5747 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
5848 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.4 , is
5949 amended to read as follows:
6050 Section 427.4 A. The Oklahoma Medical Marijuana Authority, in
6151 conjunction with the State Department of Health, shall employ an
6252 Executive Director and other personnel as necessary to assist the
6353 Authority in carrying out its duties.
6454 B. The Authority shall not employ an indiv idual if any of the
6555 following circumstances exist:
56+1. The individual has a direct or indirect interest in a
57+licensed medical marijuana business; or
58+2. The individual or his or her spouse, parent, child, spouse
59+of a child, sibling, or spouse of a sibling has an application for a

93-1. The individual has a direct or indirect interest in a
94-licensed medical marijuana business; or
95-2. The individual or his or her spouse, parent, child, spouse
96-of a child, sibling, or spouse of a sibling has an application for a
9786 medical marijuana business l icense pending before the Department
9887 Authority or is a member of the board of directors of a medical
9988 marijuana business, or is an indi vidual financially interested in
10089 any licensee or medical marijuana bu siness.
10190 C. All officers and employees of the Authori ty shall be in the
10291 exempt unclassified service as provided for in Section 840 -5.5 of
10392 Title 74 of the Oklahoma Statutes.
10493 D. The Commissioner may delegate to any offic er or employee of
10594 the Department Authority any of the powers of the Executive Director
10695 and may designate any officer or employee of the Department
10796 Authority to perform any of the duties of the Executi ve Director.
10897 E. The Executive Director shal l be authorized to sug gest rules
10998 governing the oversight an d implementation of the Oklahoma Medical
11099 Marijuana and Patient Protection Act.
111100 F. The Department Authority is hereby authorized to create
112101 employment positions n ecessary for the implementation of its
113102 obligations pursuant to the Oklahoma Medical Marijuana a nd Patient
114103 Protection Act including, but not limited to, Authority
115104 investigators and a senior director of enforcement . The Department
116105 and the Authority, the senior director of enforcement, the Executive
106+Director, and Department investigators of the Authority shall have
107+all the powers and authority of any a peace officer of this state
108+for the purpose of enforcing the provi sions of the Oklahoma Medical
109+Marijuana and Patient Protection Ac t, rules promulgated by the

144-Director, and Department investigators of the Authority shall have
145-all the powers and authority of any a peace officer of this state
146-for the purpose of enforcing the provi sions of the Oklahoma Medical
147-Marijuana and Patient Protection Ac t, rules promulgated by the
148136 Executive Director, or criminal laws of this state. These powers
149137 shall include, but are not limited to:
150138 1. Investigate Investigating violations or suspected violations
151139 of the Oklahoma Medical Marijuana and Patient Protection Act and,
152140 any rules promulgated pursu ant thereto, and any violations of
153141 criminal laws of this state discovered through the cour se of such
154142 investigations;
155143 2. Serve Serving all warrants, summonses, subpoenas,
156144 administrative citations, notices or and all other processes
157145 relating to the enforcem ent of laws regulating medical marijuana,
158146 marijuana concentrate, and medical marijuana product;
159147 3. Assist Seizing any marijuana or marijuana product held in
160148 violation of the Oklahoma Medical Mari juana and Patient Protection
161149 Act, any other laws of this state, or any rules promulgated by the
162150 Executive Director;
163151 4. Assisting or aid aiding any law enforcement officer in the
164152 performance of his or her duties upon such law enforcement officer 's
165153 request or the request of other local officials having jurisdiction;
166154 4. Require 5. Referring any evidence, repor ts, or charges
167155 regarding violations of any provision of the Oklahoma Medical
156+Marijuana and Patient Protection Act that carry criminal penalties,
157+or any other criminal laws of this state , to the appropriate law
158+enforcement authority and prosecutorial a uthority for action;

195-Marijuana and Patient Protection Act that carry criminal penalties,
196-or any other criminal laws of this state , to the appropriate law
197-enforcement authority and prosecutorial authority for action;
198185 6. Aiding the enforcement authorities of this state or any
199186 county or municipality of the s tate, or the federal government, in
200187 prosecutions of violations of the Oklahoma Medical Marijuana and
201188 Patient Protection Act or any other laws of this state that carry
202189 criminal penalties involving crimes discovered during the
203190 investigation of violations or suspected viol ations of the Oklahoma
204191 Medical Marijuana and Patient Protection Act, or any rules
205192 promulgated pursuant thereto;
206193 7. Requiring any business applicant or licensee to permit an
207194 inspection of licensed premises during business hours or at any t ime
208195 of apparent operation, marijuana equipment, and ma rijuana
209196 accessories, or books and r ecords; and to permit the testing of or
210197 examination of medical marijuana, marijuana concentrate, or
211198 marijuana product;
212199 5. Require 8. Requiring applicants and licensees to submit
213200 complete and current applications, information and fees required by
214201 the Oklahoma Medical Mariju ana and Patient Protection Act, the
215202 Oklahoma Medical Marijuana Waste Management Act and Se ctions 420
216203 through 426.1 of this title, and approve material changes made by
217204 the applicant or licensee;
205+6. Require 9. Requiring medical marijuana business licensees
206+to submit a sample or unit of medical marijuana or medical marijuana
207+product to the qualit y assurance laboratory when the Department
208+Authority has reason to believe the medical marijuana or medical

245-6. Require 9. Requiring medical marijuana business licensees
246-to submit a sample or unit of medical marijuana or medical marijuana
247-product to the qualit y assurance laboratory when the Department
248-Authority has reason to believe the medical marijuana or medical
249235 marijuana product may be unsafe for patient consumption or
250236 inhalation or has not been tes ted in accordance with the provisions
251237 of the Oklahoma Medic al Marijuana and Patient Protection Act and the
252238 rules and regulations of the Department promulgated by the Executive
253239 Director. The licensee shall prov ide the samples or units of
254240 medical marijuana or medical marijuana products at its o wn expense
255241 but shall not be responsible for the costs of testing; and
256242 7. Require 10. Requiring medical marijuana business licensees
257243 to periodically submit samples or units of medical ma rijuana or
258244 medical marijuana product s to the quality assurance lab oratory for
259245 quality assurance purposes. Licensed growers, processors,
260246 dispensaries, and transporters shall not be required to submit
261247 samples or units of medical marijuana or medical marijuan a products
262248 more than twice a year. The licensee shall provide the samples or
263249 units of medical marijuana or medical marijuana products at its own
264250 expense but shall not be responsible for the costs of tes ting.
265251 G. All investigators of the Authority shall meet all training
266252 requirements and qualifications for peace officers as required by
267253 Section 3311 et seq. of Title 70 of the Oklahoma Statutes.
254+H. During the course of an investigation, t he director of
255+enforcement or any investigator of the Authority, as provided in
256+subsection F of this section, may arrest a violator or suspected
257+violator of any laws of this state committed in the presence of the
258+director of enforcement or any investigator of the Authority, or

295-H. During the course of an investigation, t he director of
296-enforcement or any investigator of the Authority, as provided in
297-subsection F of this section, may arrest a violator or suspected
298-violator of any laws of this state committed in the presence of the
299-director of enforcement or any investigator of the Authority, or
300285 upon the development of proba ble cause that such crime has been
301286 committed. The director of enforcement and any investigator of the
302287 Authority as provided by subsection F of this section may, upon
303288 request of a sheriff o r another peace office r of this state, or any
304289 political subdivision thereof, assist in the apprehension and arrest
305290 of a violator or suspected vio lator of any of the laws of this
306291 state.
307292 I. The Executive Director may employ or contract with
308293 attorneys, as needed, to adv ise the Executive Director and the
309294 Authority on all legal matte rs and appear for and represent the
310295 Executor Director and the Authority in all administrative hearings
311296 and all litigation or other proceedings which may arise in the
312297 discharge of their duties. At the request of the Executive
313298 Director, such attorneys shall assist district attorneys in
314299 prosecuting charges of violators of the Oklahoma Medical Marijuana
315300 and Patient Protection Act or any other laws of this state carrying
316301 criminal penalties involving crimes discovered during the
317302 investigation of violations or suspected viol ations of the Oklahoma
303+Medical Marijuana and Patient Protection Act or any rules
304+promulgated pursuant thereto.
305+SECTION 2. This act shall become effecti ve November 1, 2022.
