4740 An Act relating to alcoholic beverages; amending 37A
4841 O.S. 2021, Section 7 -102, which relates to cocktails-
4942 to-go definitions; expandi ng the meaning of original

5245 to the requirements for cocktails -to-go; modifying
5346 requirements to sell cocktails-to-go; and providing

5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6053 SECTION 1. AMENDATORY 37 A O.S. 2021, Section 7 -102, is
6154 amended to read as follows:
6255 Section 7-102. As used in this act:
6356 1. "Cocktail" or "mixed drink" means any beverage obtained by
6457 combining ingredients alcoholic in nature, whether b rewed,
6558 fermented, or distilled, with ingredients nonalcoholic in nature,
6659 such as fruit juice, lemonade, cream or a carbonated beverage;
60+2. "Single-serve wine" means a bottle or sealed contain er,
61+containing seven (7) fluid ounces, or less, of wine;
62+3. "Original container" means, for the purposes of this act
63+only, a container that is filled, sealed and secured with a tamper-

94-2. "Single-serve wine" means a bottle or sealed contain er,
95-containing seven (7) fluid ounces, or less, of wine;
96-3. "Original container" means, for the purposes of this act
97-only, a container that is filled, sealed and secured with a tamper-
9890 evident lid or cap by the original manufacturer of the mixed drink
9991 or by a mixed beverage licensee 's or caterer licensee 's employee at
10092 the mixed beverage licensee's or caterer licensee 's location with a
10193 tamper-evident lid or cap;
10294 4. "Sealed container" means a rigid container that contains a
10395 mixed drink, is new, has never bee n used, has a secured lid or cap
10496 designed to prevent consumption without removal of the lid or cap
10597 and is tamper evident. Sealed container does not include a
10698 container with a lid with sipping holes or openings for straws or a
10799 container made of plastic, pa per or polystyrene foam; and
108100 5. "Tamper evident" means a lid or cap that has been sealed
109101 with tamper-evident covers, including, but not limited to, wax dip
110102 or heat-shrink wrap.
111103 SECTION 2. AMENDATORY 37 A O.S. 2021, Section 7 -103, is
112104 amended to read as follows:
113105 Section 7-103. A cocktail, mixed drink or single-serve wine
114106 placed in a sealed container by a mixed beverage licensee at the
115107 mixed beverage licensee 's or caterer licensee 's location in its
116108 original container may be transferred and sold for off-premises
117109 consumption if the following requir ements are met:
110+1. The cocktail, mixed beverage or single -serve wine is
111+transferred within the licensed premises by a curbside pickup or by
112+delivery by an employee of the retail licensee who:
113+a. is at least twenty-one (21) years of age, and

145-1. The cocktail, mixed beverage or single -serve wine is
146-transferred within the licensed premises by a curbside pickup or by
147-delivery by an employee of the retail licensee who:
148-a. is at least twenty-one (21) years of age, and
149140 b. upon delivery, verifies the age of the person to whom
150141 the cocktail is being delivered;
151142 2. If the employee delivering the cocktail, mixed drink or
152143 single-serve wine is not able to safely verify a person 's age or
153144 level of intoxication upon delivery, the employee shall cancel the
154145 sale of alcohol and ret urn the product to the retail license holder;
155146 3. The sealed container is placed in the trunk of the vehicle
156147 or, if there is no trunk, in the vehicle 's rear compartment that is
157148 not readily accessible to the passenger area ; and
158149 4. The In the case of a mixe d drink sealed by the mixed
159150 beverage or caterer licensee, the sealed container shall be affixed
160151 with a label or tag that contains the following information:
161152 a. the cocktail, mixed drink or single -serve wine
162153 ingredients, type and name of the alcohol,
163154 b. the name, license number and address of the mixed
164155 beverage licensee or caterer licensee who filled the
165156 original container and sold the product,
166157 c. the volume of the cocktail, mixed drink or single -
167158 serve wine in the sealed co ntainer, and
159+d. verification that the sealed container was filled less
160+than seven (7) days before the date of sale ; and
161+5. In the case of a mixed drink in its original container from
162+the original manufacturer of the mixed drink, the Oklahoma -

195-d. verification that the sealed container was filled less
196-than seven (7) days before the date of sale ; and
197-5. In the case of a mixed drink in its original container from
198-the original manufacturer of the mixed drink, the Oklahoma -
199189 registered label shall not be tampered with, modified, or otherwise
200190 changed.
201191 SECTION 3. This act shall become effective November 1, 2022.
