55	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	53		SECTION 1. AMENDATORY 65 O.S. 2021, Section 1 -105, is
57	54		amended to read as follows:
58	55		Section 1-105. A. Any library which is in whole or in part
59	56		supported by public funds including but not limited to public,
60	57		academic, school or special libra ries, and having records indicating
61	58		which of its documents or other materials, regardless of format,
62	59		have been loaned to or used by an identifiable individual or group
63	60		shall not disclose such records to any person except to:
64	61		1. Persons acting within the scope of their duties in the
65	62		administration of the library;

93	89		2. Persons authoriz ed to inspect such records, in writing, by
94	90		the individual or group; or
95	91		3. A parent or legal guardian requesting records of his or her
96	92		minor child; or
97	93		4. By order of a court of law.
98	94		B. The requirements of this section shall not prohibit middle
99	95		and elementary school libraries from maintaining a system of records
100	96		that identifies the i ndividual or group to whom library materials
101	97		have been loaned even if such sy stem permits a determinati on,
102	98		independent of any discl osure of such information by the library,
103	99		that documents or materials have been loaned to an individual or
104	100		group.
105	101		C. All registration information of minors collected by any
106	102		library which is supported i n whole or in part by publ ic funds
107	103		including but not limited to public, academic, school or special
108	104		libraries shall not be disclosed to any person except:
109	105		1. Persons acting only within the legitimate scope of their
110	106		duties in the administration of the libr ary;
111	107		2. Persons authorize d to inspect such records, i n writing, by
112	108		the individual; or
113	109		3. A parent or legal guardian requesting registration
114	110		information of his or her minor child; or
115	111		4. By order of a court of law.

143	138		For purposes of this section, "registration information" includes
144	139		any information required of a minor in order to become eligible to
145	140		borrow books, utilize library services, and other materials.
146	141		D. Any suspicious requests for records of minors that may be
147	142		indicative of criminal intent shall be r eported immediately to
148	143		appropriate law enforcement authorities.
149	144		SECTION 2. This act shall become effective November 1, 2022.
