56	56	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57	SECTION 1. AMENDATORY 70 O.S. 2021, Section 18-113.1, is
58	58	amended to read as follows:
59	59	Section 18-113.1 A. The provisions of this subsection shall
60	60	apply only to grades one through three.
61	61	1. Except as otherwise provided for in this section, no child
62	62	shall be included in the average da ily membership of a school
63	63	district for the purpose of computing and paying state -appropriated
64	64	funds if that child is regularly assigned to a teacher or to a class
65	65	that includes more than twenty (20) students.

92	92	2. If a class or classes in a grade exceed th e class size
93	93	limitation provided for in this subsection, the class size
94	94	limitation and penalty shall not apply if:
95	95	a. the creation of an additional class would cause a
96	96	class to have fewer than ten (10) students; and
97	97	b. a teacher's assistant, as defined in Section 6-127 of
98	98	this title, is employed to serve with each teacher in
99	99	a class that exceeds the class size limitation
100	100	provided for in this subsection.
101	101	3. No school district shall be penalized for exceeding class
102	102	size limitations set forth in this subsecti on if the limitations are
103	103	exceeded beginning after the first nine (9) weeks of the school
104	104	year.
105	105	Any school district found to be in violation of the provisions
106	106	of this subsection shall receive a penalty in the State Aid formula
107	107	as a reduction to State Aid t o be determined as follows:
108	108	a. Multiply each pupil in excess of the class size
109	109	membership limit as provided in this subsection by the
110	110	grade level weight and by the Base Foundation Support
111	111	Level for the current school year, and
112	112	b. Multiply each pupil in exc ess of the class size
113	113	membership limit as provided in this subsection by the
114	114	grade level weight and by the Incentive Aid guarantee

199	199	C. Classes in the following subjects shall not be subject to
200	200	the class size limitations provided for in subsections A and B of
201	201	this section:
202	202	1. Physical education; and
203	203	2. Chorus, band, orchestra and similar music classes.
204	204	D. If a school district groups its grades as grades one thr ough
205	205	five, grades six through eight, and grades nine through twelve, then
206	206	as to such district the provisions of subsection B of this section
207	207	shall apply to grades four and five rather than grades four through
208	208	six, and the provisions of Section 18 -113.3 of this title shall
209	209	apply to grades six through twelve.
210	210	E. Any violations of the provisions of this section shall
211	211	result in denial of accreditation in accordance with the
212	212	requirements of Section 3 -104.4 of this title.
213	213	F. Any school district which at the beg inning of the school
214	214	year does not have sufficient classrooms to meet the class size

251	251	eighty-five percent (85%) of the maximum allowable
252	252	pursuant to the provisions of Section 26 of Article X
253	253	of the Oklahoma Constitution as shown on the school
254	254	district budget filed with the State Equalization
255	255	Board for the current school year and certifications
256	256	by the Attorney General prior to February 1 of the
257	257	current school year; and
258	258	b. on the date of filing of the school district budget
259	259	with the State Equaliz ation Board, the school district
260	260	is voting the maximum millage allowable for the
261	261	support, maintenance and construction of schools as
262	262	provided for in subsections (a), (c), (d) and (d -1) of
263	263	Section 9 of Article X of the Oklahoma Constitution

293	293	as set forth in this section shall submit a written report to the
294	294	State Board of Education, on or before July 1 of each year, setting
295	295	forth the procedures that the district will follow in order to
296	296	comply with this section.
297	297	H. G. School districts which receive state -appropriated funds
298	298	pursuant to the provisions of Section 18 -112.2 of this title and do
299	299	not comply with the provisions of this section shal l be subject to
300	300	loss of State Aid for each child in excess of the class size
301	301	limitations specified in this section.
302	302	SECTION 2. AMENDATORY 70 O.S. 2021, Section 18 -113.2, is
303	303	amended to read as follows:
304	304	Section 18-113.2 A. The provisions of this section shall apply
305	305	only to kindergarten.
306	306	1. No child shall be included in the average daily membership
307	307	of a school district for the purpose of com puting and paying state -
308	308	appropriated funds if that child is regularly assigned to a teacher
309	309	or to a class that includes more than twenty (20) students.

449	449	SECTION 3. AMENDATORY 70 O.S. 2021, Section 18 -113.3, is
450	450	amended to read as follows:
451	451	Section 18-113.3 A. Class size, as used in Section 18-113.1
452	452	and Section 18-113.2 of this title, shall be determined by the
453	453	average daily membersh ip divided by the full -time equivalency of the
454	454	instructional staff assigned to each grade level by site. Full -time
455	455	equivalency of special education teachers, Chapter 1 teachers, and
456	456	teachers of classes not subject to class size limitations and the
457	457	average daily membership of self -contained special education classes
458	458	shall not be counted in class size computation.
459	459	B. As used in this section, self-contained special education
460	460	classes are those classes whose students attend the same class for
461	461	three (3) or more class periods and who have individualized
462	462	education plans.

489	489	C. Beginning with the 1996 -97 school year and each school year
490	490	thereafter, no teacher who is counted in class size count for grades
491	491	seven through twelve shall be responsible for the instruction o f
492	492	more than one hundred forty (140) students on any given six -hour
493	493	school day. Class size count shall be taken during the month of
494	494	October of each school year on a date set by the State Board of
495	495	Education. If the class size count is in excess of the limi ts set
496	496	forth in this subsection, the school district shall be subject to
497	497	the penalties provided for in this section.
498	498	D. Students within a class which is not subject to class size
499	499	limitations pursuant to subsection D of Section 18 -113.1 of this
500	500	title shall not be counted for purposes of the limitations set forth
501	501	in subsection C of this section.
502	502	E. No school district shall be penali zed for exceeding class
503	503	size limitations set forth in this section if the limitations are
504	504	exceeded beginning after the first ni ne (9) weeks of the school
505	505	year.
506	506	F. The first year that a school district exceeds the class size
507	507	membership limitation as establ ished and computed in subsection C of
508	508	this section, the district shall receive as a penalty a reduction in
509	509	the State Aid for th e district. For each child in excess of the
510	510	class size limitation, the reduction in State Aid to the district
511	511	shall be determined as follows:

549	549	limitation as established and computed in subsection C of this
550	550	section for two (2) consecutive years, the district shall receive as
551	551	a penalty denial of accreditation in accordance with the
552	552	requirements of Section 3-104.4 of this title.
553	553	H. For the purpose of determining whether a penalty for
554	554	exceeding class size limitations shall apply, a federally funded
555	555	bilingual assistant shall not qualify as a teacher 's assistant.
556	556	I. Any school district which at the beginning of the school
557	557	year does not have sufficient classrooms to meet the class size
558	558	limitation provided for in this section a s determined by guidelines
559	559	established by the State Board of Education shall not be penalized
