100358 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

102359 SECTION 1. AMENDATORY 61 O.S. 2021, Section 1, is
103360 amended to read as follows:

105361 Section 1. A. Prior to an award of a cont ract exceeding Fifty
106362 Thousand Dollars ($50,000.00) One Hundred Thousand Dollars
107363 ($100,000.00) for construction or repair of a public or private
108364 building, structure, or improvement on publi c real property, the
109365 person that receives the award shall :

111366 1. Furnish furnish a bond with good and sufficient sureties
112367 payable to the state in a sum not less than the total sum of the
113368 contract; or

115369 2. Cause an irrevocable letter of credit, containing term s the
116370 Office of Management and Enterprise Services prescribes, to be
117371 issued for the benefit of the state by a financial institution
118372 insured by the Federal Deposit Insurance Corporation in a sum not
119373 less than the total sum of the contract.

121374 B. The bond or irrevocable letter of credit shall ensure the
122375 proper and prompt completion of the work in accordance with the
123376 contract and shall ensure that the contractor shall pay all
124377 indebtedness the contractor incu rs for the contractor's
125378 subcontractors and all supplier s of labor, material, rental of
126379 machinery or equipment, and rep air of and parts for equi pment the
127380 contract requires the contractor to furnish.

129407 C. For a contract not exceeding Fifty Thousand Dollars
130408 ($50,000.00), in lieu of a bond or irrevocable letter of credit, the
131409 contractor shall submit an affidavit of the payment of all
132410 indebtedness incurred by the contractor , the contractor's
133411 subcontractors, and all suppliers of labor, material, rented
134412 machinery or equipment, and repair of and parts for equipment used
135413 or consumed in the performance of the contract. The execution of

145421 municipality, with any corporation, person or perso ns, for the
146422 performance of any public work, by or on behalf of the state or any

148424 considered as made upon the basis of eight (8) hours c onstituting a
149425 day's work; and it shall be unlawful for such corporation, person or
150426 persons, to require, aid, abet, assist, connive at, or permi t any
151427 laborer, workman, mechanic, prison guard s, janitors in public
152428 institutions, or other person to work more th an eight hours per
153429 calendar day in doing such work, exc ept in cases and upon the

173472 institution of the state, or for any county there of, where the

181505 SECTION 4. AMENDATORY 61 O.S. 2021, Section 11, is

184507 Section 11. A. Unless otherwise provided for by law, all plans
185508 and specifications for the erection of public buildings by this
186509 state, or any agency or political subdivision thereof, or for any
187510 building erected through the use of public funds shall provide
188511 facilities for the handicapped people with disabilities . Such
189512 facilities shall conform with the c odes and standards adopted by the
190513 State Fire Marshal and amended by the Division's Office's
191514 promulgated rules. Elevators shall be constructed and installed in
192515 said public buildings to the extent deemed feasible and financially
193516 reasonable by the contractin g authority of the state or such
194517 political subdivision. Said codes and standards shall be on file in
195518 the Construction and Properties Division of the Office of Management
196519 and Enterprise Services.

209556 SECTION 5. AMENDATORY 61 O.S. 2021, Sec tion 12, is
210557 amended to read as follows:

212558 Section 12. All plans and specifications for the erection of
213559 public buildings subject to Section 11 of this title shall be
214560 submitted prior to bidding and awarding of contract to the governing
215561 body of the political e ntity controlling the funds involved State
216562 Fire Marshal or other authority having jurisdiction. Such plans and
217563 specifications shall be checked for compliance with Section 11 of
218564 this title, and no construction contract for any public building
219565 shall be awarded unless and until said plans and s pecifications are
220566 approved as being in compliance with Section 11 of this title by the
221567 appropriate governmental agency. If public buildings are to be
222568 financed by state funds, the Construction and Properties Division of
223569 the Office of Management and Enterpr ise Services shall approve said

321754 SECTION 8. AMENDATORY 61 O.S. 2021, Section 62, is

324756 Section 62. A. The Department of Real Estate Services of the
325757 Office of Management and Enterprise Services shall ma intain a file
326758 of all persons and entities interested i n and capable of performing
327759 construction management and consul tant services for state agencies.
328760 The file shall inclu de registration forms and information submit ted
329761 by construction managers and consulta nts pursuant to rules
330762 promulgated by the Office of Man agement and Enterprise Services.
331763 Pursuant to rules promulgate d by the Office, the Department Office
332764 shall determine whether a construction manager or consultant
333765 qualifies for registration and shall not ify the construction manager
334766 or consultant within twen ty (20) days of receipt of a request for
335767 registration. Constr uction managers and consultants shall re -
336768 register for each successive calendar year with the Department

339770 B. The requisitioning state agency shall define the scope of a
340771 proposed project. The scope shall identify project components,
341772 phases and timetables and shall include detailed project
342773 descriptions. The state agency may request the Department Office to
343774 assist with scope development. The state agency shall send the
