	43	+	O.S. 2021, Section 422, which relates to medical
	44	+	marijuana commercial grower licenses; requiring all
	45	+	medical marijuana commercial grower licensees to
	46	+	register as an environmentally sensitive crop owner;
	47	+	directing medical marijuana commer cial grower
	48	+	licensees to provide certain information when
	49	+	registering; and providing an effective date.

51	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	55		SECTION 1. AMENDATORY 63 O.S. 2021, Section 422, is
53	56		amended to read as follows:
54	57		Section 422. A. The State Department of Health shall, within
55	58		thirty (30) days of passage of this initiative, make available on
56	59		its website in an easy-to-find location an application for a
57	60		commercial grower license . The application fee shall be Two
58	61		Thousand Five Hundred Dollars ($2,500.00) . A method of payment
59	62		shall be provided on the website of the Department. The State
60	63		Department of Health shall have ninety (90) days to review the
61	64		application; approve, reject or deny the application; and mail the
62		-	approval, rejection or denial letter stating the reasons for the
63		-	rejection or denial to the applicant.

	92	+	rejection or denial to the applicant.
91	93		B. The State Department of Health shall approve all
92	94		applications which me et the following criteria:
93	95		1. The applicant must be twenty-five (25) years of age or
94	96		older;
95	97		2. The applicant, if applying as an individual, must show
96	98		residency in the State of Oklahoma;
97	99		3. All applying entities must show that all members, managers,
98	100		and board members are Oklahoma residents;
99	101		4. An applying entity may show ownership of non -Oklahoma
100	102		residents, but that perc entage ownership may not exceed twe nty-five
101	103		percent (25%);
102	104		5. All applying individuals or entities must be registered to
103	105		conduct business in the State of Oklahoma; and
104	106		6. All applicants must disclose all ownership interests in the
105	107		commercial grower opera tion.
106	108		Applicants with a nonviolent felony conviction in the last two
107	109		(2) years, any other felony conviction in the last five (5) years,
108	110		inmates in the custody of the Department of Corrections or any
109	111		person currently incarcerate d shall not qualify for a com mercial
110	112		grower license.
111	113		C. A licensed commercial grower may sell marijuan a to a
112	114		licensed dispensary or a licensed processor. Further, sales by a
113		-	licensed commercial grower shall be considered wholesale sales and
114		-	shall not be subject to taxation. Under no circumstances may a

	141	+	licensed commercial grower shall be considered wholesale sales and
	142	+	shall not be subject to taxation. Under no circumstances may a
142	143		licensed commercial grower sell marijuana directly t o a licensed
143	144		medical marijuana patient or licensed caregiver . A licensed
144	145		commercial grower may only sell at the wholesale level to a license d
145	146		dispensary, a licensed grower or a licensed processor. If the
146	147		federal government lifts restrictions on buying an d selling
147	148		marijuana between states, then a licensed commercial grower would be
148	149		allowed to sell and buy marijuana wholesale from, or to, a n out-of-
149	150		state wholesale provider. A licensed commercial grower shall be
150	151		required to complete a monthly yield and sale s report to the State
151	152		Department of Health . This report shall be due on the fifteenth of
152	153		each month and provide reporting on the previous month . This report
153	154		shall detail the amount of marijuana harvested in pounds, the amount
154	155		of drying or dried marijuana on hand, the amount of marijuana sold
155	156		to licensed processors in pounds, the amount of waste in pounds, and
156	157		the amount of marijuana sold t o licensed dispensaries in pounds.
157	158		Additionally, this report shall show total wholesale sales in
158	159		dollars. The State Department of Health shall have oversight and
159	160		auditing responsibilities to ensure that all marijuana being grown
160	161		by licensed commercial growers is accounted for.
161	162		D. There shall be no limits on how much marijuana a li censed
162	163		commercial grower can grow.
163		-	E. Beginning on the effective date of this act, licensed
164		-	commercial growers shall be authorized to package and sell pre -
165		-	rolled marijuana to licensed medical marijuana dispensa ries. The

	190	+	E. Beginning on the effective date of this act, licensed
	191	+	commercial growers shall be authorized to package and sell pre -
	192	+	rolled marijuana to licensed medical marijuana dispensaries . The
193	193		products described in this subsect ion shall contain only the ground
194	194		parts of the marijuana plant and shall not include marijuana
195	195		concentrates or derivatives . The total net weight of each pre -roll
196	196		packaged and sold by medical marijuana commercial growers shall not
197	197		exceed one (1) gram. These products must be tested, packaged and
198	198		labeled in accordance with Oklahoma law and rules promulga ted by the
199	199		State Commissioner of Health.
200	200		F. Beginning November 1, 2022, all medical marijuana commer cial
201	201		grower licensees who operate an outdoor medic al marijuana production
202	202		facility shall be required to register with the Oklahoma Department
203	203		of Agriculture, Food, and Forestry as an environmentally sensitive
204	204		crop owner. Registration shall provide notice to commercial and
205	205		private pesticide applicators of the locations of medical marijuana
206	206		crops and help minimize the potential for damaging pesticide drift .
207	207		Medical marijuana commercial grower licensees shall provide their
208	208		business name, address, Global Positioning System (GPS) coordinates
209	209		for all outdoor medical marijuana production facilities, and any
210	210		other information required by the Department when registering with
211	211		the Environmentally Sensitive Area Registry.
212	212		SECTION 2. This act shall become effective November 1, 2022.
