5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 63 O .S. 2021, Section 427.3, is
5252 amended to read as follo ws:
5353 Section 427.3 A. There is hereby created the Oklahoma Medical
5454 Marijuana Authority within the State Department of Health which
5555 shall address issues related to the medical marijuana program in
5656 Oklahoma including, but not limited to, the issuance of pat ient
5757 licenses and medical marijuana business licens es, and the
5858 dispensing, cultivating, processing, testing, transporting, storage,
5959 research, and the use of and sale of medical marijuana pursuant t o
6060 the Oklahoma Medical Marijuana and Patient Protection Act .

8787 B. The Department shall provide support staff to perform
8888 designated duties of the Authority . The Department shall also
8989 provide office space for meetings of the Authority.
9090 C. The Department shall im plement the provisions o f the
9191 Oklahoma Medical Marijua na and Patient Protection Act consistently
9292 with the voter-approved State Question No. 788, Initiative Petition
9393 No. 412, subject to the provisions o f the Oklahoma Medical Marijuana
9494 and Patient Protection Act.
9595 D. The Department shall exercise its respective powers and
9696 perform its respective duties and funct ions as specified in the
9797 Oklahoma Medical Marijuana and Patient Protection Act and this title
9898 including, but not limited to, the following:
9999 1. Determine steps the state shall take, whether administrative
100100 or legislative in nature, to ensure that research o n marijuana and
101101 marijuana products is being conducted for public purposes, including
102102 the advancement of:
103103 a. public health policy and public safety poli cy,
104104 b. agronomic and horticultural best practices, an d
105105 c. medical and pharmacopoeia best practices;
106106 2. Contract with third-party vendors and other governmental
107107 entities in order to carry out the respective duties and functions
108108 as specified in the Oklahoma Medical Marijuana and Patient
109109 Protection Act;

136136 3. Upon complaint or upon its own motion and upon a compl eted
137137 investigation, levy fines as prescribed i n applicable laws, rules
138138 and regulations and suspend, revoke, or not renew licenses pursuant
139139 to applicable laws, rules, and regulations;
140140 4. Issue subpoenas for the appearance or production of persons,
141141 records, and things in connection with disciplinary or contested
142142 cases considered by the Department;
143143 5. Apply for injunctive or declaratory relief to enforce t he
144144 provisions of applicable laws, rules , and regulations;
145145 6. Inspect and examine all licensed premises of medical
146146 marijuana businesses, research facilities , education facilities and
147147 waste disposal facilities in which medical marijuana is cultivated,
148148 manufactured, sold, stored, transported, tested , distributed, or
149149 disposed of;
150150 7. Upon action by the federal government by which the
151151 production, sale, and use of marijuana in Oklahoma does not violate
152152 federal law, work with the Oklahoma State Banking Department and the
153153 State Treasurer to develop good practice s and standards for banking
154154 and finance for medical mar ijuana businesses;
155155 8. Establish internal control procedures for licenses including
156156 accounting procedures, reporting procedures and personnel policies;
157157 9. Establish a fee schedule and collect fees f or performing
158158 background checks as the Commissioner deems appropriate. The fees

185185 charged pursuant to this paragraph shall not exceed the actual cost
186186 incurred for each background check;
187187 10. Establish a fee schedule and collect fees for material
188188 changes requested by the licensee; and
189189 11. Establish regulations , which require a medical marijuana
190190 business to submit information to the Oklahoma Medical Marijuana
191191 Authority, deemed reasonably necessary to assist the Authority in
192192 the prevention of diversion of m edical marijuana by a licensed
193193 medical marijuana business . Such information required by the
194194 Authority may include, but shall not be limited to:
195195 a. the square footage of the licensed premise s,
196196 b. a diagram of the licensed premises,
197197 c. the number and type of lights at the licensed medical
198198 marijuana commercial growe r business,
199199 d. the number, type and production capacity of equipment
200200 located at the medical marijuana processing facility,
201201 e. the names, addresses and t elephone numbers of
202202 employees or agents of a medical marijuana business,
203203 f. employment manuals and stand ard operating procedures
204204 for the medical marijuana business, and
205205 g. any other information as the Authority reasonably
206206 deems necessary; and
207207 12. Declare and establish a temporary moratorium on the
208208 approval and issuance of new medical marijuana business licenses,

236236 the Authority determines necessary.
237237 SECTION 2. It being immediately necessary for the preservation
238238 of the public peace, health or safety, an emergency is hereby
239239 declared to exist, by reason whereof this act shall take effect and
240240 be in full force from and after its passage an d approval.
