4040 An Act relating to teachers; amending 70 O.S. 2021,
4141 Section 6-108, which relates to prohibition on

4343 exception for teachers who provide virtual
4444 instruction to secondary students ; and providing an

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 70 O.S. 2021, Sectio n 6-108, is
5252 amended to read as follows:
5353 Section 6-108. A. Except as provided in subsection B of this
5454 section and except for service as a director of a public
5555 developmental research school and service by a faculty member of a
5656 higher education institution affiliated with a public developmental
5757 research school as specifically authorized in this act and except as
5858 provided for in Section 6 -101 of this title, it shall be unlawful
5959 for any person to serve, or to contract or agree to serve, as
6060 superintendent, elem entary superintendent, principal, superviso r,
6161 librarian, school nurse, classroom teacher or other instructional,
6262 supervisory or administrative employee of a school district unless

8989 the person holds a valid certificate of qualification issued in
9090 accordance with the rules of the State Board of Educat ion to perform
9191 the services the person performs or contracts or agrees to perform.
9292 The State Board of Education shall provide for the certificatio n of
9393 elementary superintendents.
9494 B. Any person may serve, or contract, or agree to serve,
9595 without a valid certificate of qualification issued in accordance
9696 with the rules of the State Board of Educat ion if the person is only
9797 providing virtual instruction to secondary students enrolled in a
9898 public school district.
9999 SECTION 2. This act shall become effective November 1, 2022.
