58 | 48 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.4 , is |
---|
59 | 49 | | amended to read as follows: |

60 | 50 | | Section 427.4 A. The Oklahoma Medical Marijuana Authority, in |
---|
61 | 51 | | conjunction with the State Department of Health, shall employ an |
---|
62 | 52 | | Executive Director and other personnel as necessary to assist the |
---|
63 | 53 | | Authority in carrying out its duties. |
---|
64 | 54 | | B. The Authority shall not employ an indiv idual if any of the |
---|
65 | 55 | | following circumstances exist: |
---|
97 | 86 | | medical marijuana business l icense pending before the Department |
---|
98 | 87 | | Authority or is a member of the board of directors of a medical |
---|
99 | 88 | | marijuana business, or is an indi vidual financially interested in |
---|
100 | 89 | | any licensee or medical marijuana bu siness. |

101 | 90 | | C. All officers and employees of the Authori ty shall be in the |
---|
102 | 91 | | exempt unclassified service as provided for in Section 840 -5.5 of |
---|
103 | 92 | | Title 74 of the Oklahoma Statutes. |
---|
104 | 93 | | D. The Commissioner may delegate to any offic er or employee of |
---|
105 | 94 | | the Department Authority any of the powers of the Executive Director |
---|
106 | 95 | | and may designate any officer or employee of the Department |
---|
107 | 96 | | Authority to perform any of the duties of the Executi ve Director. |
---|
108 | 97 | | E. The Executive Director shal l be authorized to sug gest rules |
---|
109 | 98 | | governing the oversight an d implementation of the Oklahoma Medical |
---|
110 | 99 | | Marijuana and Patient Protection Act. |
---|
111 | 100 | | F. The Department Authority is hereby authorized to create |
---|
112 | 101 | | employment positions n ecessary for the implementation of its |
---|
113 | 102 | | obligations pursuant to the Oklahoma Medical Marijuana a nd Patient |
---|
114 | 103 | | Protection Act including, but not limited to, Authority |
---|
115 | 104 | | investigators and a senior director of enforcement . The Department |
---|
116 | 105 | | and the Authority, the senior director of enforcement, the Executive |
---|
148 | 136 | | Executive Director, or criminal laws of this state. These powers |

149 | 137 | | shall include, but are not limited to: |

158 | 146 | | marijuana concentrate, and medical marijuana product; |
---|
159 | 147 | | 3. Assist Seizing any marijuana or marijuana product held in |
---|
160 | 148 | | violation of the Oklahoma Medical Mari juana and Patient Protection |
---|
161 | 149 | | Act, any other laws of this state, or any rules promulgated by the |
---|

---|
163 | 151 | | 4. Assisting or aid aiding any law enforcement officer in the |
---|
164 | 152 | | performance of his or her duties upon such law enforcement officer 's |

165 | 153 | | request or the request of other local officials having jurisdiction; |

206 | 193 | | 7. Requiring any business applicant or licensee to permit an |
---|
207 | 194 | | inspection of licensed premises during business hours or at any t ime |
---|
208 | 195 | | of apparent operation, marijuana equipment, and ma rijuana |
---|
209 | 196 | | accessories, or books and r ecords; and to permit the testing of or |
---|
210 | 197 | | examination of medical marijuana, marijuana concentrate, or |
---|
211 | 198 | | marijuana product; |
---|
212 | 199 | | 5. Require 8. Requiring applicants and licensees to submit |

213 | 200 | | complete and current applications, information and fees required by |

253 | 239 | | Director. The licensee shall prov ide the samples or units of |

254 | 240 | | medical marijuana or medical marijuana products at its o wn expense |

255 | 241 | | but shall not be responsible for the costs of testing; and |

256 | 242 | | 7. Require 10. Requiring medical marijuana business licensees |
---|
257 | 243 | | to periodically submit samples or units of medical ma rijuana or |
---|
258 | 244 | | medical marijuana product s to the quality assurance lab oratory for |
---|
259 | 245 | | quality assurance purposes. Licensed growers, processors, |
---|
260 | 246 | | dispensaries, and transporters shall not be required to submit |
---|
261 | 247 | | samples or units of medical marijuana or medical marijuan a products |
---|
262 | 248 | | more than twice a year. The licensee shall provide the samples or |
---|
263 | 249 | | units of medical marijuana or medical marijuana products at its own |
---|
264 | 250 | | expense but shall not be responsible for the costs of tes ting. |
---|
265 | 251 | | G. All investigators of the Authority shall meet all training |
---|
266 | 252 | | requirements and qualifications for peace officers as required by |
---|
267 | 253 | | Section 3311 et seq. of Title 70 of the Oklahoma Statutes. |
---|
300 | 285 | | upon the development of proba ble cause that such crime has been |
---|
301 | 286 | | committed. The director of enforcement and any investigator of the |
---|
302 | 287 | | Authority as provided by subsection F of this section may, upon |
---|
303 | 288 | | request of a sheriff o r another peace office r of this state, or any |
---|
304 | 289 | | political subdivision thereof, assist in the apprehension and arrest |
---|
305 | 290 | | of a violator or suspected vio lator of any of the laws of this |
---|
306 | 291 | | state. |
---|
307 | 292 | | I. The Executive Director may employ or contract with |
---|
308 | 293 | | attorneys, as needed, to adv ise the Executive Director and the |
---|
309 | 294 | | Authority on all legal matte rs and appear for and represent the |
---|
310 | 295 | | Executor Director and the Authority in all administrative hearings |
---|
311 | 296 | | and all litigation or other proceedings which may arise in the |
---|
312 | 297 | | discharge of their duties. At the request of the Executive |
---|
313 | 298 | | Director, such attorneys shall assist district attorneys in |
---|
314 | 299 | | prosecuting charges of violators of the Oklahoma Medical Marijuana |
---|
315 | 300 | | and Patient Protection Act or any other laws of this state carrying |
---|
316 | 301 | | criminal penalties involving crimes discovered during the |
---|
317 | 302 | | investigation of violations or suspected viol ations of the Oklahoma |
