5752 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5853 SECTION 1. AMENDATORY 3A O.S. 2021, Section 200.1, is
5954 amended to read as follows:
6055 Section 200.1 A. As used in the Oklahoma Horse Racing Act:
6156 1. "Advance deposit wagering" means a form of pari-mutuel
6257 wagering by an individual who has established an account with an
6358 advance deposit wagering provider and who uses the account for pari -
6459 mutuel wagering on inter state horse races pursuant to the Interstate
6560 Horseracing Act of 1978 found in Sections 3001 et seq. of Title 15

9488 2. "Advance deposit wagering provider" means any person or
9589 entity located outside of Oklahoma that conducts advance deposit
9690 wagering;
9791 3. "Commission" means the Oklahoma Ho rse Racing Commission;
9892 2. 4. "Enclosure" means all buildings, structures and grounds
9993 utilized for the conduct of a race meeting and/or gaming at the race
10094 track and any additional areas designated by the Oklahoma Horse
10195 Racing Commission;
10296 3. 5. "Family" means husband, wife, and any dependent children;
10397 4. 6. "Financial interest" means an interest that could result
10498 in directly or indirectly receiving a pecuni ary gain or sustaining a
10599 pecuniary loss as a result of ownership or interest in a business
106100 entity, or as a result of salary, gra tuity, or other comp ensation or
107101 remuneration from any person;
108102 5. 7. "Horse racing" means any type of horse racing, including,
109103 but not limited to, Arabian, Appaloosa, Paint, Pinto, Quarter Horse,
110104 and Thoroughbred horse racing.
111105 a. "Arabian horse racing " means the form of horse racing
112106 in which each participating horse is an Arabian horse
113107 registered with the Arabian Horse Club Registry o f
114108 America and approved by the Arabian Horse Racing
115109 Association of America or any successor organiz ation,
116110 mounted by a jockey, and engaged in races on the flat

146139 b. "Appaloosa horse racing" means the form of horse
147140 racing in which each participating horse is an
148141 Appaloosa horse registered with the Ap paloosa Horse
149142 Club or any successor organization and mounted by a
150143 jockey.
151144 c. "Quarter Horse racing " means the form of horse racing
152145 where each participating horse is a Quarter Horse
153146 registered with the American Quarter Horse Assoc iation
154147 or any successor org anization, mounted b y a jockey,
155148 and engaged in a race on the flat.
156149 d. "Paint horse racing" means the form of horse racing in
157150 which each participating horse is a Paint horse
158151 registered with the American Paint Horse Association
159152 or any successor organization and mounted by a joc key.
160153 e. "Pinto horse racing" means the form of horse racing in
161154 which each participating horse is a Pinto horse
162155 registered with the Pinto Horse Association of
163156 America, Inc. or any successor organization and
164157 mounted by a jockey.
165158 f. "Thoroughbred horse racing " means the form of horse
166159 racing in which each participating horse is a
167160 Thoroughbred horse registered with the Jockey Club or

195187 any successor organization, mounted by a jockey, and
196188 engaged in races on the flat.
197189 "Horse racing" shall not mean the racing of a c loned horse or
198190 offspring of a cloned horse regardless of whether any breed
199191 association has registered the horse ;
200192 6. 8. "Minor" means any individual under eighteen (18) years of
201193 age;
202194 7. 9. "Minus pool" means a pari-mutuel pool in which , after
203195 deducting the take-out, not enough money remains in the pool to pay
204196 the legally prescribed minimum return to those placing winnin g
205197 wagers, and in which the organization licensee would be required to
206198 pay the remaining amou nt due;
207199 8. 10. "Occupation licensee" means any person who has obtained
208200 an occupation license;
209201 9. 11. "Organization licensee " means any person receiving an
210202 organization license;
211203 10. 12. "Pari-mutuel system of wagering " means a form of
212204 wagering on the outcome of horse races in whic h those who wager
213205 purchase wagers of various denominations on a horse or horses and
214206 all wagers for each race are pooled and held by the organization
215207 licensee for distribution. The pari -mutuel system of wagering uses
216208 an electric totalizator or similar equi pment which automati cally
217209 registers the wagers made on each horse;

245236 11. 13. "Pari-mutuel pool" means the total money wagered by
246237 individuals on any horse or horses in a particular horse race to
247238 win, place, or show and held by the organization licensee pursu ant
248239 to the pari-mutuel system of wagering. There is a separate pari -
249240 mutuel pool for win, for place, for show, and for each multiple
250241 combination of betti ng approved by the Oklahoma Horse Racing
251242 Commission;
252243 12. 14. "Person" means any individual, partnershi p,
253244 corporation, or other association or entity; and
254245 13. 15. "Race meeting" means the entire period of time not to
255246 exceed twenty (20) calendar days separating an y race days for which
256247 an organization license has been granted to a person by the
257248 Commission to hold horse races at which the pari-mutuel system of
258249 wagering is conducted, to hold non -pari-mutuel horse races or to
259250 conduct accredited work or training races.
260251 B. The Commission may define by rule or regulation any term
261252 which is not defined in the Oklaho ma Horse Racing Act.
262253 SECTION 2. AMENDATORY 3A O.S. 2021, Section 204, is
263254 amended to read as follows:
264255 Section 204. A. The Oklahoma Horse Racing Commission shall:
265256 1. Have supervision of :
266257 a. all race meetings held in this state; provided, for
267258 non-pari-mutuel race meetings and training races held
268259 at non-pari-mutuel tracks jurisdiction of the

296286 Commission shall be limited to a period of time
297287 beginning twelve (12) hours before the commencement of
298288 the first race on a race day and ending four (4) hours
299289 after the finish of the last race on a race day,
300290 b. all occupation and organizatio n licensees in this
301291 state, and
302292 c. all persons on the property of an organization
303293 licensee; provided, for non -pari-mutuel race meetings
304294 and training races held at non -pari-mutuel tracks
305295 supervision of such persons shall be limited to the
306296 period set out in subparagraph a of this paragraph;
307297 2. Have the authority to promulgate rules for the purpose of
308298 administering the pr ovisions of the Oklahoma Horse Racing Act;
309299 3. Administer and en force the provisions of the Oklahoma Horse
310300 Racing Act and the rules of the Co mmission;
311301 4. Adjudicate controversies arising from the enforcement of the
312302 provisions of the Oklahoma Horse Racing Act and the rules of the
313303 Commission;
314304 5. Allocate racing days of not to exceed six (6) days per
315305 calendar week, dates, and hours which are in the best interests of
316306 the people of this state to organization licensees;
317307 6. Promulgate rules for the granting or refusing and the
318308 suspension or revoking of licenses;

346335 7. Promulgate rules for the holding, conducting, and operating
347336 of all race meetings hel d in this state; provided, the rules of the
348337 American Quarter Horse Association for regulation of the holding,
349338 conducting and operating of non-pari-mutuel race meetings and
350339 training races held at non-pari-mutuel tracks shall serve as the
351340 rules for the holding, conducting and operating of non -pari-mutuel
352341 race meetings and training races held at non -pari-mutuel tracks,
353342 except that appeals from decisions of the stewards shall be to the
354343 Commission, until such time as the Commission has promulgated
355344 substantially similar rules for regulation of the holding,
356345 conducting and operating of non -pari-mutuel race meetings and
357346 training races held at non-pari-mutuel tracks;
358347 8. Promulgate rules to establish the terms and requirements for
359348 obtaining and maintaining an advance deposit wagering license;
360349 9. Have supervision and control of the pari -mutuel machines and
361350 all other equipment a t all race meetings held in this state;
362351 9. 10. Check the making of pari-mutuel pools and the
363352 distribution of such pools and shall:
364353 a. contract with the Office of the State Auditor and
365354 Inspector to conduct an annual audit and inspection of
366355 live race meets in this state, and
367356 b. reimburse the Office of the State Auditor and
368357 Inspector for the cost of these services;
369358 10. 11. Promulgate rules governing:

397385 a. bids on leases,
398386 b. the rate charged by an organization licensee for
399387 admission to races, and
400388 c. the rate charged for the perfor mance of any service or
401389 for the sale of any art icle on the premises of an
402390 organization licensee;
403391 11. 12. Approve all contracts and agreements for the payment of
404392 money and all salaries, fees, and compensations by any organization
405393 licensee;
406394 12. 13. Have the authority to exclude, or compel the exclusion ,
407395 from any race meeting:
408396 a. any person who violates the provisions of any rule or
409397 order of the Commission or any law of this state, any
410398 other state, or the United S tates,
411399 b. any person who has been previously convicted of
412400 violating any law of this state, a ny other state, the
413401 United States, or
414402 c. any other person, licensed or unlicensed, whose
415403 conduct or reputation is such that his or her presence
416404 at the race meeting may, in the opinion of the
417405 Commission reflect on the honesty and integrity of
418406 horse racing or interfere with the orderly conduct of
419407 the race meeting. No person shall be excluded or

447434 ejected from a race meeting solely on the grounds of
448435 race, color, creed, sex, national origin, o r ancestry;
449436 13. 14. Have investigatory powers and authority to place
450437 attendants and such other persons as may be deemed necessary by the
451438 Commission in the offices, on the tracks, or in places of business
452439 of any organization licensee for the purpose of det ermining whether
453440 an organization or occupation licensee is complying w ith the
454441 provisions of the Oklahoma Ho rse Racing Act and the rules of the
455442 Commission;
456443 14. 15. Have authority to acquire or contract with, or
457444 establish, maintain, and operate testing labo ratories and related
458445 facilities for the purpose of conducting:
459446 a. human substance abuse testing on occupati on licensees
460447 who may affect the outcome of race results. Human
461448 substance abuse tests and the laboratories performing
462449 such tests must meet the nation ally recognized
463450 standards specified in the Mandatory Guidelines for
464451 Federal Workplace Drug Testing Programs adopted by the
465452 United States Department of Health and Human Services.
466453 The Commission may require any occupation licensee to
467454 submit to a human subst ance abuse test if the
468455 Commission has probable cause to believe that s uch
469456 licensee is possessing or using a ny controlled
470457 dangerous substance or any other drug in violation of

498484 any federal or state law. Provided, on and after July
499485 1, 1994, such testing shal l be in compliance with the
500486 provisions of the Standards for Workplace Drug and
501487 Alcohol Testing Act, and
502488 b. a saliva test, a blood test, a urine test, or other
503489 tests or combinations of tests on the horses run or to
504490 be run in any race meeting. Prior to the Commission
505491 entering into any contract pursuant to this paragraph,
506492 the Attorney General shall review and app rove the
507493 contract. Any contract entered into pursuant to this
508494 paragraph shall contain the specifications that were
509495 in the request for bid for the co ntract;
510496 15. 16. Approve of all proposed con struction on property owne d
511497 or leased by an organization licens ee;
512498 16. 17. Have authority to require that all financial,
513499 employment, or other records of an organization licensee shall be
514500 kept in such manner as p rescribed by the Commis sion and shall be
515501 subject to inspection by the Commission. The organization license e
516502 shall submit to the Commission an annual balance sheet, profit -and-
517503 loss statement, and any other information the Commission deems
518504 necessary in order to administer the pro visions of the Oklahoma
519505 Horse Racing Act;
520506 17. 18. Have the authority to suspend or revoke a license or
521507 impose fines in amounts not to exceed Ten Thousand Dollars

550535 not to exceed Twenty Thous and Dollars ($20,000.00) agai nst
551536 organization licensees for each violation of any pr ovision of the
552537 Oklahoma Horse Racing Act, any rules adopted by the Commission, or
553538 any order of the Commission, or for any other action which, in the
554539 discretion of the Commi ssion, is a detriment or impe diment to horse
555540 racing or both such suspension or revoc ation and fine. Each day
556541 upon which such violation or other action by the organization
557542 licensee occurs shall constitute a separate offense;
558543 18. 19. Have authority to susp end a horse from participating in
559544 races if the horse has been involved in any violat ion of the rules
560545 promulgated by the Commission or the provisions of the Oklahoma
561546 Horse Racing Act; and
562547 19. 20. Prepare and submit an annual report t o the Governor,
563548 the Speaker of the House of Representatives, and the President Pro
564549 Tempore of the Senate. The report shall include an account of the
565550 operations, actions, and orders of the Commission, and an accounting
566551 of all revenue received by the Commis sion.
567552 B. 1. The Commission may delegate to stewards or the Executive
568553 Director, those of its powers and du ties as it deems necessary to
569554 fully implement and effectuate the purposes of the Oklahoma Horse
570555 Racing Act.
571556 2. The Commission, upon appeal or due co nsideration, may
572557 overrule any decision of a steward except d ecisions regarding

600584 disqualifications for interf erence during the running of a race if a
601585 preponderance of evidence indicates:
602586 a. the stewards mistakenly interpreted the law,
603587 b. new evidence of a co nvincing nature is prod uced, or
604588 c. the best interests of rac ing and the state may be
605589 better served.
606590 3. Any decision pertaining to the finish of a race, as used for
607591 purposes of pari-mutuel pool distribution to winning ticket holders,
608592 may not be overruled. Any decision pertainin g to the distribution
609593 of purses may be changed only if a claim is made in writing to the
610594 Commission by one of the involved owners or trainers, and a
611595 preponderance of evidence clearly indicates to the Commission that
612596 one or more of the grounds for protest, as provided for in the rules
613597 prepared by the Commission, has been substantiated.
614598 SECTION 3. NEW LAW A new section of law to be codified
615599 in the Oklahoma Statutes as Section 205.9 of Title 3A, unless there
616600 is created a duplication in numbering, reads as follows:
617601 Any advance deposit wagering provider that accepts f unds from an
618602 Internet Protocol address within the State of Oklahoma, pursuant to
619603 the Interstate Horseracing Act of 1978, found in Section 3001 et
620604 seq. of Title 15 of the United States Code, must obtain an advance
621605 deposit wagering license from the Oklahoma Hor se Racing Commission.
