4040 An Act relating to elections; amending 26 O.S. 2021,
4141 Section 4-101, which relates to voter registration;
4242 modifying conditions for voter eligibility; and
4343 providing an effective date.

4848 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4949 SECTION 1. AMENDATORY 26 O.S. 202 1, Section 4-101, is
5050 amended to read as follows:
5151 Section 4-101. Every person who is a qualified elector as
5252 defined by Section 1 of Article III of the O klahoma Constitution
5353 shall be entitled to become a registered voter in the precinct of
5454 his or her residence, with the following conditions:
5555 1. Persons convicted of a felony shall be eligibl e to register
5656 to vote when they have:
5757 a. fully served their senten ce of court-mandated calendar
5858 days or their sentence has been discharged , including
5959 any term of incarceration, parole or supervision, or
6060 completed a period of probation ordered b y any court,

8787 b. received a commutation that reduced the sentence t o
8888 time served pursuant to federal or state law ,
8989 c. received a commutation for a crime that has been
9090 reclassified from a felony to a misdemeanor pursuant
9191 to federal or state law, or
9292 d. been granted a pardon pursuant to federal or state
9393 law; and
9494 2. Any person who has bee n adjudged to be an incapacitated
9595 person as such term is defined by Section 1 -111 of Title 30 of the
9696 Oklahoma Statutes shall be ineligible to register to vote. When
9797 such incapacitated person has been adjudged to be no longer
9898 incapacitated such person shal l be eligible to become a registered
9999 voter. The provisions of this paragraph shall not prohibit any
100100 person adjudged to be a partially incapacitated person as such term
101101 is defined by Section 1-111 of Title 30 of the Oklahoma Statutes
102102 from being eligible to register to vote unless the order adjudging
103103 the person to be partially incapacitated restricts such person from
104104 being eligible to register to vote.
105105 SECTION 2. This act shall become effective November 1, 2022.
