43	114		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

45	115		SECTION 1. NEW LAW A new section of law not to be
46		-	codified in the Oklahoma Statutes reads as follows: ENR. H. B. NO. 3819 Page 2

48	117		This act shall be known and may be cited as the "Oklahoma
49	118		Disaster Mitigation and Recovery Matching Fund Act".

51	119		SECTION 2. There is hereby appropriated to t he Oklahoma
52	120		Disaster Mitigation and Recovery Matching Fund from any monies not
53	121		otherwise appropriated from the General Revenue Fund of the State
54	122		Treasury for the fiscal year ending June 30, 2023, the sum of Five
55	123		Million Dollars ($5,000,000.00) or so much thereof as may be

56	150		necessary to perform the duties imposed upon the Oklahoma Department
57	151		of Commerce by law.

59	152		SECTION 3. NEW LAW A new sect ion of law to be codified
60	153		in the Oklahoma Statutes as Section 2021 of Title 62, unless there
61	154		is created a duplication in n umbering, reads as follows:
62		-
63	155		A. There is hereby established a fund within the State Treasury
64	156		to be known as the Oklahoma Disaster Mitigation and Recovery
65	157		Matching Fund, to be administered by the Oklahoma Department of
66	158		Commerce. The fund shall be a continuing fund not subject t o fiscal
67	159		year limitations. Within the Oklahoma Disaster Mitigation and
68	160		Recovery Matching Fund there shall be es tablished separate accounts
69	161		as prescribed by Sect ion 4 of this act into which shall be deposited
70	162		such funds as may be pro vided by law.

72	163		B. One of nine accounts shall be available to each entity
73	164		described in subsection A of Secti on 4 of this act.

75	165		C. One account shall be divided equally into tw o subaccounts.
76	166		One of the two subaccounts shall be availab le to each of the
77	167		entities described by subsection B of Section 4 of this act for
78	168		distribution to any city or town within the respe ctive jurisdiction
79	169		of the entity or for the benefit of an unincorporated area.

81	170		D. No funds deposited into one account or subaccount shall be
82	171		transferred to any other account. N o entity may access any more
83	172		than one account per fiscal year and the total expenditure from any

87	201		E. No monies in the Oklahoma Disaster Mitigation and Recovery
88	202		Matching Fund shall be used for the payment of administrative
89	203		expenses, salaries, or any other continuing obligation of the
90	204		Oklahoma Department of Commerce.

92	205		SECTION 4. NEW LAW A new section of law to be codified
93	206		in the Oklahoma Statutes as Section 2022 of Title 62, unless there
94	207		is created a duplication in number ing, reads as follows:

96	208		A. A voluntary association of Oklahoma loc al governmental
97	209		jurisdictions or another legal entity, including a public trust or a
98	210		nonprofit corporation or other entity which performs functions for
99	211		the benefit of or which exists for the primary benefit of Oklahoma
100	212		local governmental jurisdictions and which is not described in
101	213		subsection B of this section, shall be eligible to obtain fu nding
102	214		for rural hazard mitigation projects as authorized by Section 5 of
103	215		this act.

105	216		B. A voluntary assoc iation of Oklahoma local governmental
106	217		jurisdictions containing at least one municipalit y with a population
107	218		in excess of three hundred fifty thousand (350,000) person s
108	219		according to the latest Federal Decennial Census shall be eligible
109	220		to obtain funding as authorized by Section 5 of this act.

111	221		C. The entities described in subsection A or B of this sect ion
112	222		and which are eligible for any funds authorized by Section 5 of this

113	249		act may make expenditures on behalf of any city or town using funds
114	250		deposited to the Oklahoma Disaster Mitigation and Recovery Matching
115	251		Fund created by Section 3 of this act.

117	252		D. An organization described in subsection A or B of t his
118	253		section shall be aut horized to make payment of funds obtained
119	254		pursuant to Section 5 of this act directly to a county if the funds
120	255		are used for the benefit of an unincorpo rated area located within
121	256		the county to which payment is made. After the county has provided
122	257		a request to an organization described in subsection A or B of this
123	258		section for funds to benefit an unincorporated area of the county,
124	259		together with a statement that the co unty has conducted a revie w of
125	260		the needs of unincorporated areas located within the county and t hat
126	261		the funding requested is consistent with the evaluation of
127	262		priorities for funds by t he county, the funds requested may be paid
128	263		to the county. Any funds pai d to a county pursuant to the
129	264		provisions of this subsection shall be expended by the county
130	265		exclusively for the purpose identified in the request and as
131	266		required by the provisions of t his act.

133	267		E. No county to which funds are paid pursuant to the provisions
134	268		of subsection D of this section shall be lia ble to any person or
135	269		other legal entity for damages arising out of any condition, act,

137	271		project upon which funds expended pursuant to the authority of
138	272		subsection D of this section were paid to the county.

140	299		SECTION 5. NEW LAW A new section of law to be codified
141	300		in the Oklahoma Statutes as Section 2023 of Title 62, unless there
142	301		is created a duplication in numbering, reads as follows:

144	302		A. The governing board of an entity described by subsection A
145	303		or B of Section 4 of this act shall develop a plan for the use of
146	304		available funds for providing matching amounts as required pursuant
147	305		to the terms of applicable federal law to obtain federal funds for
148	306		the prevention of damage or to repa ir damages caused by a qualifying
149	307		hazard within areas included within its respective jurisdiction.
150	308		For purposes of this act, "qualifying hazard" shall include, but
151	309		shall not be limited to, potential damage or actual damages caus ed
152	310		by any one or more of the following conditions or causes :

154	311		1. High winds;

156	312		2. Tornadoes;

158	313		3. Hail;

160	314		4. Rain;

162	315		5. Flooding;

164	316		6. Freezing rain or ice;

166	317		7. Heavy snow;

170	319		9. Seismic disturbances; or

172	320		10. Other hazardous condition, whether naturally occurring or
173	321		resulting from manmade conditions, having the potential to cause or

183	356		received by the entity from the Oklahoma Disaster Mitigation and
184	357		Recovery Matching Fund were expended during the f iscal year ending
185	358		on the June 30 date immediately preceding the July 31 reporting

188	360		C. No entity which qualifies for funds pursuant to the
189	361		provisions of this act shall be required to provide matching funds
190	362		or to provide equivalent value in order to o btain available funds o r
191	363		funds for planning ex penditures from the Oklahoma Disaster
192	364		Mitigation and Recovery Matching Fund.

194	365		D. No funds allocated pursuant to the provisions of the
195	366		Oklahoma Disaster Mitigation and Rec overy Matching Fund Act shall be
196	367		used for any purpose other than to provide matching funds, available
197	368		through the federal government or other sources as authorized by
198	369		law, to maximize and leverage such available funding, and the funds
199	370		allocated pursuant to the provisions of this act shall not be used
200	371		for any direct expenditures on salaries, employee benefits,
201	372		acquisition of real or pe rsonal property, other than the availa ble

206	402		in the Oklahoma Statutes as Section 2024 of Title 62, unless there
207	403		is created a duplication in numbering, reads as follows:

209	404		The expenditures from the Oklahoma Disaster Mitigation and
210	405		Recovery Matching Fund and other expenditures governed by this act,
211	406		if made in accordance with the requirements of this act, shall be
212	407		construed as an expenditure of publ ic funds in furtherance of
213	408		governmental functions and for the purpose of conferring general and
214	409		uniform benefits resulting from the expenditures upon the residents
215	410		and other legal entities located in areas subject to t he
216	411		jurisdiction of the entities descri bed in subsection A or B of
217	412		Section 4 of this act.

219	413		SECTION 7. This act shall become effective July 1, 2022.

221	414		SECTION 8. It being immediately necessary for the preservation
222	415		of the public peace, health or safety, an emergency is hereby
223	416		declared to exist, by reason whereof this act shall take effect and
224	417		be in full force from and after its passage and approval.
