42	42	relates to public notices; modifying legal notice
43	43	publication by newspaper; and providing an effective

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 25 O.S. 2021, Section 106, is
52	52	amended to read as follows:
53	53	Section 106. No legal notice, advertisemen t, or publication of
54	54	any kind required or provided for by the laws of this state to be
55	55	published in a newspaper shall have force or effect unless published
56	56	in a legal newspaper of the county. A legal n ewspaper of the county
57	57	is any newspaper which, during a period of one hundred four (104)
58	58	consecutive weeks immediately prior to the first publication of such
59	59	notice, advertisement, or publication:
60	60	1. Has maintained a paid general subscription circulation in
61	61	the county; and

88	88	2. has been admitted to the United States mails as paid second -
89	89	class mail matter; and
90	90	3. Has been continuously and uninterruptedly published in the
91	91	county.
92	92	If there is no legal newspaper in a county, then all legal notices,
93	93	advertisements, or publications of any kind required or provided for
94	94	by the laws of this state shall be published in a legal newspaper in
95	95	an adjoining county of this state, which newspaper has general
96	96	circulation in the county or politic al subdivision in which such
97	97	notice is required.
98	98	Nothing in this section shall inval idate the publication of such
99	99	legal notices, advertisements, or publications in a newspaper which
100	100	has moved its place of publication from one location in the county
101	101	to another location in the same count y without breaking the
102	102	continuity of its regular issue s for the requisite length of time,
103	103	or the name of which may have been changed when said change of
104	104	location was made as permitted by United States postal laws and
105	105	regulations. Failure to issue or publi sh said newspaper for a
106	106	period of fourteen (14) days d ue to fire, accident, or other
107	107	unforeseen cause, or by reason of the pendency of mortgage
108	108	foreclosure, attachment, execution, or other legal proceedings
109	109	against the type, presses, or other personal prop erty used by the
110	110	newspaper, shall not be deemed a fail ure to maintain continuous and
111	111	consecutive publication as required by the provisions of this

138	138	section, nor shall said failure invalidate the publication of a
139	139	notice otherwise valid. Failure to issue or publish a newspaper
140	140	qualified to publish legal notices , advertisements, or publications
141	141	of any kind, for a period totaling not more than fourteen (14)
142	142	consecutive days during a calendar year shall not be deemed a
143	143	failure to maintain continuous and consecut ive publication as
144	144	required by the provisions of this section, nor shall said failure
145	145	invalidate the publication of a notice otherwise valid.
146	146	SECTION 2. This act shall become effective November 1, 2022.
