4040 An Act relating to schools; amending 70 O.S. 2021,
4141 Section 21-101.1, which relates to exemptions from
4242 licensing by the Oklahoma Board of Private Vocational
4343 Schools; adding an exemption; and providing an

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 70 O.S. 2021, Section 21 -101.1, is
5252 amended to read as fol lows:
5353 Section 21-101.1 The term "private school" shall not include
5454 the following which are exempt from licensing by the Oklahoma Board
5555 of Private Vocational Schools:
5656 1. Barber schools, beauty schools or other schools which are
5757 exclusively regulated or licensed pursuant to the provisions of any
5858 school-licensing law of this state, although such school may c hoose
5959 to apply to secure a license for state authorization from the Board;
6060 2. Any form of flight instruction subject to regulations
6161 promulgated by the Federal Aviation Administration;

8888 3. Parochial, private or other nonpublic schools offering
8989 programs of general education accredited or approved by the State
9090 Board of Education, the State Board of Career and Technology
9191 Education or the State Regents for Higher Education;
9292 4. Education or training, as approved by the Board, provided
9393 and paid for by:
9494 a. an employer for its own employees,
9595 b. a professional organization, as approved by the Board,
9696 for its members,
9797 c. a parochial, denominational, el eemosynary school or
9898 institution, which is sectarian in nature and uniquely
9999 useful for and intrinsic to the propagatio n of a faith
100100 or the pursuit of the mission of the school or
101101 institution as approved by the Board, or
102102 d. an entity supported by taxation of a local or state
103103 source;
104104 5. Education or training , as approved by the Board, which
105105 offers instruction solely in the field of an avocation, hobby,
106106 recreation or entertainment , as approved by the Board ;
107107 6. Professional prelicensing programs or continuing education
108108 programs when an alternate state agency maintains complete authority
109109 or jurisdiction over the right to offer or certify such a program,
110110 regardless if the other agency mandates the subject matter of the
111111 program;

138138 7. Postgraduate certificates offer ed or provided by a school
139139 that has approval for that specific program issued by another state
140140 agency or an accreditin g agency approved by the Board;
141141 8. If a private school combines training or education that is
142142 both licensed and not licensed by another s tate agency, licensing by
143143 the Board will be required for the entity 's combined programs.
144144 However, the Board will defe r to the other state agency on matters
145145 contained in the other agency 's regulations and will refrain from
146146 establishing conflicting requirem ents. Matters to be governed by
147147 the other state agency may include but are not limited to
148148 curriculum, testing or cert ification completion. The Board may
149149 require a private school to document its approval by any other state
150150 agency or an accrediting organiz ation; and
151151 9. Seminars or workshops offered by an entity that:
152152 a. is not primarily in the business of providing progr ams
153153 of instruction,
154154 b. provides instruction to advance the personal
155155 development or general, transferable skills of a
156156 participant, and
157157 c. offers aggregate clock or contact hours of no more
158158 than twenty-four (24) clock or defined contact hours
159159 per calendar quarter of the calendar year; and

186186 10. Education or training via distance learning, as approved by
187187 the Board, which offers instruction solely in the field of
188188 gunsmithing.
189189 SECTION 2. This act shall become effect ive November 1, 2022.
