate.
207	199		3. The mandate shall reference the speci fic masks or medical
208	200		devices that would meet the requirements of th e mandate.
209	201		4. Any mandate to implement wearin g a mask or any other medical
210	202		device shall be reconsidered at each regularly scheduled board
211	203		meeting.
212	204		B. A sheriff of any county shall have autho rity to make an
213	205		arrest of any person, including , but not limited to, a
214	206		superintendent, principal, administrator, teacher, school nurse,
215	207		board member of the education district, university staff, or other
216	208		school staff for violating this section.
217	209		SECTION 4. It being immediately necessary for the preservation
218	210		of the public peace, health or safety, an emergency is hereby
