40	40	An Act relating to teachers; amending 70 O.S. 2021,
41	41	Section 6-108, which relates to prohibition on
42	42	teaching without a valid certificate; providing an
43	43	exception for teachers who provide virtual
44	44	instruction to secondary students ; and providing an

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 70 O.S. 2021, Sectio n 6-108, is
52	52	amended to read as follows:
53	53	Section 6-108. A. Except as provided in subsection B of this
54	54	section and except for service as a director of a public
55	55	developmental research school and service by a faculty member of a
56	56	higher education institution affiliated with a public developmental
57	57	research school as specifically authorized in this act and except as
58	58	provided for in Section 6 -101 of this title, it shall be unlawful
59	59	for any person to serve, or to contract or agree to serve, as
60	60	superintendent, elem entary superintendent, principal, superviso r,
61	61	librarian, school nurse, classroom teacher or other instructional,
62	62	supervisory or administrative employee of a school district unless

89	89	the person holds a valid certificate of qualification issued in
90	90	accordance with the rules of the State Board of Educat ion to perform
91	91	the services the person performs or contracts or agrees to perform.
92	92	The State Board of Education shall provide for the certificatio n of
93	93	elementary superintendents.
94	94	B. Any person may serve, or contract, or agree to serve,
95	95	without a valid certificate of qualification issued in accordance
96	96	with the rules of the State Board of Educat ion if the person is only
97	97	providing virtual instruction to secondary students enrolled in a
98	98	public school district.
99	99	SECTION 2. This act shall become effective November 1, 2022.
