4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-2503, is
5050 amended to read as follows :
5151 Section 1-2503. As used in the Oklahoma Emergen cy Response
5252 Systems Development Act:
5353 1. "Ambulance" means any ground, air or water vehicle which is
5454 or should be approved by the Commissioner of Health, designed and
5555 equipped to transport a patient or patients and to provide
5656 appropriate on-scene and en route patient stabilization and care as
5757 required. Vehicles used as ambulances shall meet such standards as
5858 may be required by the State Board of Health for approval, and shall
5959 display evidence of such approval at all times;
6060 2. "Ambulance authority" means any public trust or nonprofit
6161 corporation established by the state or any unit of local government

8888 or combination of units of government for the express purpose of
8989 providing, directly or by contract, emergency medical services in a
9090 specified area of the sta te;
9191 3. "Ambulance patient" or "patient" means any person who is or
9292 will be transported in a reclining position to or from a health care
9393 facility in an ambulance;
9494 4. "Ambulance service" means any private firm or governmental
9595 agency which is or should be l icensed by the State Department of
9696 Health to provide lev els of medical care, including but not limited
9797 to comprehensive integrated medical care in emergency and
9898 nonemergency settings under the supervision of a physician, base d on
9999 certification standards pr omulgated by the Board;
100100 5. "Ambulance service district " means any county, group of
101101 counties or parts of counties formed together to provide, operate
102102 and finance emergency medical services as provided by Section 9C of
103103 Article X of the Oklahoma Constitution or Sections 1201 through 1221
104104 of Title 19 of the Oklaho ma Statutes;
105105 6. "Board" means the State Board of Health;
106106 7. "Certified emergency medical responder " means an individual
107107 certified by the Department to perform emergenc y medical services in
108108 accordance with the Oklahoma Emergency Response Systems Developme nt
109109 Act and in accordance with the rules and standards promulgated by
110110 the Board;

137137 8. "Certified emergency medical response agency " means an
138138 organization of any type certified by the Department to provi de
139139 emergency medical care, but not transport. Certified emergency
140140 medical response agencies may utilize certified emergency medical
141141 responders or licensed emergency medical personnel; provided,
142142 however, that all personnel so utilized shall function under the
143143 direction of and consistent with guidelines for medi cal control;
144144 9. "Classification" means an inclusive standardized
145145 identification of stabilizing and definitive emergency services
146146 provided by each hospital that treats emergency patients;
147147 10. "CoAEMSP" means the Committee on Accreditation of
148148 Educational Programs for the Emergency Medical Services Professions;
149149 11. "Commissioner" means the State Commissioner of Health;
150150 12. "Community paramedic" means a licensed paramedic who meets
151151 the requirements of Section 1-2505 of this title;
152152 13. "Community paramedic services" means services that include
153153 interventions intended to prevent unnecessary a mbulance
154154 transportation or hospital emergency department use.
155155 a. Community paramedic services must be part of a car e
156156 plan ordered by a primary health care provider or a
157157 hospital provider in consultation with the medical
158158 director of an ambulance service. S uch care plan must
159159 ensure that the services provided by a community
160160 paramedic do not duplicate services already pro vided

187187 to the patient, including home health and waiver
188188 services.
189189 b. Community paramedic services shall include health
190190 assessment, chronic dis ease monitoring and education,
191191 medication compliance, immunizations and vaccinations,
192192 laboratory specimen collectio n, hospital discharge
193193 follow-up care and minor medical p rocedures compliant
194194 with the community paramedic 's scope of practice and
195195 approved by the ambulance medical director;
196196 14. "Council" means the Trauma and Emergency Response Advisory
197197 Council created in Section 1-103a.1 of this title;
198198 15. "Critical care paramedic" or "CCP" means a licensed
199199 paramedic who has successfully completed critical care training and
200200 testing requirements in accordance with the Oklahoma Emergency
201201 Response Systems Development Act and in accordance with the rules
202202 and standards promulgated by the Board;
203203 16. "Department" means the State Department of Health;
204204 17. "Emergency medical services system " means a system which
205205 provides for the organization and appropriate designation of
206206 personnel, facilities and equipment for the effective and
207207 coordinated local, regional and statewide delivery of health care
208208 services primarily under emergency conditions;

235235 18. "Letter of review" means the official designation from
236236 CoAEMSP to a paramedic program t hat is in the "becoming accredited"
237237 process;
238238 19. "Licensed emergency medical personnel" means an emergency
239239 medical technician (EMT), an intermediate emergency medical
240240 technician (IEMT), an advanced emergency medical technician (AEMT),
241241 or a paramedic licen sed by the Department to perform emergency
242242 medical services in accordance with the Oklahoma Emergency Response
243243 Systems Development Act and the rules and standards promulgated by
244244 the Board;
245245 20. "Licensure" means the licensing of emergency medical care
246246 providers and ambulance services pursuant to rules and stand ards
247247 promulgated by the Board at one or more of the following levels:
248248 a. basic life support,
249249 b. intermediate life support,
250250 c. paramedic life support,
251251 d. advanced life support,
252252 e. stretcher aid van, an d
253253 f. specialty care, which shall be used solely for
254254 interhospital transport of patients requiring
255255 specialized en route medical monitoring and advanced
256256 life support which exceed the capabilities of the
257257 equipment and personnel provided by paramedic life
258258 support.

285285 Requirements for each level of care shall be establ ished by the
286286 Board. Licensure at any level of care includes a license to operate
287287 at any lower level, with the exception of licensure for specialty
288288 care; provided, however, that the highest level of c are offered by
289289 an ambulance service shall be available t wenty-four (24) hours each
290290 day, three hundred sixty -five (365) days per year.
291291 Licensure shall be granted or renewed for such periods and under
292292 such terms and conditions as may be promulgated by the Bo ard,
293293 An applicant upon submitting his or her national ce rtification,
294294 license fee and application to the Department, shall be granted a
295295 temporary license which shall be valid for six (6) months. The
296296 temporary license shall allow the applicant to immediatel y start
297297 work as if the individual was in possession of his or her official
298298 license and shall authorize the individ ual to conduct any actions as
299299 the official license would authorize ;
300300 21. "Medical control" means local, regional or statewide
301301 medical direction and quality assurance of health care delivery in
302302 an emergency medical service system. On-line medical control is the
303303 medical direction given to licensed emergency medical personnel,
304304 certified emergency medical responders and stretcher aid van
305305 personnel by a physician via radio or telephone. Off -line medical
306306 control is the establishment and monitoring of all medical
307307 components of an emergency medical service system, which is to
308308 include stretcher aid van service including, but not limited to,

335335 protocols, standing orders, educational programs, and the quality
336336 and delivery of on-line control;
337337 22. "Medical director" means a physician, fully licensed
338338 without restriction, who acts as a paid or volunt eer medical advisor
339339 to a licensed ambulance service and who mo nitors and directs the
340340 care so provided. Such physicians sha ll meet such qualifications
341341 and requirements as may be p romulgated by the Board;
342342 23. "Region" or "emergency medical service region " means two or
343343 more municipalities, counties, ambulance district s or other
344344 political subdivisions exercising joint control ov er one or more
345345 providers of emergency medical services a nd stretcher aid van
346346 service through common ordinances, authorities, boards o r other
347347 means;
348348 24. "Regional emergency medical services syste m" means a
349349 network of organizations, individuals, facilities and equipment
350350 which serves a region, subject to a unifie d set of regional rules
351351 and standards which may exceed, but may not be in con travention of,
352352 those required by the state, which is under the medical direction of
353353 a single regional medical director, and which participates directly
354354 in the delivery of the foll owing services:
355355 a. medical call-taking and emergency medical services
356356 dispatching, emergency and routine, including priority
357357 dispatching of first response agencies, stretcher aid
358358 van and ambulances,

385385 b. emergency medical responder services provided by
386386 emergency medical response agencies,
387387 c. ambulance services, both emergency, routin e and
388388 stretcher aid van including, but not limited to, the
389389 transport of patients in accordance with transport
390390 protocols approved by the regional medical director,
391391 and
392392 d. directions given by physicians directly via radio or
393393 telephone, or by written protocol , to emergency
394394 medical response agencies, stretcher aid van or
395395 ambulance personnel at the scene of an emergency or
396396 while en route to a hospital;
397397 25. "Regional medical director " means a licensed physician, who
398398 meets or exceeds the qualifications of a medic al director as defined
399399 by the Oklahoma Emergency Response Syst ems Development Act, chosen
400400 by an emergency medical service r egion to provide external medical
401401 oversight, quality con trol and related services to that region;
402402 26. "Registration" means the listing of an ambulance service in
403403 a registry maintained by the Dep artment; provided, however,
404404 registration shall not be deemed to be a license;
405405 27. "Stretcher aid van" means any ground vehicle which is or
406406 should be approved by the State Commissioner of Health , which is
407407 designed and equipped to transport individuals on a stretcher or
408408 gurney type apparatus. Vehicles used as stretc her aid vans shall

435435 meet such standards as may be require d by the State Board of Health
436436 for approval and shall display evidence of suc h approval at all
437437 times. Stretcher aid van services shall onl y be permitted and
438438 approved by the Commissioner in emergency medical service regions,
439439 ambulance service districts, or counties with populations in excess
440440 of four hundred thousand (400,000) peopl e. Notwithstanding the
441441 provisions of this paragraph, stretche r aid van transports may be
442442 made to and from any federal or s tate veterans facility;
443443 28. "Stretcher aid van patient " means any person who is or will
444444 be transported in a reclining position on a stretcher or gurney, who
445445 is medically stable, nonemergent and does not require any medical
446446 monitoring equipment or assistan ce during transport; and
447447 29. "Transport protocol" means the written instructions
448448 governing decision-making at the scene of a medical emergency by
449449 ambulance personnel regarding the selection of t he hospital to which
450450 the patient shall be transported. Trans port protocols shall be
451451 developed by the regional medica l director for a regional emergency
452452 medical services system or by the Departm ent if no regional
453453 emergency medical services system has been established. Such
454454 transport protocols shall adhere to, at a minimum, the following
455455 guidelines:
456456 a. nonemergency, routine transport shall be to the
457457 facility of the patient 's choice,

484484 b. urgent or emergency transport not involving life -
485485 threatening medical ill ness or injury shall be to the
486486 nearest facility, or, subject to transport
487487 availability and system area coverage, to t he facility
488488 of the patient's choice, and
489489 c. life-threatening medical illness or injury shall
490490 require transport to the nearest health care f acility
491491 appropriate to the needs of the patient as establishe d
492492 by regional or state guidelines.
493493 SECTION 2. This act shall become effective November 1, 2022.
