6362 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6463 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -190, is
6564 amended to read as follows:
6665 Section 6-190. A. The board of education of each school
6766 district shall employ and contract in writing, as required in
6867 Section 6-101 of this title, only with persons certified to teach by
6968 the State Board of Education in accordance with the Oklahoma Teacher

9997 B. The Board shall issue a cer tificate to teach to any person
10098 who:
10199 1. Has successfully completed th e teacher education program
102100 required by the Commission for Educational Quality an d
103101 Accountability;
104102 2. Has graduated from an accredited institution of higher
105103 education that has approval or accreditation for teacher education;
106104 3. Has met all other requirem ents as may be established by the
107105 Board;
108106 4. Has made the necessary application a nd paid the competency
109107 examination fee in an amount and as prescribed by the Commission;
110108 5. Has successfully completed the competency examination
111109 required in Section 6-187 of this title; and
112110 6. Beginning November 1, 2001, has on file with the Board a
113111 current Oklahoma criminal history record fr om the Oklahoma State
114112 Bureau of Investigation as well as a nation al criminal history
115113 record check as defined in S ection 150.9 of Title 74 of the Oklahoma
116114 Statutes. Upon receipt of the Oklahoma criminal history recor d, the
117115 Board may issue a temporary certi ficate which shall be effective
118116 until receipt of the national fin gerprint-based criminal history
119117 record. The person applying for a cer tificate shall be responsible
120118 for the cost of the criminal history records.

148145 C. The Board shall issue a certificate to te ach to any person

150147 1. Holds an out-of-state certificate and meets the requirements
151148 set forth in subsection G of this section;
152149 2. Holds certification from the National Board for Professional
153150 Teaching Standards;
154151 3. Holds an out-of-country certificate and meets the
155152 requirements set forth in subsection F of this sect ion; or
156153 4. Holds a certificate from a federally recognized tribal
157154 nation and meets the requirements set forth in subsection H of thi s
158155 section; or
159156 5. Has successfully completed a competency examination used in
160157 the majority of other states or comparable c ustomized exam and meets
161158 the requirements set for th in subsection H I of this section.
162159 D. Beginning July 1, 2004, any person applying for initial
163160 Oklahoma certification shall have on file wit h the Board a curren t
164161 Oklahoma criminal history record from the Oklahoma State Bureau of
165162 Investigation as well as a national criminal history record check as
166163 defined in Section 150.9 of Title 74 of the Oklahoma Statu tes. Upon
167164 receipt of the Oklahoma crimi nal history record, the Board may issue
168165 a temporary certificate which shall be effective until receipt of
169166 the national fingerprint-based criminal history record. The person
170167 applying for a certificate shall be respon sible for the cost of the
171168 criminal history records.

199195 E. Any person holding a valid certificate, issued p rior to
200196 January 1, 1997, shall be a certified tea cher for purposes of the
201197 Oklahoma Teacher Preparation Act, subject to any professional
202198 development requirements prescribed by the Oklahoma Teac her
203199 Preparation Act or by the State Board of Education.
204200 F. 1. The Board shall issue a certificate to teach to a person
205201 who holds a valid out -of-country certificate and meets any
206202 requirements established by the Boar d. The certificate to teach
207203 shall only be for those subject areas and grade levels most closely
208204 aligned to the subject areas and grade levels recognized on the out-
209205 of-country certificate.
210206 2. A person who meets the requirements of paragraph 1 of this
211207 subsection shall not be required to take any competency examinations
212208 in those subject areas and grade levels most closely aligned to the
213209 subject areas and gr ade levels recognized on the out -of-country
214210 certificate.
215211 3. A person who meets the requirements of par agraph 1 of this
216212 subsection shall have o n file with the Boar d a current Oklahoma
217213 criminal history record check from the Oklahoma State Bureau of

252247 4. The Board shall promulgate rules establishing a process by
253248 which out-of-country certificates will be reviewed and evaluated for
254249 purposes of awarding a certificate to teach pursuant to this
255250 subsection.
256251 G. 1. The Board shall i ssue a certificate to teach to a person
257252 who holds a valid out-of-state certificate. The cert ificate to
258253 teach shall only be for those subject areas and grade levels most
259254 closely aligned to the sub ject areas and grade levels recognized o n
260255 the out-of-state certificate.
261256 2. A person who meets the requi rements of paragraph 1 of this
262257 subsection shall not be required to take any competency examinations
263258 in those subject areas and grade levels most closely aligned to the
264259 subject areas and grade levels recognized on the out-of-state
265260 certificate.
266261 3. A person who meets the requirements of this subsection sha ll

303297 H. 1. The Board shall issue a certificate to teach to a person
304298 who holds a certificate from a federally recognized tribal nation.
305299 The certificate to teach shall only be for a school that is operated
306300 by the certificate-granting tribal nation within its reservation or
307301 treaty area boundaries.
308302 2. A person who meets the requirements of paragra ph 1 of this
309303 subsection shall not be required to take any compet ency examinations
310304 other than those required by th e certificate-granting tribal nation.
311305 3. A person who meets t he requirements of this subsection shall
312306 have on file with the Board a current Ok lahoma criminal history
313307 record check as defined in Section 150.9 of Title 74 of the Oklahoma
314308 Statutes. Upon receipt of the Oklahoma criminal history record
315309 check, the Board may issue a temporary certificate which sh all be
316310 effective until receipt of the na tional fingerprint-based criminal
317311 history record check. The per son applying for a certificate shall
318312 be responsible for the cost of the criminal history record checks.
319313 I. 1. The Board shall issue a certificate to t each to a person
320314 who has successfully co mpleted a competency exam used in a majority
321315 of the other states. The certificate to teach shall only be for
322316 those subject areas and grade levels that correspond with a
323317 certification area used in Oklahoma.

351344 2. A person who meets the requirements of paragr aph 1 of this
352345 subsection shall have on file with the Board a cur rent Oklahoma
353346 criminal history record check from the Oklahoma State Bureau of
354347 Investigation as well as a national criminal history record check as
355348 defined in Section 150.9 of Title 74 of the O klahoma Statutes. U pon
356349 receipt of the Oklahoma criminal history record check, the Board may
357350 issue a temporary ce rtificate which shall be effective until receipt
358351 of the national fingerprint -based criminal history rec ord check.
359352 The person applying for a ce rtificate shall be r esponsible for the
360353 cost of the criminal hist ory record checks.
361354 I. J. The Board shall issue a lead teaching certificate to any
362355 person who upon application:
363356 1. Has successfully completed the requi rements of this
364357 subsection;
365358 2. Has a minimum of five (5) years of experience as a teacher;
366359 3. Participates in a meaningful individualized program of
367360 professional development, as provided for in Section 6 -101.10 of
368361 this title;
369362 4. Has earned a "highly effective" or "superior" rating
370363 pursuant to Section 6-101.16 of this title; and
371364 5. May have a teaching loa d of not more than seventy -five
372365 percent (75%) student instruction to allow the teacher to mentor
373366 other teachers.

401393 J. K. 1. The Board shall issue a mast er teaching certificate
402394 to any person who upon application:
403395 a. has successfully completed the requiremen ts of this
404396 subsection,
405397 b. has a minimum of seven (7) years of experience as a
406398 teacher, and
407399 c. (1) has earned a "superior" rating pursuant to
408400 Section 6-101.16 of this title, or
409401 (2) has earned a "highly effective" rating pursuant
410402 to Section 6-101.16 of this title and holds or
411403 has held a National Board cert ification from the
412404 National Board for Professional Teaching
413405 Standards.
414406 2. Teachers with a master teach ing certificate may assume
415407 leadership roles that include but are n ot limited to:
416408 a. the planning and del ivery of professional development
417409 activities designed to improve instructional
418410 strategies,
419411 b. the facilitation of an instructional leadership team
420412 within the building or school district in whi ch the
421413 lead teacher is assigned, and
422414 c. the mentoring of other t eachers and participation in
423415 evaluations of other teachers.

451442 3. Teachers with a master teaching certificate may have a
452443 teaching load of not more than fi fty percent (50%) student
453444 instruction to allow the lead teacher to spend time on:
454445 a. co-teaching,
455446 b. co-planning,
456447 c. peer reviews, and
457448 d. other duties mutually agreed upon by the
458449 superintendent and the master teacher, and may be used
459450 to satisfy the qualita tive evaluation component for
460451 teachers as required by Section 6 -101.16 of this title
461452 by performing the duties set forth in this paragraph.
462453 K. L. The State Board of Education shall adopt rules to
463454 implement a renewal schedule and associated fees for lead an d master
464455 teaching certificates. The rul es shall allow a teacher that no
465456 longer meets the requirements o f a lead or master teaching
466457 certificate to make a pplication for the standard teaching
467458 certificate.
468459 L. M. The terms of the contracts issued to those hol ding lead
469460 and master teaching certificat es shall include the following:
470461 1. Lead: an additional ten (10 ) days to be used to strengthen
471462 instructional leadership. A person with a lead teaching certificate
472463 shall receive an annual salary supplement of at lea st Three Thousand
473464 Dollars ($3,000.00) or the district's daily rate of pay, whichever

502492 pursuant to Section 18 -114.14 of this title; and
503493 2. Master: an additional fifteen (15) days to be us ed to
504494 strengthen leadership. A person w ith a master teaching certificat e
505495 shall receive an annual salary supplement of at least Five Thousand
506496 Dollars ($5,000.00) or the district 's daily rate of pay, whichever
507497 is higher, in addition to the salary for which the teacher qualifies
508498 pursuant to Section 18-114.14 of this title.
509499 If a person with a lead or master tea ching certificate changes
510500 school districts during the life of the certificate, the terms of
511501 the contracts required in this subsection shall be subject t o
512502 approval by the new employing school d istrict.
513503 M. N. 1. Any person who is eligible for a lead or mas ter
514504 teaching certificate described in this sectio n shall make
515505 application for the following school year with the State Board of
516506 Education. The applicat ion shall include a recommendation from the
517507 local board of education and de termination that the applican t has
518508 met the statutory criteria. In reviewing a n application, the local
519509 school board of education and the superintendent shall consider the
520510 ability of the school district to fulfill the addi tional
521511 requirements described in su bsections I and J and K of this section
522512 before making a recommendation to the State Board of Education.

550539 2. The State Department of Education shall develop an
551540 application to impleme nt the provisions of this subsection and make
552541 it available to school districts.
553542 N. O. Beginning in the 2021-2022 school year, the Department
554543 shall make the teaching certificates provided for in this section
555544 available for any person who has received a reco mmendation from
556545 their local board of edu cation and who meets the eligibility
557546 criteria.
558547 O. P. For the 2019-2020 and 2020-2021 school years, the
559548 Department shall identify school districts to implement the teaching
560549 certificates provided for in this section o n a pilot program basis
561550 with the assistance of public-private partnerships, funding fro m
562551 philanthropic organizations or federal grants.
563552 P. Q. The Department shall seek funding necessary for the
564553 administration of this section. If funding for the administr ation
565554 of the teaching certificates liste d in subsections I and J and K is
566555 not available, the Dep artment shall not be required to fulfill the
567556 requirements listed in subsections L, M, N and, O, and P of this
568557 section.
569558 Q. R. The State Board of Education shall promulgate rules to
570559 implement the provisions of this act.
571560 SECTION 2. This act shall become effective November 1, 2022.
