5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18-113.1, is
5858 amended to read as follows:
5959 Section 18-113.1 A. The provisions of this subsection shall
6060 apply only to grades one through three.
6161 1. Except as otherwise provided for in this section, no child
6262 shall be included in the average da ily membership of a school
6363 district for the purpose of computing and paying state -appropriated
6464 funds if that child is regularly assigned to a teacher or to a class
6565 that includes more than twenty (20) students.

9292 2. If a class or classes in a grade exceed th e class size
9393 limitation provided for in this subsection, the class size
9494 limitation and penalty shall not apply if:
9595 a. the creation of an additional class would cause a
9696 class to have fewer than ten (10) students; and
9797 b. a teacher's assistant, as defined in Section 6-127 of
9898 this title, is employed to serve with each teacher in
9999 a class that exceeds the class size limitation
100100 provided for in this subsection.
101101 3. No school district shall be penalized for exceeding class
102102 size limitations set forth in this subsecti on if the limitations are
103103 exceeded beginning after the first nine (9) weeks of the school
104104 year.
105105 Any school district found to be in violation of the provisions
106106 of this subsection shall receive a penalty in the State Aid formula
107107 as a reduction to State Aid t o be determined as follows:
108108 a. Multiply each pupil in excess of the class size
109109 membership limit as provided in this subsection by the
110110 grade level weight and by the Base Foundation Support
111111 Level for the current school year, and
112112 b. Multiply each pupil in exc ess of the class size
113113 membership limit as provided in this subsection by the
114114 grade level weight and by the Incentive Aid guarantee

195195 grade level weight and by the Incentive Aid guarantee

197197 c. Sum the products of subparagraphs a and b of this
198198 paragraph.
199199 C. Classes in the following subjects shall not be subject to
200200 the class size limitations provided for in subsections A and B of
201201 this section:
202202 1. Physical education; and
203203 2. Chorus, band, orchestra and similar music classes.
204204 D. If a school district groups its grades as grades one thr ough
205205 five, grades six through eight, and grades nine through twelve, then
206206 as to such district the provisions of subsection B of this section
207207 shall apply to grades four and five rather than grades four through
208208 six, and the provisions of Section 18 -113.3 of this title shall
209209 apply to grades six through twelve.
210210 E. Any violations of the provisions of this section shall
211211 result in denial of accreditation in accordance with the
212212 requirements of Section 3 -104.4 of this title.
213213 F. Any school district which at the beg inning of the school
214214 year does not have sufficient classrooms to meet the class size

242242 established by the State Board of Education shall not be penalized
243243 for failure to meet the class size l imitations provided for in this
244244 section if:
245245 a. the school district has voted indebtedness, at any
246246 time within the five (5) years preceding the year the
247247 district exceeds the class size limitations or during
248248 the year the district exceeds the class size
249249 limitations, through the issuance of bonds or approval
250250 by voters of issuance of new bonds for more than
251251 eighty-five percent (85%) of the maximum allowable
252252 pursuant to the provisions of Section 26 of Article X
253253 of the Oklahoma Constitution as shown on the school
254254 district budget filed with the State Equalization
255255 Board for the current school year and certifications
256256 by the Attorney General prior to February 1 of the
257257 current school year; and
258258 b. on the date of filing of the school district budget
259259 with the State Equaliz ation Board, the school district
260260 is voting the maximum millage allowable for the
261261 support, maintenance and construction of schools as
262262 provided for in subsections (a), (c), (d) and (d -1) of
263263 Section 9 of Article X of the Oklahoma Constitution

292292 G. Any school district which exceeds the class size limitations
293293 as set forth in this section shall submit a written report to the
294294 State Board of Education, on or before July 1 of each year, setting
295295 forth the procedures that the district will follow in order to
296296 comply with this section.
297297 H. G. School districts which receive state -appropriated funds
298298 pursuant to the provisions of Section 18 -112.2 of this title and do
299299 not comply with the provisions of this section shal l be subject to
300300 loss of State Aid for each child in excess of the class size
301301 limitations specified in this section.
302302 SECTION 2. AMENDATORY 70 O.S. 2021, Section 18 -113.2, is
303303 amended to read as follows:
304304 Section 18-113.2 A. The provisions of this section shall apply
305305 only to kindergarten.
306306 1. No child shall be included in the average daily membership
307307 of a school district for the purpose of com puting and paying state -
308308 appropriated funds if that child is regularly assigned to a teacher
309309 or to a class that includes more than twenty (20) students.
310310 2. If a class or classes in a grade exceed the class size
311311 limitation provided for in this subsection, t he class size

345345 3. No school district shall be penalized for exceeding class
346346 size limitations set forth in this section if the limitations are
347347 exceeded beginning after the first nine (9) weeks of the school
348348 year.
349349 4. Any school district which at the beginning of the sch ool
350350 year does not have sufficient classrooms to meet the class size
351351 limitation provided for in this section as determined by guidelines
352352 established by the State Boa rd of Education shall not be penalized
353353 for failure to meet the class size limitations provid ed for in this
354354 section if:

441441 B. Any violations of the provisions of this section shall
442442 result in denial of accreditation in accordance with the
443443 requirements of Section 3 -104.4 of this title.
444444 C. School districts which receive state -appropriated funds
445445 pursuant to the provisions of Section 18 -112.2 of this title and do
446446 not comply with the provisions of this sec tion shall be subject to
447447 loss of State Aid for each child in excess of the class size
448448 limitations specified in this section.
449449 SECTION 3. AMENDATORY 70 O.S. 2021, Section 18 -113.3, is
450450 amended to read as follows:
451451 Section 18-113.3 A. Class size, as used in Section 18-113.1
452452 and Section 18-113.2 of this title, shall be determined by the
453453 average daily membersh ip divided by the full -time equivalency of the
454454 instructional staff assigned to each grade level by site. Full -time
455455 equivalency of special education teachers, Chapter 1 teachers, and
456456 teachers of classes not subject to class size limitations and the
457457 average daily membership of self -contained special education classes
458458 shall not be counted in class size computation.
459459 B. As used in this section, self-contained special education
460460 classes are those classes whose students attend the same class for
461461 three (3) or more class periods and who have individualized
462462 education plans.

489489 C. Beginning with the 1996 -97 school year and each school year
490490 thereafter, no teacher who is counted in class size count for grades
491491 seven through twelve shall be responsible for the instruction o f
492492 more than one hundred forty (140) students on any given six -hour
493493 school day. Class size count shall be taken during the month of
494494 October of each school year on a date set by the State Board of
495495 Education. If the class size count is in excess of the limi ts set
496496 forth in this subsection, the school district shall be subject to
497497 the penalties provided for in this section.
498498 D. Students within a class which is not subject to class size
499499 limitations pursuant to subsection D of Section 18 -113.1 of this
500500 title shall not be counted for purposes of the limitations set forth
501501 in subsection C of this section.
502502 E. No school district shall be penali zed for exceeding class
503503 size limitations set forth in this section if the limitations are
504504 exceeded beginning after the first ni ne (9) weeks of the school
505505 year.
506506 F. The first year that a school district exceeds the class size
507507 membership limitation as establ ished and computed in subsection C of
508508 this section, the district shall receive as a penalty a reduction in
509509 the State Aid for th e district. For each child in excess of the
510510 class size limitation, the reduction in State Aid to the district
511511 shall be determined as follows:

538538 1. Multiply the averaged number of the October class size count
539539 of pupils which is in excess of the class size m embership limit as
540540 provided for in subsection C of this section by the grade weight and
541541 by the Base Foundation Support Level for the current school year;
542542 2. Multiply the averaged number of the October class size count
543543 of pupils which is in excess of the c lass size membership limit as
544544 provided for in subsection C of this section by the grade level
545545 weight and by the Incentive Aid gua rantee for the current school
546546 year times twenty (20); and
547547 3. Sum the products of paragraphs 1 and 2 of this subsection.
548548 G. If a school district exceeds the class size membership
549549 limitation as established and computed in subsection C of this
550550 section for two (2) consecutive years, the district shall receive as
551551 a penalty denial of accreditation in accordance with the
552552 requirements of Section 3-104.4 of this title.
553553 H. For the purpose of determining whether a penalty for
554554 exceeding class size limitations shall apply, a federally funded
555555 bilingual assistant shall not qualify as a teacher 's assistant.
556556 I. Any school district which at the beginning of the school
557557 year does not have sufficient classrooms to meet the class size
558558 limitation provided for in this section a s determined by guidelines
559559 established by the State Board of Education shall not be penalized
560560 for failure to meet the class siz e limitations provided for in this
