43114 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

45115 SECTION 1. NEW LAW A new section of law not to be
46-codified in the Oklahoma Statutes reads as follows: ENR. H. B. NO. 3819 Page 2

48117 This act shall be known and may be cited as the "Oklahoma
49118 Disaster Mitigation and Recovery Matching Fund Act".

51119 SECTION 2. There is hereby appropriated to t he Oklahoma
52120 Disaster Mitigation and Recovery Matching Fund from any monies not
53121 otherwise appropriated from the General Revenue Fund of the State
54122 Treasury for the fiscal year ending June 30, 2023, the sum of Five
55123 Million Dollars ($5,000,000.00) or so much thereof as may be

56150 necessary to perform the duties imposed upon the Oklahoma Department
57151 of Commerce by law.

59152 SECTION 3. NEW LAW A new sect ion of law to be codified
60153 in the Oklahoma Statutes as Section 2021 of Title 62, unless there
61154 is created a duplication in n umbering, reads as follows:

63155 A. There is hereby established a fund within the State Treasury
64156 to be known as the Oklahoma Disaster Mitigation and Recovery
65157 Matching Fund, to be administered by the Oklahoma Department of
66158 Commerce. The fund shall be a continuing fund not subject t o fiscal
67159 year limitations. Within the Oklahoma Disaster Mitigation and
68160 Recovery Matching Fund there shall be es tablished separate accounts
69161 as prescribed by Sect ion 4 of this act into which shall be deposited
70162 such funds as may be pro vided by law.

72163 B. One of nine accounts shall be available to each entity
73164 described in subsection A of Secti on 4 of this act.

75165 C. One account shall be divided equally into tw o subaccounts.
76166 One of the two subaccounts shall be availab le to each of the
77167 entities described by subsection B of Section 4 of this act for
78168 distribution to any city or town within the respe ctive jurisdiction
79169 of the entity or for the benefit of an unincorporated area.

81170 D. No funds deposited into one account or subaccount shall be
82171 transferred to any other account. N o entity may access any more
83172 than one account per fiscal year and the total expenditure from any

84199 one account for each fiscal year may not exceed the amount of funds
85200 available to each account as may be provided by law.

87201 E. No monies in the Oklahoma Disaster Mitigation and Recovery
88202 Matching Fund shall be used for the payment of administrative
89203 expenses, salaries, or any other continuing obligation of the
90204 Oklahoma Department of Commerce.

92205 SECTION 4. NEW LAW A new section of law to be codified
93206 in the Oklahoma Statutes as Section 2022 of Title 62, unless there
94207 is created a duplication in number ing, reads as follows:

96208 A. A voluntary association of Oklahoma loc al governmental
97209 jurisdictions or another legal entity, including a public trust or a
98210 nonprofit corporation or other entity which performs functions for
99211 the benefit of or which exists for the primary benefit of Oklahoma
100212 local governmental jurisdictions and which is not described in
101213 subsection B of this section, shall be eligible to obtain fu nding
102214 for rural hazard mitigation projects as authorized by Section 5 of
103215 this act.

105216 B. A voluntary assoc iation of Oklahoma local governmental
106217 jurisdictions containing at least one municipalit y with a population
107218 in excess of three hundred fifty thousand (350,000) person s
108219 according to the latest Federal Decennial Census shall be eligible
109220 to obtain funding as authorized by Section 5 of this act.

111221 C. The entities described in subsection A or B of this sect ion
112222 and which are eligible for any funds authorized by Section 5 of this

113249 act may make expenditures on behalf of any city or town using funds
114250 deposited to the Oklahoma Disaster Mitigation and Recovery Matching
115251 Fund created by Section 3 of this act.

117252 D. An organization described in subsection A or B of t his
118253 section shall be aut horized to make payment of funds obtained
119254 pursuant to Section 5 of this act directly to a county if the funds
120255 are used for the benefit of an unincorpo rated area located within
121256 the county to which payment is made. After the county has provided
122257 a request to an organization described in subsection A or B of this
123258 section for funds to benefit an unincorporated area of the county,
124259 together with a statement that the co unty has conducted a revie w of
125260 the needs of unincorporated areas located within the county and t hat
126261 the funding requested is consistent with the evaluation of
127262 priorities for funds by t he county, the funds requested may be paid
128263 to the county. Any funds pai d to a county pursuant to the
129264 provisions of this subsection shall be expended by the county
130265 exclusively for the purpose identified in the request and as
131266 required by the provisions of t his act.

133267 E. No county to which funds are paid pursuant to the provisions
134268 of subsection D of this section shall be lia ble to any person or
135269 other legal entity for damages arising out of any condition, act,
136-omission, or other cause alleged to have arisen as a result of a ENR. H. B. NO. 3819 Page 4

137271 project upon which funds expended pursuant to the authority of
138272 subsection D of this section were paid to the county.

140299 SECTION 5. NEW LAW A new section of law to be codified
141300 in the Oklahoma Statutes as Section 2023 of Title 62, unless there

144302 A. The governing board of an entity described by subsection A
145303 or B of Section 4 of this act shall develop a plan for the use of
146304 available funds for providing matching amounts as required pursuant
147305 to the terms of applicable federal law to obtain federal funds for
148306 the prevention of damage or to repa ir damages caused by a qualifying
149307 hazard within areas included within its respective jurisdiction.
150308 For purposes of this act, "qualifying hazard" shall include, but
151309 shall not be limited to, potential damage or actual damages caus ed
152310 by any one or more of the following conditions or causes :

160314 4. Rain;

164316 6. Freezing rain or ice;

172320 10. Other hazardous condition, whether naturally occurring or

175349 for which federal funds may be available pursuant to a declaration
176350 of a disaster by the Governor or purs uant to terms of federal la w.

178351 B. Not later than July 31, ea ch entity described by Section 4
179352 of this act shall transmit, in such electronic form as may be
180353 prescribed by the Oklahoma Department of Commerce for pur poses of
181-access to such information on th e website maintained by the ENR. H. B. NO. 3819 Page 5

182355 Department, a summary of each p roject upon which matching funds
183356 received by the entity from the Oklahoma Disaster Mitigation and
184357 Recovery Matching Fund were expended during the f iscal year ending
185358 on the June 30 date immediately preceding the July 31 reporting

188360 C. No entity which qualifies for funds pursuant to the
189361 provisions of this act shall be required to provide matching funds
190362 or to provide equivalent value in order to o btain available funds o r
191363 funds for planning ex penditures from the Oklahoma Disaster
192364 Mitigation and Recovery Matching Fund.

194365 D. No funds allocated pursuant to the provisions of the
195366 Oklahoma Disaster Mitigation and Rec overy Matching Fund Act shall be
196367 used for any purpose other than to provide matching funds, available
197368 through the federal government or other sources as authorized by
198369 law, to maximize and leverage such available funding, and the funds
199370 allocated pursuant to the provisions of this act shall not be used
200371 for any direct expenditures on salaries, employee benefits,
201372 acquisition of real or pe rsonal property, other than the availa ble

205401 SECTION 6. NEW LAW A new section of law to be codified
206402 in the Oklahoma Statutes as Section 2024 of Title 62, unless there
207403 is created a duplication in numbering, reads as follows:

209404 The expenditures from the Oklahoma Disaster Mitigation and
210405 Recovery Matching Fund and other expenditures governed by this act,
211406 if made in accordance with the requirements of this act, shall be
212407 construed as an expenditure of publ ic funds in furtherance of
213408 governmental functions and for the purpose of conferring general and
214409 uniform benefits resulting from the expenditures upon the residents
215410 and other legal entities located in areas subject to t he
216411 jurisdiction of the entities descri bed in subsection A or B of
217412 Section 4 of this act.

219413 SECTION 7. This act shall become effective July 1, 2022.

221414 SECTION 8. It being immediately necessary for the preservation
222415 of the public peace, health or safety, an emergency is hereby
223416 declared to exist, by reason whereof this act shall take effect and
224417 be in full force from and after its passage and approval.
