4040 An Act relating to definitions and general

4242 relates to public notices; modifying legal notice
4343 publication by newspaper; and providing an effective

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 25 O.S. 2021, Section 106, is
5252 amended to read as follows:
5353 Section 106. No legal notice, advertisemen t, or publication of
5454 any kind required or provided for by the laws of this state to be
5555 published in a newspaper shall have force or effect unless published
5656 in a legal newspaper of the county. A legal n ewspaper of the county
5757 is any newspaper which, during a period of one hundred four (104)
5858 consecutive weeks immediately prior to the first publication of such
5959 notice, advertisement, or publication:
6060 1. Has maintained a paid general subscription circulation in
6161 the county; and

8888 2. has been admitted to the United States mails as paid second -
8989 class mail matter; and
9090 3. Has been continuously and uninterruptedly published in the
9191 county.
9292 If there is no legal newspaper in a county, then all legal notices,
9393 advertisements, or publications of any kind required or provided for
9494 by the laws of this state shall be published in a legal newspaper in
9595 an adjoining county of this state, which newspaper has general
9696 circulation in the county or politic al subdivision in which such
9797 notice is required.
9898 Nothing in this section shall inval idate the publication of such
9999 legal notices, advertisements, or publications in a newspaper which
100100 has moved its place of publication from one location in the county
101101 to another location in the same count y without breaking the
102102 continuity of its regular issue s for the requisite length of time,
103103 or the name of which may have been changed when said change of
104104 location was made as permitted by United States postal laws and
105105 regulations. Failure to issue or publi sh said newspaper for a
106106 period of fourteen (14) days d ue to fire, accident, or other
107107 unforeseen cause, or by reason of the pendency of mortgage
108108 foreclosure, attachment, execution, or other legal proceedings
109109 against the type, presses, or other personal prop erty used by the
110110 newspaper, shall not be deemed a fail ure to maintain continuous and
111111 consecutive publication as required by the provisions of this

138138 section, nor shall said failure invalidate the publication of a
139139 notice otherwise valid. Failure to issue or publish a newspaper
140140 qualified to publish legal notices , advertisements, or publications
141141 of any kind, for a period totaling not more than fourteen (14)
142142 consecutive days during a calendar year shall not be deemed a
143143 failure to maintain continuous and consecut ive publication as
144144 required by the provisions of this section, nor shall said failure
145145 invalidate the publication of a notice otherwise valid.
146146 SECTION 2. This act shall become effective November 1, 2022.
