57	47		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
58	48		SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.4 , is
59	49		amended to read as follows:
60	50		Section 427.4 A. The Oklahoma Medical Marijuana Authority, in
61	51		conjunction with the State Department of Health, shall employ an
62	52		Executive Director and other personnel as necessary to assist the
63	53		Authority in carrying out its duties.
64	54		B. The Authority shall not employ an indiv idual if any of the
65	55		following circumstances exist:
	56	+	1. The individual has a direct or indirect interest in a
	57	+	licensed medical marijuana business; or
	58	+	2. The individual or his or her spouse, parent, child, spouse
	59	+	of a child, sibling, or spouse of a sibling has an application for a

93		-	1. The individual has a direct or indirect interest in a
94		-	licensed medical marijuana business; or
95		-	2. The individual or his or her spouse, parent, child, spouse
96		-	of a child, sibling, or spouse of a sibling has an application for a
97	86		medical marijuana business l icense pending before the Department
98	87		Authority or is a member of the board of directors of a medical
99	88		marijuana business, or is an indi vidual financially interested in
100	89		any licensee or medical marijuana bu siness.
101	90		C. All officers and employees of the Authori ty shall be in the
102	91		exempt unclassified service as provided for in Section 840 -5.5 of
103	92		Title 74 of the Oklahoma Statutes.
104	93		D. The Commissioner may delegate to any offic er or employee of
105	94		the Department Authority any of the powers of the Executive Director
106	95		and may designate any officer or employee of the Department
107	96		Authority to perform any of the duties of the Executi ve Director.
108	97		E. The Executive Director shal l be authorized to sug gest rules
109	98		governing the oversight an d implementation of the Oklahoma Medical
110	99		Marijuana and Patient Protection Act.
111	100		F. The Department Authority is hereby authorized to create
112	101		employment positions n ecessary for the implementation of its
113	102		obligations pursuant to the Oklahoma Medical Marijuana a nd Patient
114	103		Protection Act including, but not limited to, Authority
115	104		investigators and a senior director of enforcement . The Department
116	105		and the Authority, the senior director of enforcement, the Executive
	106	+	Director, and Department investigators of the Authority shall have
	107	+	all the powers and authority of any a peace officer of this state
	108	+	for the purpose of enforcing the provi sions of the Oklahoma Medical
	109	+	Marijuana and Patient Protection Ac t, rules promulgated by the

144		-	Director, and Department investigators of the Authority shall have
145		-	all the powers and authority of any a peace officer of this state
146		-	for the purpose of enforcing the provi sions of the Oklahoma Medical
147		-	Marijuana and Patient Protection Ac t, rules promulgated by the
148	136		Executive Director, or criminal laws of this state. These powers
149	137		shall include, but are not limited to:
150	138		1. Investigate Investigating violations or suspected violations
151	139		of the Oklahoma Medical Marijuana and Patient Protection Act and,
152	140		any rules promulgated pursu ant thereto, and any violations of
153	141		criminal laws of this state discovered through the cour se of such
154	142		investigations;
155	143		2. Serve Serving all warrants, summonses, subpoenas,
156	144		administrative citations, notices or and all other processes
157	145		relating to the enforcem ent of laws regulating medical marijuana,
158	146		marijuana concentrate, and medical marijuana product;
159	147		3. Assist Seizing any marijuana or marijuana product held in
160	148		violation of the Oklahoma Medical Mari juana and Patient Protection
161	149		Act, any other laws of this state, or any rules promulgated by the
162	150		Executive Director;
163	151		4. Assisting or aid aiding any law enforcement officer in the
164	152		performance of his or her duties upon such law enforcement officer 's
165	153		request or the request of other local officials having jurisdiction;
166	154		4. Require 5. Referring any evidence, repor ts, or charges
167	155		regarding violations of any provision of the Oklahoma Medical
	156	+	Marijuana and Patient Protection Act that carry criminal penalties,
	157	+	or any other criminal laws of this state , to the appropriate law
	158	+	enforcement authority and prosecutorial a uthority for action;

195		-	Marijuana and Patient Protection Act that carry criminal penalties,
196		-	or any other criminal laws of this state , to the appropriate law
197		-	enforcement authority and prosecutorial authority for action;
198	185		6. Aiding the enforcement authorities of this state or any
199	186		county or municipality of the s tate, or the federal government, in
200	187		prosecutions of violations of the Oklahoma Medical Marijuana and
201	188		Patient Protection Act or any other laws of this state that carry
202	189		criminal penalties involving crimes discovered during the
203	190		investigation of violations or suspected viol ations of the Oklahoma
204	191		Medical Marijuana and Patient Protection Act, or any rules
205	192		promulgated pursuant thereto;
206	193		7. Requiring any business applicant or licensee to permit an
207	194		inspection of licensed premises during business hours or at any t ime
208	195		of apparent operation, marijuana equipment, and ma rijuana
209	196		accessories, or books and r ecords; and to permit the testing of or
210	197		examination of medical marijuana, marijuana concentrate, or
211	198		marijuana product;
212	199		5. Require 8. Requiring applicants and licensees to submit
213	200		complete and current applications, information and fees required by
214	201		the Oklahoma Medical Mariju ana and Patient Protection Act, the
215	202		Oklahoma Medical Marijuana Waste Management Act and Se ctions 420
216	203		through 426.1 of this title, and approve material changes made by
217	204		the applicant or licensee;

	207	+	product to the qualit y assurance laboratory when the Department

245		-	6. Require 9. Requiring medical marijuana business licensees
246		-	to submit a sample or unit of medical marijuana or medical marijuana
247		-	product to the qualit y assurance laboratory when the Department
248		-	Authority has reason to believe the medical marijuana or medical
249	235		marijuana product may be unsafe for patient consumption or
250	236		inhalation or has not been tes ted in accordance with the provisions
251	237		of the Oklahoma Medic al Marijuana and Patient Protection Act and the
252	238		rules and regulations of the Department promulgated by the Executive
253	239		Director. The licensee shall prov ide the samples or units of
254	240		medical marijuana or medical marijuana products at its o wn expense
255	241		but shall not be responsible for the costs of testing; and
256	242		7. Require 10. Requiring medical marijuana business licensees
257	243		to periodically submit samples or units of medical ma rijuana or
258	244		medical marijuana product s to the quality assurance lab oratory for
259	245		quality assurance purposes. Licensed growers, processors,
260	246		dispensaries, and transporters shall not be required to submit
261	247		samples or units of medical marijuana or medical marijuan a products
262	248		more than twice a year. The licensee shall provide the samples or
263	249		units of medical marijuana or medical marijuana products at its own
264	250		expense but shall not be responsible for the costs of tes ting.
265	251		G. All investigators of the Authority shall meet all training
266	252		requirements and qualifications for peace officers as required by
267	253		Section 3311 et seq. of Title 70 of the Oklahoma Statutes.
	254	+	H. During the course of an investigation, t he director of
	255	+	enforcement or any investigator of the Authority, as provided in
	256	+	subsection F of this section, may arrest a violator or suspected
	257	+	violator of any laws of this state committed in the presence of the
	258	+	director of enforcement or any investigator of the Authority, or

295		-	H. During the course of an investigation, t he director of
296		-	enforcement or any investigator of the Authority, as provided in
297		-	subsection F of this section, may arrest a violator or suspected
298		-	violator of any laws of this state committed in the presence of the
299		-	director of enforcement or any investigator of the Authority, or
300	285		upon the development of proba ble cause that such crime has been
301	286		committed. The director of enforcement and any investigator of the
302	287		Authority as provided by subsection F of this section may, upon
303	288		request of a sheriff o r another peace office r of this state, or any
304	289		political subdivision thereof, assist in the apprehension and arrest
305	290		of a violator or suspected vio lator of any of the laws of this
306	291		state.
307	292		I. The Executive Director may employ or contract with
308	293		attorneys, as needed, to adv ise the Executive Director and the
309	294		Authority on all legal matte rs and appear for and represent the
310	295		Executor Director and the Authority in all administrative hearings
311	296		and all litigation or other proceedings which may arise in the
312	297		discharge of their duties. At the request of the Executive
313	298		Director, such attorneys shall assist district attorneys in
314	299		prosecuting charges of violators of the Oklahoma Medical Marijuana
315	300		and Patient Protection Act or any other laws of this state carrying
316	301		criminal penalties involving crimes discovered during the
317	302		investigation of violations or suspected viol ations of the Oklahoma
	303	+	Medical Marijuana and Patient Protection Act or any rules
	304	+	promulgated pursuant thereto.
	305	+	SECTION 2. This act shall become effecti ve November 1, 2022.
