5954 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6055 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.189, is
6156 amended to read as follows:
6257 Section 1210.189 A. A board of education of a public school
6358 district or a technology center school district, the board of
6459 regents of an institution within The Oklahoma State System of Higher
6560 Education, the governing board of a private postsecondary
6661 educational institution, the Oklahoma State Regents for Higher

94-Education, the State Board of Education or the State Board of Career
95-and Technology Education shall not:
9690 1. Require a vaccination against Coronavirus dise ase 2019
9791 (COVID-19) as a condition of admittance to or attendance of the
9892 school or institution;
9993 2. Require a vaccine passport as a co ndition of admittance to
10094 or attendance of the school or instit ution; or
10195 3. Implement a mask mandate for students who have not been
10296 vaccinated against COVID-19.
10397 B. As used in this section, "vaccine passport" means
10498 documentation that an individual has bee n vaccinated against COVID-
10599 19.
106100 C. Nothing in this section shal l be construed to apply to any
107101 public or private healthcare se tting.
108102 D. A sheriff of any county shall have autho rity to make an
109103 arrest of any person, including , but not limited to, a
110104 superintendent, principal, administrator, teacher, school nurse,
111105 board member of the education district, university staff, or other
112106 school staff for violating this section.
113107 SECTION 2. NEW LAW A new section of law to be codified
114108 in the Oklahoma Statutes as Section 9000 of Title 70, unless there
115109 is created a duplication in numbering, reads as follows:
116110 A. Any person, including , but not limited to, a superintendent,
117111 principal, administrator, teacher, school nurse, board member of the
112+education district, university s taff, or other school staff shall

147140 1. Require a vaccination against COVID-19 as a condition of

153146 B. The sheriff of a county shall have the authority to m ake an
154147 arrest of any person, including, but not limited to, a
155148 superintendent, principal, administrator, teacher, school nurse,
156149 board member of the education district, university staff, or other
157150 school staff for violating this section.
158151 C. Any person who directly or in directly violates any provision
159152 of this section shall be guilty of a misdemeanor pu nishable by a
160153 fine of Five Hundred Dollars ($500.00) for the first offense, and a
161154 fine of Five Hundred Dollars ($500.00) for the second offense a nd/or
162155 not more than ten (10) days in the local county jail .
163156 D. Nothing in this section shall be construed to apply to a ny
164157 public or private health care setting.
165158 SECTION 3. AMENDATORY 70 O.S. 2021, Section 1210.190, is
166159 amended to read as follows:
167160 Section 1210.190 A. A board of education of a public school
168161 district or a technology center scho ol district may only implement a
162+mandate to wear a mask or any other medical device as provided in
163+this subsection.

196-mandate to wear a mask or any other medical device as provided in
197-this subsection.
198190 1. A board of education of a public sc hool district or a
199191 technology center school distric t may only implement a ma ndate to
200192 wear a mask or any other medical device after consultation with the
201193 local county health department or city-county health departm ent
202194 within the jurisdiction of where the board is located and when the
203195 jurisdiction of where the board is located is un der a current state
204196 of emergency declared by the Governor.
205197 2. The mandate shall explicitly list the purposes for the
206198 mandate.
207199 3. The mandate shall reference the speci fic masks or medical
208200 devices that would meet the requirements of th e mandate.
209201 4. Any mandate to implement wearin g a mask or any other medical
210202 device shall be reconsidered at each regularly scheduled board
211203 meeting.
212204 B. A sheriff of any county shall have autho rity to make an
213205 arrest of any person, including , but not limited to, a
214206 superintendent, principal, administrator, teacher, school nurse,
215207 board member of the education district, university staff, or other
216208 school staff for violating this section.
217209 SECTION 4. It being immediately necessary for the preservation
218210 of the public peace, health or safety, an emergency is hereby
