57	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	53		SECTION 1. AMENDATORY 3A O.S. 2021, Section 200.1, is
59	54		amended to read as follows:
60	55		Section 200.1 A. As used in the Oklahoma Horse Racing Act:
61	56		1. "Advance deposit wagering" means a form of pari-mutuel
62	57		wagering by an individual who has established an account with an
63	58		advance deposit wagering provider and who uses the account for pari -
64	59		mutuel wagering on inter state horse races pursuant to the Interstate
65	60		Horseracing Act of 1978 found in Sections 3001 et seq. of Title 15

94	88		2. "Advance deposit wagering provider" means any person or
95	89		entity located outside of Oklahoma that conducts advance deposit
96	90		wagering;
97	91		3. "Commission" means the Oklahoma Ho rse Racing Commission;
98	92		2. 4. "Enclosure" means all buildings, structures and grounds
99	93		utilized for the conduct of a race meeting and/or gaming at the race
100	94		track and any additional areas designated by the Oklahoma Horse
101	95		Racing Commission;
102	96		3. 5. "Family" means husband, wife, and any dependent children;
103	97		4. 6. "Financial interest" means an interest that could result
104	98		in directly or indirectly receiving a pecuni ary gain or sustaining a
105	99		pecuniary loss as a result of ownership or interest in a business
106	100		entity, or as a result of salary, gra tuity, or other comp ensation or
107	101		remuneration from any person;
108	102		5. 7. "Horse racing" means any type of horse racing, including,
109	103		but not limited to, Arabian, Appaloosa, Paint, Pinto, Quarter Horse,
110	104		and Thoroughbred horse racing.
111	105		a. "Arabian horse racing " means the form of horse racing
112	106		in which each participating horse is an Arabian horse
113	107		registered with the Arabian Horse Club Registry o f
114	108		America and approved by the Arabian Horse Racing
115	109		Association of America or any successor organiz ation,
116	110		mounted by a jockey, and engaged in races on the flat

144	137		over a distance of not less than one -quarter (1/4)
145	138		mile or more than four (4) miles.
146	139		b. "Appaloosa horse racing" means the form of horse
147	140		racing in which each participating horse is an
148	141		Appaloosa horse registered with the Ap paloosa Horse
149	142		Club or any successor organization and mounted by a
150	143		jockey.
151	144		c. "Quarter Horse racing " means the form of horse racing
152	145		where each participating horse is a Quarter Horse
153	146		registered with the American Quarter Horse Assoc iation
154	147		or any successor org anization, mounted b y a jockey,
155	148		and engaged in a race on the flat.
156	149		d. "Paint horse racing" means the form of horse racing in
157	150		which each participating horse is a Paint horse
158	151		registered with the American Paint Horse Association
159	152		or any successor organization and mounted by a joc key.
160	153		e. "Pinto horse racing" means the form of horse racing in
161	154		which each participating horse is a Pinto horse
162	155		registered with the Pinto Horse Association of
163	156		America, Inc. or any successor organization and
164	157		mounted by a jockey.
165	158		f. "Thoroughbred horse racing " means the form of horse
166	159		racing in which each participating horse is a
167	160		Thoroughbred horse registered with the Jockey Club or

195	187		any successor organization, mounted by a jockey, and
196	188		engaged in races on the flat.
197	189		"Horse racing" shall not mean the racing of a c loned horse or
198	190		offspring of a cloned horse regardless of whether any breed
199	191		association has registered the horse ;
200	192		6. 8. "Minor" means any individual under eighteen (18) years of
201	193		age;
202	194		7. 9. "Minus pool" means a pari-mutuel pool in which , after
203	195		deducting the take-out, not enough money remains in the pool to pay
204	196		the legally prescribed minimum return to those placing winnin g
205	197		wagers, and in which the organization licensee would be required to
206	198		pay the remaining amou nt due;
207	199		8. 10. "Occupation licensee" means any person who has obtained
208	200		an occupation license;
209	201		9. 11. "Organization licensee " means any person receiving an
210	202		organization license;
211	203		10. 12. "Pari-mutuel system of wagering " means a form of
212	204		wagering on the outcome of horse races in whic h those who wager
213	205		purchase wagers of various denominations on a horse or horses and
214	206		all wagers for each race are pooled and held by the organization
215	207		licensee for distribution. The pari -mutuel system of wagering uses
216	208		an electric totalizator or similar equi pment which automati cally
217	209		registers the wagers made on each horse;

245	236		11. 13. "Pari-mutuel pool" means the total money wagered by
246	237		individuals on any horse or horses in a particular horse race to
247	238		win, place, or show and held by the organization licensee pursu ant
248	239		to the pari-mutuel system of wagering. There is a separate pari -
249	240		mutuel pool for win, for place, for show, and for each multiple
250	241		combination of betti ng approved by the Oklahoma Horse Racing
251	242		Commission;
252	243		12. 14. "Person" means any individual, partnershi p,
253	244		corporation, or other association or entity; and
254	245		13. 15. "Race meeting" means the entire period of time not to
255	246		exceed twenty (20) calendar days separating an y race days for which
256	247		an organization license has been granted to a person by the
257	248		Commission to hold horse races at which the pari-mutuel system of
258	249		wagering is conducted, to hold non -pari-mutuel horse races or to
259	250		conduct accredited work or training races.
260	251		B. The Commission may define by rule or regulation any term
261	252		which is not defined in the Oklaho ma Horse Racing Act.
262	253		SECTION 2. AMENDATORY 3A O.S. 2021, Section 204, is
263	254		amended to read as follows:
264	255		Section 204. A. The Oklahoma Horse Racing Commission shall:
265	256		1. Have supervision of :
266	257		a. all race meetings held in this state; provided, for
267	258		non-pari-mutuel race meetings and training races held
268	259		at non-pari-mutuel tracks jurisdiction of the

296	286		Commission shall be limited to a period of time
297	287		beginning twelve (12) hours before the commencement of
298	288		the first race on a race day and ending four (4) hours
299	289		after the finish of the last race on a race day,
300	290		b. all occupation and organizatio n licensees in this
301	291		state, and
302	292		c. all persons on the property of an organization
303	293		licensee; provided, for non -pari-mutuel race meetings
304	294		and training races held at non -pari-mutuel tracks
305	295		supervision of such persons shall be limited to the
306	296		period set out in subparagraph a of this paragraph;
307	297		2. Have the authority to promulgate rules for the purpose of
308	298		administering the pr ovisions of the Oklahoma Horse Racing Act;
309	299		3. Administer and en force the provisions of the Oklahoma Horse
310	300		Racing Act and the rules of the Co mmission;
311	301		4. Adjudicate controversies arising from the enforcement of the
312	302		provisions of the Oklahoma Horse Racing Act and the rules of the
313	303		Commission;
314	304		5. Allocate racing days of not to exceed six (6) days per
315	305		calendar week, dates, and hours which are in the best interests of
316	306		the people of this state to organization licensees;
317	307		6. Promulgate rules for the granting or refusing and the
318	308		suspension or revoking of licenses;

346	335		7. Promulgate rules for the holding, conducting, and operating
347	336		of all race meetings hel d in this state; provided, the rules of the
348	337		American Quarter Horse Association for regulation of the holding,
349	338		conducting and operating of non-pari-mutuel race meetings and
350	339		training races held at non-pari-mutuel tracks shall serve as the
351	340		rules for the holding, conducting and operating of non -pari-mutuel
352	341		race meetings and training races held at non -pari-mutuel tracks,
353	342		except that appeals from decisions of the stewards shall be to the
354	343		Commission, until such time as the Commission has promulgated
355	344		substantially similar rules for regulation of the holding,
356	345		conducting and operating of non -pari-mutuel race meetings and
357	346		training races held at non-pari-mutuel tracks;
358	347		8. Promulgate rules to establish the terms and requirements for
359	348		obtaining and maintaining an advance deposit wagering license;
360	349		9. Have supervision and control of the pari -mutuel machines and
361	350		all other equipment a t all race meetings held in this state;
362	351		9. 10. Check the making of pari-mutuel pools and the
363	352		distribution of such pools and shall:
364	353		a. contract with the Office of the State Auditor and
365	354		Inspector to conduct an annual audit and inspection of
366	355		live race meets in this state, and
367	356		b. reimburse the Office of the State Auditor and
368	357		Inspector for the cost of these services;
369	358		10. 11. Promulgate rules governing:

398	386		b. the rate charged by an organization licensee for
399	387		admission to races, and
400	388		c. the rate charged for the perfor mance of any service or
401	389		for the sale of any art icle on the premises of an
402	390		organization licensee;
403	391		11. 12. Approve all contracts and agreements for the payment of
404	392		money and all salaries, fees, and compensations by any organization
405	393		licensee;
406	394		12. 13. Have the authority to exclude, or compel the exclusion ,
407	395		from any race meeting:
408	396		a. any person who violates the provisions of any rule or
409	397		order of the Commission or any law of this state, any
410	398		other state, or the United S tates,
411	399		b. any person who has been previously convicted of
412	400		violating any law of this state, a ny other state, the
413	401		United States, or
414	402		c. any other person, licensed or unlicensed, whose
415	403		conduct or reputation is such that his or her presence
416	404		at the race meeting may, in the opinion of the
417	405		Commission reflect on the honesty and integrity of
418	406		horse racing or interfere with the orderly conduct of
419	407		the race meeting. No person shall be excluded or

447	434		ejected from a race meeting solely on the grounds of
448	435		race, color, creed, sex, national origin, o r ancestry;
449	436		13. 14. Have investigatory powers and authority to place
450	437		attendants and such other persons as may be deemed necessary by the
451	438		Commission in the offices, on the tracks, or in places of business
452	439		of any organization licensee for the purpose of det ermining whether
453	440		an organization or occupation licensee is complying w ith the
454	441		provisions of the Oklahoma Ho rse Racing Act and the rules of the
455	442		Commission;
456	443		14. 15. Have authority to acquire or contract with, or
457	444		establish, maintain, and operate testing labo ratories and related
458	445		facilities for the purpose of conducting:
459	446		a. human substance abuse testing on occupati on licensees
460	447		who may affect the outcome of race results. Human
461	448		substance abuse tests and the laboratories performing
462	449		such tests must meet the nation ally recognized
463	450		standards specified in the Mandatory Guidelines for
464	451		Federal Workplace Drug Testing Programs adopted by the
465	452		United States Department of Health and Human Services.
466	453		The Commission may require any occupation licensee to
467	454		submit to a human subst ance abuse test if the
468	455		Commission has probable cause to believe that s uch
469	456		licensee is possessing or using a ny controlled
470	457		dangerous substance or any other drug in violation of

498	484		any federal or state law. Provided, on and after July
499	485		1, 1994, such testing shal l be in compliance with the
500	486		provisions of the Standards for Workplace Drug and
501	487		Alcohol Testing Act, and
502	488		b. a saliva test, a blood test, a urine test, or other
503	489		tests or combinations of tests on the horses run or to
504	490		be run in any race meeting. Prior to the Commission
505	491		entering into any contract pursuant to this paragraph,
506	492		the Attorney General shall review and app rove the
507	493		contract. Any contract entered into pursuant to this
508	494		paragraph shall contain the specifications that were
509	495		in the request for bid for the co ntract;
510	496		15. 16. Approve of all proposed con struction on property owne d
511	497		or leased by an organization licens ee;
512	498		16. 17. Have authority to require that all financial,
513	499		employment, or other records of an organization licensee shall be
514	500		kept in such manner as p rescribed by the Commis sion and shall be
515	501		subject to inspection by the Commission. The organization license e
516	502		shall submit to the Commission an annual balance sheet, profit -and-
517	503		loss statement, and any other information the Commission deems
518	504		necessary in order to administer the pro visions of the Oklahoma
519	505		Horse Racing Act;
520	506		17. 18. Have the authority to suspend or revoke a license or
521	507		impose fines in amounts not to exceed Ten Thousand Dollars

549	534		($10,000.00) against individuals for each violation and in amounts
550	535		not to exceed Twenty Thous and Dollars ($20,000.00) agai nst
551	536		organization licensees for each violation of any pr ovision of the
552	537		Oklahoma Horse Racing Act, any rules adopted by the Commission, or
553	538		any order of the Commission, or for any other action which, in the
554	539		discretion of the Commi ssion, is a detriment or impe diment to horse
555	540		racing or both such suspension or revoc ation and fine. Each day
556	541		upon which such violation or other action by the organization
557	542		licensee occurs shall constitute a separate offense;
558	543		18. 19. Have authority to susp end a horse from participating in
559	544		races if the horse has been involved in any violat ion of the rules
560	545		promulgated by the Commission or the provisions of the Oklahoma
561	546		Horse Racing Act; and
562	547		19. 20. Prepare and submit an annual report t o the Governor,
563	548		the Speaker of the House of Representatives, and the President Pro
564	549		Tempore of the Senate. The report shall include an account of the
565	550		operations, actions, and orders of the Commission, and an accounting
566	551		of all revenue received by the Commis sion.
567	552		B. 1. The Commission may delegate to stewards or the Executive
568	553		Director, those of its powers and du ties as it deems necessary to
569	554		fully implement and effectuate the purposes of the Oklahoma Horse
570	555		Racing Act.
571	556		2. The Commission, upon appeal or due co nsideration, may
572	557		overrule any decision of a steward except d ecisions regarding

600	584		disqualifications for interf erence during the running of a race if a
601	585		preponderance of evidence indicates:
602	586		a. the stewards mistakenly interpreted the law,
603	587		b. new evidence of a co nvincing nature is prod uced, or
604	588		c. the best interests of rac ing and the state may be
605	589		better served.
606	590		3. Any decision pertaining to the finish of a race, as used for
607	591		purposes of pari-mutuel pool distribution to winning ticket holders,
608	592		may not be overruled. Any decision pertainin g to the distribution
609	593		of purses may be changed only if a claim is made in writing to the
610	594		Commission by one of the involved owners or trainers, and a
611	595		preponderance of evidence clearly indicates to the Commission that
612	596		one or more of the grounds for protest, as provided for in the rules
613	597		prepared by the Commission, has been substantiated.
614	598		SECTION 3. NEW LAW A new section of law to be codified
615	599		in the Oklahoma Statutes as Section 205.9 of Title 3A, unless there
616	600		is created a duplication in numbering, reads as follows:
617	601		Any advance deposit wagering provider that accepts f unds from an
618	602		Internet Protocol address within the State of Oklahoma, pursuant to
619	603		the Interstate Horseracing Act of 1978, found in Section 3001 et
620	604		seq. of Title 15 of the United States Code, must obtain an advance
621	605		deposit wagering license from the Oklahoma Hor se Racing Commission.
