5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5653 SECTION 1. AMENDATORY 65 O.S. 2021, Section 1 -105, is
5754 amended to read as follows:
5855 Section 1-105. A. Any library which is in whole or in part
5956 supported by public funds including but not limited to public,
6057 academic, school or special libra ries, and having records indicating
6158 which of its documents or other materials, regardless of format,
6259 have been loaned to or used by an identifiable individual or group
6360 shall not disclose such records to any person except to:
6461 1. Persons acting within the scope of their duties in the
6562 administration of the library;

9389 2. Persons authoriz ed to inspect such records, in writing, by
9490 the individual or group; or
9591 3. A parent or legal guardian requesting records of his or her
9692 minor child; or
9793 4. By order of a court of law.
9894 B. The requirements of this section shall not prohibit middle
9995 and elementary school libraries from maintaining a system of records
10096 that identifies the i ndividual or group to whom library materials
10197 have been loaned even if such sy stem permits a determinati on,
10298 independent of any discl osure of such information by the library,
10399 that documents or materials have been loaned to an individual or
104100 group.
105101 C. All registration information of minors collected by any
106102 library which is supported i n whole or in part by publ ic funds
107103 including but not limited to public, academic, school or special
108104 libraries shall not be disclosed to any person except:
109105 1. Persons acting only within the legitimate scope of their
110106 duties in the administration of the libr ary;
111107 2. Persons authorize d to inspect such records, i n writing, by
112108 the individual; or
113109 3. A parent or legal guardian requesting registration
114110 information of his or her minor child; or

143138 For purposes of this section, "registration information" includes
144139 any information required of a minor in order to become eligible to
145140 borrow books, utilize library services, and other materials.
146141 D. Any suspicious requests for records of minors that may be
147142 indicative of criminal intent shall be r eported immediately to
148143 appropriate law enforcement authorities.
149144 SECTION 2. This act shall become effective November 1, 2022.
